Subject: Resolution 6276- Resolution to Amend Current Impact Fees to Comply
with Senate Bill No. 133

BACKGROUND: The City's current impact fees for Water, Sewer Collection, Sewer
Treatment, Stormwater, Police, and Fire include a 5% administrative fee, as allowed under MCA
7-6-1601.
Earlier this year, the Legislature passed Senate Bill (SB) 133, amending MCA Sections 7-6-1601
and 7-6-1602. SB 133 eliminates the administrative fee previously included as part of impact
fees. To comply with this change, the City must adjust current impact fees by removing the 5%
administrative portion.
ACTION REQUESTED: Motion to approve Resolution 6276, amending the City's impact fees
for Water, Sewer Collection, Sewer Treatment, Stormwater, Police, and Fire to remove the 5%
administrative charge.
ALTERNATIVES: Council can elect to amend or reject the resolution.

RESOLUTION NO. 6276
A RESOLUTION ADJUSTING THE WATER, SEWER COLLECTION, SEWER
TREATMENT, STORMWATER, POLICE, AND FIRE IMPACT FEES TO REMOVE THE
FIVE PERCENT (5%) ADMINISTRATIVE FEE, PURSUANT TO THE RECENTLY
ENACTED SENATE BILL 133.
WHEREAS, the City's current impact fees for Water, Sewer Collection, Sewer Treatment,
Stormwater, Police, and Fire include a 5% Administrative Fee, as allowed under
MCA 7-6-1601; and
WHEREAS, the 2025 Legislature passed Senate Bill (SB) 133, amending MCA Sections 7-6-1601
and 7-6-1602, which eliminates the Administrative Fee previously included as part of
impact fees; and
WHEREAS, in order to comply with the requirements of SB 133, the Kalispell Water, Sewer
Collection, Sewer Treatment, Stormwater, Police, and Fire Impact Fee schedules are
required to be amended to reflect the removal of the 5% Administrative Fee.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
KALISPELL, MONTANA:
SECTION 1. That the Water, Sewer Collection, Sewer Treatment, Stormwater, Police, and
Fire Impact Fees each be amended to reflect the removal of the previously
allowed 5% Administrative Fee.
SECTION 2. That these impact fee schedule amendments shall become effective by
September 30, 2025.
