Resolution 6264 - ROI - Amend Growth Policy - Reserve at Johnson RanchRESOLUTION NO.6264 A RESOLUTION OF INTENTION TO ADOPT, REVISE OR REJECT A PROPOSED AMENDMENT TO THE KALISPELL GROWTH POLICY — PLAN IT 2035 TO AMEND THE DESIGNATION OF PROPERTY DESCRIBED AS (1) PARCEL B OF CERTIFICATE OF SURVEY NO. 14346, LOCATED IN THE SOUTHEAST QUARTER OF THE NORTHEAST QUARTER OF SECTION 26, TOWNSHIP 29 NORTH, RANGE 22 WEST, P.M.M., FLATHEAD COUNTY, MONTANA; AND (2) THE EAST HALF OF THE SOUTHEAST QUARTER OF SECTION 26, TOWNSHIP 29 NORTH, RANGE 22 WEST, P.M.M., FLATHEAD COUNTY, MONTANA, EXCEPTING THEREFROM THAT PORTION DEEDED TO FLATHEAD COUNTY FOR ROAD PURPOSES, RECORDED DECEMBER 5, 1899, IN BOOK 30, PAGE 582, AND ALSO EXCEPTING THEREFROM THAT PORTION DEEDED TO THE MONTANA DEPARTMENT OF TRANSPORTATION FOR HIGHWAY PURPOSES, RECORDED JUNE 28, 2007, AS DOC. NO.2007-179-14150, AND TO CALL FOR A PUBLIC HEARING. WHEREAS, the Kalispell Growth Policy Plan It 2035 was originally adopted by the Kalispell City Council on July 3, 2017; and WHEREAS, the applicants, Spartan Holdings and Whispering Trails, have formally requested a growth policy amendment on approximately 91.8 acres generally situated at the northwest corner of Old Reserve Drive and Stillwater Road, and includes property located at 1053 Stillwater Road; and WHEREAS, the Kalispell Planning Commission has determined that it would be appropriate to amend the Growth Policy by changing the above land use designations to those requested; and WHEREAS, the area to be included is described as generally situated at the northwest corner of Old Reserve Drive and Stillwater Road, and includes property located at 1053 Stillwater Road; and WHEREAS, on June 10, 2025, the Kalispell Planning Commission held a public hearing, after due and proper notice, received public comment upon, and reviewed Kalispell Planning Department report #KGPA-25-01, which evaluated the proposal based upon the goals and objectives of the Growth Policy, the purpose of zoning and current circumstances in the planning jurisdiction; and WHEREAS, at the conclusion of said public hearing and after consideration of the proposed amendment, the Kalispell Planning Commission adopted report #KGPA-25-01, as the findings of fact and recommended approval of the proposed Growth Policy amendment; and WHEREAS, the Kalispell City Council considers it advisable that they consider the proposed Growth Policy Amendment and the recommendations of the Kalispell Planning Commission, and adopt a Resolution of Intention to Adopt, Revise or Reject a Proposed Amendment to the Kalispell Growth Policy -- Plan It 2035. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF KALISPELL, AS FOLLOWS: SECTION 1. That pursuant to Section 76-1-604, MCA, the Kalispell City Council intends to consider a proposed amendment to the Kalispell Growth Policy — Plan It 2035, and a recommendation by the Kalispell Planning Commission to grant said amendment, consisting of approximately 91.8 acres generally situated at the northwest corner of Old Reserve Drive and Stillwater Road, and includes property located at 1053 Stillwater Road, in Section 26, Township 29 North, Range 22 West, P.M.M., Flathead County, Montana. SECTION 2. The City Council will hold a public hearing on the proposed growth policy amendment on July 21, 2025, at 7:00 p.m. in the City Hall Council Chambers located at 201 First Avenue East, Kalispell. SECTION 3. At the regular meeting of August 4, 2025, the City Council will consider Resolutions to Adopt, Revise, or Reject said proposed amendment. SECTION 4. The City Clerk is authorized and directed to give notice of said meeting in accordance with Section 7-1-4127, MCA. The Kalispell Planning Commission has considered the amendment, held a public hearing on June 10, 2025, and presented Resolution KGPA-25-01 to the Kalispell City Council recommending adoption of the amendment. The Kalispell City Council, on July 7, 2025, passed a Resolution of Intention to Adopt, Revise, or Reject a Recommended Amendment to the Kalispell Growth Policy -- Plan It 2035. On July 21, 2025, at 7:00 pm in the City Hall Council Chambers, 201 First Avenue East, Kalispell, the Kalispell City Council will hold a public hearing regarding the proposed amendment to the Kalispell Growth Policy — Plan It 2035. The proposed amendment can be viewed on the city's website at www.kalispell.com/CouncilHearing_s or in the office of the City Clerk at 201 First Avenue East, Kalispell. Any person wishing to address the proposed amendment may appear at this hearing and make oral statements or present same in writing.
