Change Order 1 Reservoir 2 MEMORANDUM To: Jarod Nygren – City Manager From: Keith Haskins, PE – Deputy Director Public Works CC: Susie Turner, PE – Director of Public Works Re: Change Order No. 1 – Lower Zone Storage Tank 2 Replacement Project – Asbestos Remediation Delay / Winter Shutdown Meeting Date: 6/15/2026 BACKGROUND: On October 20, 2025, City Council awarded the Lower Zone Storage Tank 2 Replacement Project to Preload, LLC for a contract price of $7,040,000.00. The project consists of demolition of the existing 2.7 MG water reservoir, which had a failing timber roof, and construction of a new 2.5 MG prestressed concrete water storage tank and surrounding infrastructure. Demolition of the existing tank could not proceed until asbestos remediation of the structure was completed, a task performed by the City. The project schedule assumed the existing tank would be drained and abatement would begin on February 9, 2026, with demolition starting February 16, 2026. The tank tested positive for asbestos on February 19, 2026, and remediation was not completed until April 27, 2026, a period of nearly ten weeks. This delay, which was outside the contractor’s control, pushed Preload’s construction schedule for the prestressed concrete tank into the winter months. Demolition of the existing tank has been completed and site work, including underground piping, is in process. This initial work is being completed by a local subcontractor to Preload (LHC). Preload has advised that due to the delay, they do not anticipate being able to fully complete construction of the new tank this construction season. In particular, the shooting of shotcrete cannot be completed during winter weather. Therefore, if tank construction commences this year, two mobilizations will be necessary and work completed this year will be subject to potential damage or loss through the winter weather. Preload submitted the attached Change Order Request, which presents three options for sequencing the remaining work and recovering the associated delay costs. Options 1 and 2 consider partial construction this year with completion next year. Option 3 considers full tank construction next year, meaning only site prep and piping currently underway would be completed this year. Option Description Cost Option 1 Pour floor and walls in 2026; complete the remainder of the tank in 2027 $138,992.00 Option 2 Pour floor, walls, and dome in 2026; maintain shoring and decking in place through the winter $210,759.00 Option 3 Defer all tank construction to 2027 (full winter shutdown) $89,467.00 RECOMMENDATION: Morrison-Maierle (MMI), the engineer of record for the City, has reviewed the change order request and the associated cost backup. Staff and the engineer recommend approval of Option 3 for the following reasons. Option 3 is the lowest cost of the three options and it avoids performing critical prestressed concrete and shotcrete work in cold weather, which Preload has indicated cannot be reliably completed during the winter. Option 3 also avoids the cost and risk of leaving shoring and decking in place over the winter, the associated material that would otherwise be discarded under Option 2, and the cold-weather productivity losses associated with winter construction. Because the delay was caused by asbestos remediation performed by the City and was outside the contractor’s control, deferring tank construction to 2027 allows the tank to be built in a single, continuous, favorable construction season. The principal trade-off is schedule. Under Option 3, final completion is projected for approximately October 2027, compared with late August 2027 under Option 1. Staff considers this additional time acceptable given the cost savings and the quality-assurance benefit of avoiding winter construction. Staff recommends approval of Option 3. Because the cost of the recommended option exceeds the City Manager’s $80,000 change order approval authority, this change order requires City Council approval. FISCAL EFFECTS: The cost of the recommended Option 3 is $89,467.00. Approval will increase the contract price from $7,040,000.00 to $7,129,467.00, as summarized below. Description Amount Original Contract Price $7,040,000.00 Change Order No. 1 (Option 3) $89,467.00 Revised Contract Price $7,129,467.00 The project is budgeted within the Water Fund under the line items used for the original award (5210- 447-430550-969 and 5210-447-430551-971). Sufficient appropriation remains within the project budget to cover this increase in contract price. ACTION REQUESTED: Motion to approve Change Order No. 1 (Option 3) to the Lower Zone Storage Tank 2 Replacement Project with Preload, LLC in the amount of $89,467.00, increasing the contract price from $7,040,000.00 to $7,129,467.00, and authorizing the corresponding adjustment to the contract