Dear Mr. Carver:
Based upon a recent on -site observation of the referenced project site, the items listed
in the attached letters have not been corrected. I am notifying you at this time to
advise you that the work shall be completed or under contract to be completed not later
than September 11, 2004. Evidence of the work placed under contract shall be an
executed construction contract with a performance bond attached. If the work is not
completed by August 11, 2004, or the City has not received an executed construction
contract by August 11, 2004, the City will execute on its security in the Valley Bank
Letter of Credit (expiration date of August 11, 2004 in the amount of $249,261.38) to
pay for the work.

Dear Mr. Carver:
Recent cursory observations of the construction within the referenced development has
revealed that the extension of the sanitary sewer main and the water main to the West
property line of the referenced development within Teal Drive, specifically to the West
line of the East Half of Section 19, T28N, R21W, PMM, Flathead County, Montana, has
not been done. This extension was specifically requested by our letter dated July 18,
2004.
I am notifying you at this time to advise you that the work shall be completed or under
contract to be completed not later than August 31, 2004. Evidence of the work placed
under contract shall be an executed construction contract with a performance bond
attached. If the work is not completed by August 25, 2004, or City has not received an
executed construction contract by August 25, 2004, the City will execute on its security
in the Valley Bank Letter of Credit (expiration date of August 25, 2004, in the amount of
$74,800.00) to pay for the work.

Attached is a copy of the request by the developer to reduce the amount of the
subdivision improvement financial security to $65,115.36 and extend the completion
date of the improvements to June 30, 2006. An examination of the referenced project
was performed recently. We concur that the items remaining to be constructed are as
they appear in EXHIBIT B (dated 9/26/05). Public Works approves this request from the
developer.
The developer is providing a Letter of Credit for the amount of $65,115.36.

In accordance with Paragraph 1.b. of the attached Subdivision Improvement Agreement, please draw
down the Letter of Credit in the amount of $24,283.00. The Letter of Credit from Valley Bank is to
expire on August 25, 2004. This is the amount I have estimated that will be required to complete the
construction. The construction to be completed is:
1. Complete the temporary cul-de-sac at the West end of Teal Drive
2. Complete the sidewalks on the North side of Teal Drive
3. Complete the topsoil in the boulevards.
4. Install the street signs.
5. Adjust the curb valve boxes.

As we have discussed, boulevard trees that are planted too early, are subjected to an extremely harsh
environment (concrete trucks, carpenters, absence of water, etc.). As you have requested, I will
provide the City with financial security to assure that these trees will be installed. It appears that 22
trees will be required at an approximate cost of $200 per tree. We will, provide an irrevocable letter of
credit in the amount of 125% of the cost of the installed trees or $5500.00.
