The requests were to 1) operate an espresso drive through window for The Boiler Room Coffee House, and 2) operate a bakery in the lower portion of the Boiler Room building. The PUD development agreement states that the Kalispell Site Review Committee is to determine whether the proposed amendments are minor or major in scope. Minor amendments can be administratively addressed by the site review committee and major amendments are forwarded to the council for deliberation and action. At the July 8, 2010 meeting of the site review committee it was determined that both of the amendments were minor in nature and consequently both amendment requests were approved. Attached is a letter sent to the applicant and owner Vince Padilla which lists the findings and conditions of approval made by site review for each amendment. Per the PUD development agreement, site review is to determine whether the proposed amendments are minor or major in scope. Minor amendments can be administratively addressed by the site review committee and major amendments are forwarded to the council for deliberation and action. The site review committee reviewed each request and determined the amendments to be minor in nature and approved both requests. The findings and conditions attached to each approval are listed below: Operation of an espresso drive -through window for The Boiler Room Coffee House Findings: • The coffee house is an "internal to the site" operation. • The addition of a drive -through window is a very minor expansion. • The drive -through window is intended to be a neighborhood oriented use. • There will not be any additional on- site signage which is intended to draw traffic from outside the neighborhood into the neighborhood. • The use would benefit those people in the neighborhood who would otherwise be in -route past the coffee shop. • Structural or aesthetic changes to the building would be minimal. • The drive -through window will not impede fire access to the property. • The conditions below will mitigate any adverse impacts. Conditions: 1. The drive -through window accessing out the west side of the Boiler Room Coffee House is approved per the site plan submitted with your request called "Parking Plan" which has been dated and signed by me. 2. The parking spaces 6, 8, & 10 shall be re -striped per the plan. 3. A drive lane serving the drive -through window shall be demarcated by a painted strip which allows for staking of a minimum of 3 vehicles (as shown on the approved site plan). Said painted strip shall be maintained for the duration of the drive -through window use. 4. One-way signs (two of them) shall be placed on either side of the westerly drive lane that serves the drive -through window to restrict traffic to a southerly flow past the drive -through window as shown on the attached site plan. 5. There shall be no additional freestanding signs associated with this use elsewhere on the property. Any additional signage on the Boiler Room Coffee House building must be approved by this office and receive a sign permit. 6. Prior to operation of the drive -through window, the applicant must contact the Kalispell Building Department to determine if there are any additional building code issues associated with modifying the drive -through window or operation of the coffee house. This would include the ability to reverse the swing of the westerly door that exits into the drive lane. 7. Prior to operation, the applicant must contact the Kalispell Public Works Department to determine if any additional impact fees would be associated with this expansion of use. Operation of a bakery in the lower portion of the Boiler Doom building Findings: • The lower level was always intended to be used for non-residential purposes and a glass blowing studio was originally envisioned to serve as an attraction for the coffee shop. • A bakery would be creating its own products on -site and was found to be compatible with the artists theme of East Side Brick. • The bakery would serve the coffee shop above as a primary customer but will also serve as a whole sale outlet to the greater community. • Delivery vans operating out of the bakery would be limited, small vans/vehicles as opposed to large commercial carriers. • The ability of the bakery to expand is physically limited by the space available. • The baker will operate in the mornings and early afternoon as opposed to around the clock. • Because of the size of the bakery space, the number of employees will be limited and thus not impact parking. • The bakery will not have a lower level retail counter. • The conditions below will mitigate any adverse impacts.
