MINUTES OF REGULAR MEETING
July 8, 2025
CALL TO ORDER AND ROLL
The regular meeting of the Kalispell City Planning Board and
CALL
Zoning Commission was called to order at 6:00 p.m. Commission
members present were Chad Graham, Doug Kauffman, Shelby
Leckron (Zoom), Joshua Borgardt, Pip Burke, Cate Walker and
Rory Young. Jarod Nygren, PJ Sorensen, Kari Barnhart, Kirstin
Robinson, and Donnie McBath represented the Kalispell Planning
Department. Keith Haskins represented the Kalispell Public
Works Department.
APPROVAL OF MINUTES
Young moved and Borgardt seconded a motion to approve the
minutes of the June 10, 2025 meeting of the Kalispell City
Planning Board and Zoning Commission.
VOTE BY ACCLAMATION
The motion passed unanimously on a vote of acclamation.

BOARD MEMBER SEATED
Young recused himself from KA-25-05 and KCU-25-04; he is a
representative for the applicant.
KA-25-05 & KCU-25-04 — NORTH
File #KA-25-05 and KCU-25-04 - Roger Foley, through his
MEADOWS MULTI -FAMILY
representative Jackola Engineering & Architecture, PC, has
submitted applications for annexation, initial zoning of RA-1
(Residential Apartment), and a Conditional Use Permit (CUP) for
the development of a 99-unit multi -family residential complex.
The proposed project is located at 1859 South Meadows Drive
and encompasses approximately 12.13 acres.
STAFF REPORT
Donnie McBath representing the Kalispell Planning Department
reviewed Staff Reports #KA-25-05 and KCU-25-04.
Staff recommends that the Kalispell City Planning Commission
adopt Staff Report #KA-25-05 as findings of fact and recommend
to the Kalispell City Council that the property be annexed and the
zoning for the property be city RA-1 (Residential Apartment).
Staff recommends that the Kalispell City Planning Commission
adopt staff report #KCU-25-04 as findings of fact and recommend
to the Kalispell City Council that the conditional use permit be
approved subject to the conditions on the staff report.
BOARD DISCUSSION
Sorensen clarified the permanent cul de sac to Kauffman.
McBath advised Burke that there was no phasing planned for the
project. Graham confirmed with Sorensen that R4 and RAl
zoning carry the same allowable density. McBath clarified the
fence locations to Leckron.

PUBLIC COMMENT Rhonda Hawkins — 1731 Bluestone Dr - Opposes the project and
has concerns about traffic, safety, and the single access to the
apartments.
Diane Marshall 1923 Bluestone Dr Opposes the project and
has concerns about traffic; particularly during the summer due to
nearby baseball games.
Lisa Najera - 119 Rimrock Ct - Opposes the project and has
concerns about traffic and density.
Ricki Moffat — 147 Rimrock Ct — Opposes the project and has
concerns about safety, density, geotechnical issues, wildlife
impacts, infrastructure capacity, overcrowded schools, increased
taxes, and the single access to the apartments. Also feels that the
project does not meet the character of the neighborhood.
John Pipolo 139 Rimrock Ct Opposes the project because he
feels that it is not in line with the Growth Policy and it does not
meet the character of the neighborhood. He has concerns about
traffic and light pollution.
Luke Irwin -- I I I Denver Ave -- Opposes the project and has
concerns about safety and speeding. He lives by the speed bumps
on Denver Ave and stated that people still speed over them.
Clyde Steinberg - 1810 N Belmar Dr Opposes the project and
has concerns about safety, soil stabilization, and increased crime.
Perry Diioro 143 Rimrock Ct Opposes the project and has
concerns about geotechnical issues, traffic, and wildlife impacts.
Karl Kratt - 135 Rimrock Ct -- Opposes the project and has
concerns about his property value, and noise, ground, and water
pollution.
Jacqueline Pipolo 139 Rimrock Ct Opposes the project and
has concerns about the size of the project, and traffic. She also
feels that the notification process was insufficient.
Deidre Thompson 120 Denver Ave Opposes the project and
has concerns about traffic.
Tony Shamp 1826 N Belmar Dr Requested more information
about the application process. Graham explained the process to
him.
Jennifer Bennett 120 Denver Ave Opposes the project and has
concerns about traffic and the loss of views.
Melissa Pliley — 1912 S Meadows Dr — Opposes the project and
has concerns about safety and noise pollution; particularly during
the construction process.

