Contract Amendment 2- PFAS ResponseKALISPELL TO: Jarod Nygren, Interim City Manager FROM: Susie Turner, P.E., Public Works Director SUBJECT: Agreement Amendment - Response To Emerging Contaminant PFAS: Professional Services for Water Source Replacements and/or Treatment Alternatives MEETING DATE: October 6, 2025 BACKGROUND: In May 2024, the City entered into a professional services agreement with Robert Peccia & Associates (RPA) to evaluate alternatives in response to PFAS detections in the City's source water, design the selected project, and provide construction management services. Amendment No. 1 was approved to advance professional services following selection of the preferred alternative in April of 2025. With design now entering the final stages, including new wells, well facilities, transmission mains, and booster station improvements, Amendment No. 2 to the professional services agreement is required to support design completion, coordination and construction management services. REQUIRED SERVICES: The consultants will generally be tasked to support the following as part of the amended agreement: 1. Preliminary Engineering Report - Upper Pressure Zone - complete 2. Preliminary Engineering Report - Lower Pressure Zone - complete 3. Temporary Treatment Support -complete 4. Public Outreach 5. Funding Support 6. Access, Easement, and Utility Coordination 7. Well Design, Water Rights, and Drilling Oversight 8. Engineering Design and Geotechnical Report 9. Facility Bidding and Negotiating Services 10. Facility Construction Inspection Services 11. SCADA Integration 12. Post Construction Phase Services 13. Drilling and Sampling Test Wells - complete ACTION REQUESTED: Motion to approve the updated agreement with Robert Peccia & Associates for the Response To Emerging Contaminant PFAS: Professional Services for Water Source Replacements and/or Treatment Alternatives Project and allow the City Manager to execute the amended professional service contract. Emerging contaminant grant funding which includes both a forgivable loan from the State Revolving Fund program and a grant managed by DEQ for a total of $23,617,000. The City has submitted an application for grant funding and has executed an agreement for funding support for professional services up to the bidding phase. The funding of the continued professional service contracts and construction amounts are contingent upon the City securing the forgivable loan and grant funding. ENCLOSURE: Professional Service Agreement -Amendment 2 Public Works Department, 201 1st Ave E, Kalispell, MT www.Kalispell.com PROFESSIONAL SERVICES AGREEMENT AMENDMENT TWO Response To Emerging Contaminant PFAS: Professional Services for Water Source Replacements and/or Treatment Alternatives This Amendment to the Response To Emerging Contaminant PFAS: Professional Services for Water Source Replacements and/or Treatment Alternatives ("Amendment") is hereby executed and effective as of , 2025, and is intended to modify and to replace certain terms of the Response To Emerging Contaminant PFAS: Professional Services for Water Source Replacements and/or Treatment Alternatives ("Agreement") previously executed on or about May 7, 2024, by and between the City of Kalispell ("CITY") and Robert Peccia & Associates, Inc., hereinafter referred to as ("CONSULTANT"). RECITALS WHEREAS, the Parties entered into the Agreement on May 7, 2024. WHEREAS, the Parties desire to amend the Agreement on the terms and conditions set forth in this Amendment. WHEREAS, this Amendment is the first Amendment to the Agreement. NOW, THEREFORE, the Parties agree to amend and extend their obligations in the existing Agreement for other valuable consideration, the receipt and sufficiency of which is hereby acknowledged, the Parties agree to keep, perform, and fulfill the promises, conditions, and agreements of the Agreement and this Amendment as enumerated below: Section 1.
