Motor Vehicles and Traffic
BACKGROUND: Peterson Elementary School staff contacted Public Works to request the
establishment of short-term parking on the south side of 2nd Street West, from South Meridian
Road approximately 110 feet east. Changes in adjacent land use reduced longstanding off-street
parking availability, prompting school representatives to seek updated options for pickup, drop-
off, and short-term parking adjacent to the school.
Under current regulations, establishing short-term parking requires a code amendment adopted
by City Council. At the August 25, 2025, work session, Council reviewed amendment options
and reached consensus to update Section 17-82. The intent is to allow short-term parking for
schools to be permitted administratively, consistent with the process currently used for loading
zones.
The recommended amendment to Section 17-82 incorporates Council’s direction from the work
session. Specifically, the update would:
•Allow school short-term parking requests to be processed through the administrative permit
process, enabling quicker, more flexible responses to evolving needs.
•Mirror the existing permitting framework for loading zones.
•Allow staff to evaluate roadway conditions, apply standards, and issue permits without
requiring a code amendment for each individual request.
Proposed Amendment:
The updated language for Section 17-82 Parking Spaces for Taxicabs, Buses and Delivery
Vehicles; Permits for; Unlawful Use Prohibited is as follows (underlined text indicates new
language):
A.Permit: The City may grant to any person, K-12 school, agency or business a permit for the
permanent use of a reserved parking space on a public street or City owned or operated off-street
parking lot for use of a taxicab, bus, delivery vehicle or similar commercial vehicle or device
used for the transportation of persons or property. The City may grant any K-12 school a permit
for loading areas and/or short-term parking.
Additionally, Council directed staff to update Section 17-90 Overtime Parking Prohibited; Two
Hour Parking on Certain Streets by striking Section D and applying the revised 17-82 process to
establish short-term parking for Hedges School on Fourth Avenue East between Ninth Street
East and Eighth Street East.

D. One Hour Parking: It is unlawful and a violation of this article for any person to permit a
vehicle to remain parked continuously in any individual parking space for more than one hour
between 8:00 a.m. and 6:00 p.m. on any day except Saturday or Sunday or a legal holiday on the
following street:
1. The east side of Fourth Avenue East between Ninth Street East and Eighth Street East.
ACTION REQUESTED: Motion and vote to approve the first reading of Ordinance 1942 -
Amending Municipal Code Chapter 17 Motor Vehicles and Traffic.
ALTERNATIVE: As suggested by City Council.

ORDINANCE NO. 1942
AN ORDINANCE AMENDING KALISPELL MUNICIPAL CODE, CHAPTER 17,
ARTICLE 4, STOPPING, STANDING AND PARKING GENERALLY, BY AMENDING
SECTION 17-82, PARKING SPACES FOR TAXICABS, BUSES AND DELIVERY
VEHICLES, AND SECTION 17-90, OVERTIME PARKING PROHIBITED,
DECLARING AN EFFECTIVE DATE, AND AUTHORIZING THE CITY ATTORNEY
TO CODIFY THE SAME.
WHEREAS, it is in the best interests of the City and its residents and visitors that its ordinances
be reassessed and updated from time to time to ensure that the interests of the public
are being properly served; and
WHEREAS, during a work session requested by School District 5 regarding temporary parking
during a lengthy construction project across the street from a school, proposed
amendments were suggested to KMC Chapter 17, Section 17-82, Parking Spaces
for Taxicabs, Buses and Delivery Vehicles, and Section 17-90, Overtime Parking
Prohibited; and
WHEREAS, the Kalispell City Council finds that the amendments to KMC Chapter 17, Section
17-82 and 17-90, as set forth in Exhibit “A”, attached hereto, are necessary and
proper to respond effectively to schools requesting short term parking options.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
KALISPELL AS FOLLOWS:
SECTION 1. The City of Kalispell Municipal Code, Chapter 17, Sections 17-82 and 17-
90, is hereby amended as set forth in Exhibit “A”, attached hereto and
incorporated fully herein by this reference.
SECTION 2. The City Attorney is hereby authorized and directed to codify this
Ordinance.
SECTION 3. This Ordinance shall take effect thirty (30) days after its final passage.
PASSED AND APPROVED BY THE CITY COUNCIL AND SIGNED BY THE MAYOR OF
THE CITY OF KALISPELL THIS 20TH DAY OF SEPTEMBER, 2025.