Amber Pirie — 711 8` Ave W — Opposes the project and has
concerns about traffic, safety, wildlife impacts, and snow
removal.
Kim Smith- 1827 Bluestone Dr — Agrees with the previous
comments opposing the project and has concerns with traffic and
wildlife impacts.
Mark Topp — 107 Denver Ave — Opposes the project and has
concerns about the single access to the apartments, traffic,
geotechnical issues, safety, construction traffic, and density. He
also feels that the project doesn't fit the neighborhood.
Jessica Chance — 1934 Bluestone Dr — Opposes the project and
has concerns about construction traffic. She also feels that the
project does not fit the neighborhood and that more apartments in
Kalispell are not needed.
Patrick Hawkins — 1731 Bluestone Dr — Opposes the project and
has concerns about traffic and the single access to the apartments.
Matthew Nelson — 107 Denver Ave — Opposes the project and
feels that it's unfair to the existing homeowners.
Annie Canfield — 131 Rimrock Ct — Opposes the project and has
concerns about traffic, wildlife impacts, soil stabilization, and
stormwater.
Sue Prewitt — 1910 Bluestone Dr — Opposes the project and has
concerns about traffic, safety, and speeding.
Susan Pratt — 135 Rimrock Ct — Opposes the project and has
concerns about traffic and decreased property values.
Abby Elkins — 202 Phoenix St — Opposes the project and has
concerns about traffic, safety, decreased property values, noise,
and light pollution.
Toby McIntosh — 2250 Hwy 93 S — Representative for the
applicant — Stated that the CUP conditions address the public's
concerns. Is happy to answer any questions that the commission
may have.
Nicole Fusaro Marshall — 1823 Bluestone Dr — Opposes the
project and has concerns about safety, traffic, and parking in the
street.
Austin Groszewski — 120 Rimrock Ct — Opposes the project and
has concerns about safety and noise pollution and feels that
apartments do not bring ownership to the neighborhood.

Maximillian Fusaro —1823 Bluestone Dr — Agrees with all of the
concerns the previous commentors have and would like to know
how tall the buildings will be and how long the construction
process would be.
MOTION — KA-25-05 Kauffman moved and Burke seconded that the Kalispell City
Planning Commission adopt Staff Report #KA-25-05 as findings
of fact and recommend to the Kalispell City Council that the
property be annexed and the zoning for the property be city RA-
1 (Residential Apartment).
BOARD DISCUSSION McBath clarified the building height to Kauffman. Haskins
advised Walker that improvement plans for pedestrian circulation
are not required. Haskins advised Borgardt that the TIS and traffic
counts were conducted in May 2025 and traffic control at the
intersection of South Meadows Dr and Bluestone Dr would be
required but has not been reviewed by the city yet. He also
advised there is no requirement for the TIS to take baseball game
traffic into account. Graham explained to the public of the
notification process and infrastructure services being nearby
versus onsite. Haskins confirmed that water and sewer services
are near the site and would require an extension. Graham stated
that Bluestone Dr is narrow and isn't sure if it can handle the
construction traffic. Haskins stated that the city can control haul
routes and explained the road rating process. Sorensen added that
the developer is responsible for mitigating impact. Borgardt
stated that a dump truck could not drive on Bluestone Dr if cars
were parked on both sides and clarified with Sorensen that 100
units would require a second entrance whereas 99 only requires
one. Leckron stated that she would prefer single family houses on
the site. Sorensen advised Kauffman that multi -family units fit the
property better and that the CUP process addresses setbacks and
geotechnical issues. Sorensen stated that the annexation makes
sense because it is wholly surrounded by properties that are in city
limits and advised that substantial compliance to the site plan
would be required if approved.
ROLL CALL Motion passed 5-1 on a roll call vote. Kaufman, Burke, Borgardt,
Walker, and Graham voted in favor; Leckron voted against the
motion.
MOTION KCU-25-04 Kauffman moved and Burke seconded that the Kalispell City
Planning Commission adopt staff report #KCU-25-04 as findings
of fact and recommend to the Kalispell City Council that the
conditional use permit be approved subject to the conditions on
the staff report.
BOARD DISCUSSION Sorensen clarified to Leckron that school impacts cannot be
considered for a subdivision and the CUP cannot address them
because schools are their own separate entity. Graham stated that
he has concerns about the safety on Bluestone and the single
access to the apartments. Sorensen advised that the single access
meets subdivision regulations and fire code. Haskins advised

Kauffman that only the extension of South Meadows and the
water service would be public and that all else is private. Haskins
advised Leckron that the city cannot require another TIS that
includes baseball game traffic. Toby McIntosh from Jackola
Engineering clarified the geotechnical, building permit, and road
load processes to Borgardt and stated that the developer will not
consider improving Bluestone Dr. Haskins described the speed
analysis process to Borgardt. Graham stated the plans do not fit
the area and that he has concerns about the condition of Bluestone
Dr with additional traffic including construction traffic, safety,
and geotechnical issues. Walker stated that geotechnical issues
can be mitigated but she is concerned about the single access and
safety. Kauffman and Borgardt stated that they would like to see
a TIS conducted during summer to reflect the baseball game
traffic.
ROLL CALL
Motion failed 2-4 on a roll call vote. Kaufman and Burke voted
in favor; Leckron, Borgardt, Walker, and Graham voted against
the motion.
BOARD DISCUSSION
Sorensen advised the commission that it could make a motion to
table the CUP to the August 12, 2025 Planning Commission
meeting or vote to forward the CUP to City Council with a
recommendation for denial. He also advised that a work session
is not required for CUPs.