completion dates, pending funding agency concurrence. ALTERNATIVES: The City Council may elect to approve Option 1 ($138,992.00) or Option 2 ($210,759.00) in lieu of the recommended Option 3, or as otherwise suggested and approved by the City Council. On 1/29/25 Preload received the notice to proceed dated 2/9/2026, in which it states that the demolition of the existing tank may not proceed until the asbestos remediation is completed, this task was handled by the City of Kalispell. The schedule assumed tank drain and asbestos abatement to start on the 9th of Feb, with demo of the tank to begin Feb 16th. On Feb 13th we got an email saying the city was still waiting for the results and it may take until the 23rd. On Feb 24th Preload submitted a Notice of Delay pointing out the delay from the broken drain line and noted the tank had tested positive for asbestos on the 19th. The remediation lasted until April 27th, almost 10 weeks, causing substantial delays to the overall project schedule and pushed Preloads tank work deep into the winter months. Due to the experience during the last tank, Preload does not foresee being able to complete the tank work, specifically shooting the shotcrete during the winter and is making plans to have a winter shutdown. Option 1 would be the cost to only pour the floor and the walls this year and return next year to complete the remainder of the tank. This option limits the rental costs and damaged material but is slightly longer next year. Option 2 would be the cost to proceed with standing the walls and pouring the dome but having to keep the shoring and decking installed over the winter as we do not expect to be able to complete the prestressing due to winter weather restricting the shooting of shotcrete. I have reworked the schedule for this scenario and it looks like we would not complete the tank work until 7/8/27. What kind of cost impacts would you incur if this were to play out? Can you start working on cost adders if you foresee this being something that effects your contract value? I have also attached a preliminary schedule, I would say this is worst case, best case would be get more done before we break but that highly unlikely with the risk of us not getting shoring out before winter sets in. On 1/29/25 Preload received the notice to proceed dated 2/9/2026, in which it states that the demolition of the existing tank may not proceed until the asbestos remediation is completed, this task was handled by the City of Kalispell. The schedule assumed tank drain and asbestos abatement to start on the 9th of Feb, with demo of the tank to begin Feb 16th. On Feb 13th we got an email saying the city was still waiting for the results and it may take until the 23rd. On Feb 24th Preload submitted a Notice of Delay pointing out the delay from the broken drain line and noted the tank had tested positive for asbestos on the 19th. The remediation lasted until April 27th, almost 10 weeks, causing substantial delays to the overall project schedule and pushed Preloads tank work deep into the winter months. Due to the experience during the last tank, Preload does not foresee being able to complete the tank work, specifically shooting the shotcrete during the winter and is making plans to have a winter shutdown. Option 1 would be the cost to only pour the floor and the walls this year and return next year to complete the remainder of the tank. This option limits the rental costs and damaged material but is slightly longer next year. Option 2 would be the cost to proceed with standing the walls and pouring the dome but having to keep the shoring and decking installed over the winter as we do not expect to be able to complete the prestressing due to winter weather restricting the shooting of shotcrete. Option 1 (floor and walls) $ 138,992.00 Option 2 (floor, walls, and dome) $ 210,759.00 Option 3 (full tank 2027) $ 89,467.00 Preload will request new Final Completion Dates once an option is selected. Due to the current economic climate including frequent fluctuations in both material prices and procurement lead times this quote is only valid for ten (10) days from the date of this letter unless otherwise defined within the attached backup. Its highly likely that we will have to have a winter shutdown during our work and that will delay the project substantially. I have reworked the schedule for this scenario and it looks like we would not complete the tank work until 7/8/27. What kind of cost impacts would you incur if this were to play out? Can you start working on cost adders if you foresee this being something that effects your contract value? I have also attached a preliminary schedule, I would say this is worst case, best case would be get more done before we break but that highly unlikely with the risk of us not getting shoring out before winter sets in.
