This item considers annexation and initial zoning of R-2 (Residential) with a Planned Unit
Development overlay and preliminary plat approval for 355 lots on 110.5 acres located on
the north side of Tronstad Road between Highway 93 North and Whitefish Stage Road,
opposite of Sirucek Lane.

01:11:21 Council Member Graham asked questions related to public comment received and
related to condition 919.
01:14:28 Council Member Hunter disclosed that he works for the Flathead Land Trust which is a
member of the Montana Association of Land Trust, a state-wide organization and their primary
duty is to interact with the state legislator on policy regarding land trust and community. The
Montana Association of Land Trust has hired Mr. Sanjou, one of the applicants, as a lobbyist.
Council Member Hunter does not have any interaction with Mr. Sanjou or any responsibilities in
regards to the Montana Association of Land Trust so he does not feel this is a conflict of interest.

01:23:14 Daniel Munzing, Public Comment
Mr. Munzing asked Council to consider denial of the zoning based on his view related to road
infrastructure. If passed he would request that Council add lighting standards as a condition, the
deletion of condition 919 explaining why he would like that condition removed. He continued
with safety concern comments related to the hill on Tronstad. He explained why he would like
Council to add a condition that the signal (at Hwy 93) be in and functional prior to phase 1. He
explained they have hired someone to study traffic impact and an attorney.

Bolander talked regarding his usage of Tronstad Road and safety concerns he has when the road
receives snow. He then spoke to his view that City Fire and Police would not be adequate to
serve the proposed subdivision. He spoke to his view that water capacity may not be sufficient.

Holitt of 299 Whitefish Stage Road spoke regarding why he moved to the area and why he feels
others are moving here. He then explained why he does not like the design of the subdivision or
that of adjacent Quail Meadows. He spoke regarding his view related to safety concerns.

Davis of 7 Tronstad Lane spoke regarding agricultural truck usage on Tronstad Lane and related
safety concerns. She then spoke regarding concerns related to school bus loading.
01:49:26 Jessica Bubar, Public Comment
Bubar of 250 Highland Drive spoke regarding the County's Master Plan and feels that this
subdivision goes against the County Master Plan and the infrastructure that is in place explaining
why she feels that way.

Sartain said he is speaking as an unofficial representative of those residing in Quail Meadows
and said he has concerns related to safety on Tronstad and spoke regarding the need for a signal.
01:54:18 Michelle Taylor, Public Comment
Taylor spoke in opposition to the density of the proposed subdivision and traffic safety concerns
on Rose Crossing and Tronstad. She feels the proposed traffic light would not increase safety and
does not feel Tronstad Road can handle additional traffic. She feels the subdivision would ruin
the rural nature of the area.

Moses of Whitefish Stage spoke regarding why he feels the density proposed is inappropriate

and feels it should be reduced by one-third to half of the units proposed and spoke to adjacent
road safety concerns and to the rural nature of the area.
01:59:35 Amy Vanderbilt, Public Comment
Vanderbilt explained why she believes the density of the proposal is twice as large as it should be
and spoke to traffic safety concerns and would like the road improved prior to approval. She then
spoke to concerns related to denigration of the rural aspect of the area. She also spoke regarding
light pollution. She has concerns related to fire safety and snow and spoke further regarding her
concerns related to traffic infrastructure.

Kennedy of 1503 Greenday Court spoke regarding the amount of people that are not happy with
this proposal. She feels the proposal does not consider children living in the area and that the
proposal is too dense.
02:05:20 Mary Olson, Public Comment
Olson off Whitefish Stage Road spoke to questions and concerns related to the size of the streets
within the subdivision and possible issues related to snow, parking, and busses. She spoke about
traffic safety concerns and feels the proposal is too dense.
02:07:53 Public Comment
236 Tronstad Road spoke to previous public comments she provided in writing. She feels the
rural area should not be disturbed and talked regarding her experiences living in California and
farmland being converted to businesses and subdivisions and her view that the same is happening
in Kalispell.
02:12:32 Dan Pearson, Public Comment
Pearson on Whitefish Stage spoke regarding moving to the area for the rural environment. He
then spoke to the amount of public comment received and his concerns related to where children
will play, and snow will be stored. He feels the density should be reduced by one-third to half.

02:14:23 Eric Anderson, Public Comment
Anderson of Birch Grove feels the proposal does not integrate with the environment and is a
standalone development and should not be added to the City. He spoke in detail about his
concerns related to road infrastructure.
02:15:59 Doug Bennett, Public Comment
Bennett of Sirucek spoke regarding the construction happening on Reserve Drive and diversion
of traffic to other roads during construction and his concern that Sirucek would be used during
construction to Tronstad Road.
02:17:47 Rick Nys, Public Comment
Mr. Nys with Greenlight Engineering in Oregon explained he was hired by the Munzing's to
review the application and the Traffic Impact Study and his views related to information he
believes should be included or is incorrect within the study and items he believes should be

considered. He explained he conducted his own traffic impact study and explained the
conclusions he came to.
02:23:53 Kim Wilson, Public Comment
Wilson, of Morrison Sherwood Wilson Deola spoke as a Lawyer representing the Alliance for
Responsible Development in the Flathead Valley and Dan and Ming Munzing. He stated reasons
why he believes the proposal will have negative effects on the community and spoke in detail
regarding why he feels the proposal should not be approved. He spoke to written comments
submitted that further state their reasoning and conditions they believe should be in place prior to
approval if so approved.
02:29:50 Sandy Muller, Public Comment
Muller of Tronstad Drive spoke of her opposition to the proposal and to her belief that the
proposal has not changed since it was first submitted and referred to her previous comments. She
spoke to her assumptions regarding why the proposal includes a PUD. She spoke to her
experiences living in Hawaii and her concerns related to infrastructure and fire safety.

