ANNEXATION -SEWER & WATER COMMITTEE
MEETING
CONFERENCE ROOM -CITY HALL DECEMBER 21, 1983 4:00 P.M. WEDNESDAY
Present: Mayor McDowell., Councilmen Palmer, Ruiz, Grainger, Saverud and Nystul,
Councilmen elect Manning and Schindler, City Attorney Neier, Water Superintendent
Hughes, and Mike Fraser, Engineer, Thomas, Dean & Hoskins.
1. Extension of Services
Councilman Ruiz stated that he had reviewed the proposed "Extension of Services"
policy and has no objection to its passage. There was no protest from any of the
members present. Councilman Palmer stated that he would present it for adoption at
the January 3rd meeting under old business.
2. Proposed 38 bed Rest Home
Mike Fraser presented a map showing the proposed location for a 38 bed rest home.
It will be located north of second Wind Recreation Facility. FRDO has stated that it
will be in compliance with the Comprehensive Plan. It will be zoned RA-1 and the
general nature is already there. The area is 330 x 300' - 2.25 acres. They will not
use Windward Way as an access road, but will gain access by a 70' easement north of
the area to Highway #93. Developer will construct to City Standards and maintain.
Supt. Hughes stated that sewer and water line must be extended and needs to be up -
sized for our future needs and the developer will pay for what they need and the City
will pay the difference.
Councilman Palmer stated that he would like a definition of where the Comprehensive
Plan covers. There seems to be areas like this which just borders and lines are not
positively clear.
Councilman Palmer asked that the proposal be reviewed by the Fire and Police Chiefs
also.
City Attorney Neier advised council members that even though Mr. Verma has advised
that the proposal does conform to the Comprehensive Plan, if there are objectors,
they could find a loophole here and use it. The safest way to go is with a change in
the Comprehensive Plan.
Mr. Fraser stated that everything would be in order by the first Council meeting in
January and would like a resolution of intention to annex passed. He will obtain a
waiver of protest on the right-of-way for the road.
3. PUD
Hearing no protests, Councilman Palmer stated that he would recommend that a PUD
ordinance be enacted at the next meeting.
4. Resubdivision of Lot 2, Resubdivision of Lot 6, Block 7, Sunset Addition
Correspondence has been received from FRDO recommending approval of the above resub-
division. This area is just off Sherry Lane and will be residential single family.
No action by the committee.

5. BMB Annexation
Councilman Palmer reported a letter from the Federal Land Bank stating they did not
want to annex. Councilman Palmer stated that he thought the annexation had been
completed. He requested Water Superintendent Hughes review the file and see if they
have city services and why the annexation was not completed.
Meeting adjourned at 4:45 P. M.
