EAST POISON, MT 59860 406.752-8815 March 1, 1996 Bruce Williams City Manager Subject: Water Easement Special Senses Partnership Dear Mr. Williams: In June 1993, FRDO, in consideration for the Conditional Use Permit for the land under consideration, recommended that the water easement be abandoned with the applicant bearing costs for relocation of the line (enclosure 1). Later in the summer, at a Site Plan Review Committee meeting, staff members made the same recommendation. Dr. Higgs and I, representing Special Senses Partnership, indicated that because of the cost of this project we had elected not to abandon the easement. At this juncture you pointed out that the current water easement was not ideal for the city, and proposed, therefore, that the easement be abandoned with the city participating in one- third of the cost. Special Senses Partnership agreed to this arrangement. It was understood that this project needed to move forward in a timely fashion in order to avoid costly delays with the building construction project. Mr. Meredith, in his letter of July 14th, has summarized the stages of the planning and construction of the water main relocation (enclosure 2). The total cost of the project was $62,630.00. The construction cost documents are enclosed. Special Senses Partnership paid the entire cost and we were reimbursed $15,000.00 by the city (enclosure 3). We believe the City of Kalispell's share of this project, per our agreement, is $21,210.00 and request reimbursement for the balance, $6,210.00.
