Resolution 6266 - FAILED - Police & Fire Impact Fees07-07-25 FAILED 1- 7 RESOLUTION NO. 6266 A RESOLUTION AMENDING RESOLUTION NOS. 5744 AND 5745 TO ADJUST THE POLICE AND FIRE IMPACT FEE SCHEDULES PURSUANT TO THE RECOMMENDATIONS OF THE IMPACT FEE COMMITTEE AND SENATE BILL 133. WHEREAS, the City Council passed Ordinance 1587 on October 16, 2006, which authorized the imposition of impact fees for police and fire services; and WHEREAS, subsequent to the passage of Ordinance 1587 the city established impact fees for police and fire services; and WHEREAS, the City Council passed Resolutions 5441 and 5442 on August 2, 2010, and Resolutions 5744 and 5745 on December 7, 2015, adjusting the police and fire services impact fees; and WHEREAS, pursuant to MCA 7-6-1602 the Impact Fee Advisory Committee analyzed the police and fire services impact fees, collaborated with city staff in developing the City of Kalispell Final Reports of Impact Fees for the Police Department and the Fire Department, dated March 2025, and is now recommending accordingly that the currently established impact fees be adjusted to more accurately reflect the current costs of local construction as set forth in the report, as well as implementing those changes provided by SB 133; and WHEREAS, Exhibit A attached hereto sets forth the fee schedules that have been recommended by the Kalispell Impact Fee Committee for both police and fire services impact fees. The City Council finds that the City of Kalispell Final Reports of Impact Fees for the Police Department and the Fire Department, dated March 2025, referenced herein, as approved and submitted by the Kalispell Impact Fee Committee, along with the plan and schedule reasonably reflects the capital needs for police and fire services in the City that may be reasonably charged through a police and fire services impact fee. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF KALISPELL, MONTANA: SECTION 1. That the Police and Fire Impact Fees be set pursuant to the Schedule attached hereto as Exhibit "A" and incorporated fully herein by this reference and that the City Clerk be directed to make the City of Kalispell Final Reports of Impact Fees for the Police Department and the Fire Department, dated March 2025, available to the public upon request. SECTION 2. That this resolution adjusting the impact fee schedules shall become effective immediately.
