Dear Kalispell City Council,
I'm writing regarding Ordinance 1948,the Conditional Use Permit Revocation Text Amendment,
which would amend Kalispell Zoning Ordinance 1677 and create a new process for revoking an
issued conditional use permit.
Even with the recent revision limiting the ordinance to permits issued after January 15, 2026,the
proposal still poses serious risks. It grants the city broad discretionary power to revoke or
reconsider conditional use permits based on alleged "misrepresentations," including
unintentional ones.That expands the city's authority in a way that leaves every future business,
nonprofit, and property owner vulnerable to arbitrary decisions.
The carve-out for existing permits doesn't resolve the underlying problem; it simply pushes the
consequences onto future applicants.The message this sends is troubling: even if someone
follows the rules and invests in good faith,their permit could still be reconsidered or taken away at
anytime.
Rather than fostering economic development or public trust, Ordinance 1948 undermines
confidence in Kalispell's permitting process and invites further legal and financial risk.
I urge the City Council to reject this amendment.