02:41:03 Colby Shaw, Public Comment
Shaw of 89 Tronstad Drive spoke in opposition and regarding his safety concerns and stated that
the subdivision contained within condition 19 does not want sidewalks if the subdivision is
approved and their concerns that they would then be forced to annex into the City.
02:42:08 Ming Munzing, Public Comment
Munzing of 213 Tronstad Road spoke regarding why the Alliance for Responsible Development
in the Flathead Valley was formed. She spoke regarding the number of public comments in
opposition to the proposal and read aloud one of her written public comments. She spoke to her
views in opposition to the proposal and her view that City standards will not be met if the
proposal is approved providing reasons why she feels that way and why she does not believe the
proposal should be approved. She spoke regarding how she would like a proposal for that
location to be designed.

Osborne of 67 Tronstad Drive spoke in opposition to the proposal and in opposition to condition
19 saying those within Koenig Subdivision do not want sidewalks installed in front of their
homes.
02:56:29 Abe, Public Comment
Abe of Tronstad Road asked about the number of lots and their sizes and said he would like a
barrier to be installed on the other side of the road in front of his home. He talked regarding his
well output and concerns that may change.
02:58:36 Danielle Tully, Public Comment
Tully of 280 Highland Drive referred to her many previous written and verbal comments and
reasons why she does not agree with the proposed density of the proposal. She asked why

proponents of the subdivision are being asked to speak last. She then spoke to her views related
to the applicant's website and to her view on the lack of support for the subdivision and the
number of comments in opposition. She referred again to her previous comments and written
comments submitted and her view that the applicants are not truthful and to her views that the
Traffic Impact Study is not accurate. She spoke regarding her safety concerns and further about
how she feels the developers are being deceptive and her view that the City would be accepting
liability if the proposal is approved.
03:13:56 Travis Taylor, Public Comment
Taylor of 1210 Birch Grove Road spoke in opposition to the density of the proposal and does not
want Tronstad Road to be improved. He then spoke to his concerns related to safety he feels
would come with additional traffic and does not feel the proposal is the correct fit within the
area.
03:22:45 Eric Mulcahey, Public Comment
Mulcahey of Sand Surveying spoke on behalf of the development group for this project. He
began by thanking the public for their comments and stated they agree with the findings the staff
put into the staff report and are supportive of the conditions. He spoke about the extensive time
they have put into this project and the specific changes they made between the first proposal and
this one and to how they are in compliance. He spoke to working extensively with the Montana
Department of Transportation, working with Kalispell Public Works and a third -party review of
the Traffic Impact Study and to the results of the Traffic Study. He referred to the Traffic Impact
Study provided by Greenlight Engineering. He spoke to hearing concerns related to traffic safety
and to the ways in which they are proposing to mitigate those concerns which are within the
conditions including a signal at Hwy 93 and Tronstad. He spoke about why they volunteered to
build out the road in front of the Koenig Subdivision to allow for continuous road improvements
and pedestrian facilities from Highway 93 through the proposal.
03:32:52 John Saniou, Public Comment
Sanjou spoke as a member of the Development Group for the proposal and to the extensive time
they have worked on this and to their transparency throughout. He spoke to a few of the
modifications they have made to the proposal including reducing the density, including a 30'
wide tree and walking trail easement on the western property line, increases to the required park
area, keeping the trees on the western and northern perimeter, not building homes over two
stories high, and other concessions. He spoke to the Groups view that this project is of significant
value to the community.
03:37:00 Merna Terry, Public Comment
Terry spoke in favor of the proposed subdivision and to living many years in the area and to her
empathy regarding changes. She spoke to the need for additional housing for people such as
teachers, firefighters and police officers can afford and to the proposal being brought forth to
provide more workforce housing. She spoke as a builder wanting to purchase lots to build homes
that are much needed by the workforce. She spoke about the changes made to bring down the
density and how that will increase the cost of some of the homes.
03:40:43 Frank Garner, Public Comment
Garner of Crestview spoke as a member of the Development Group and as a local and to their

desire to have a wide range of single-family homes and the need for further housing for Montana
residents to stay and work within the Flathead. He spoke regarding studies completed related to
the multi -year housing shortage within the area. He reminded Council of the proponents that
have previously provided public comment. He spoke about how the Group has listened to the
public comments and concerns, knocking on doors and talking with neighbors, and holding
public meetings. He spoke regarding thirteen changes they have made related to concerns they
have heard that include the work they have done with Montana Department of Transportation to
accelerate, put in and pay for the traffic light, offering to pay for and provide improvements to
the road in front of the adjacent subdivision, reducing the number of lots, prohibiting accessory
dwelling units, duplexes and short term rentals, not building homes over two stories high, adding
additional parkland, keeping the existing trees along the project, large lots around the outside,
and reversing the order of the phasing. He spoke regarding being held accountable for these
improvements through the conditions of approval and their agreement with those conditions. He
spoke to how improvements will not be completed by anyone else if they are not paid for and
completed by the applicants. He spoke to his sincerity for this to be a quality project and spoke to
cooperating with the neighborhood as they move forward.
03:58:19 Jeremy Peterson, Public Comment
Peterson of 135 North Wintercrest Drive spoke as a member of the neighborhood and to driving
on Tronstad Road every day and to his appreciation that the applicants are willing to improve and
pay for extensive road improvements. He talked regarding wanting his son and his family to be
able to purchase a home and stay in the area.
04:01:01 Mark Taylor, Public Comment
Taylor spoke as a member of the Ownership Group and as a fifth generation Montanan and to his
experience in many developments across Montana and to his view regarding the unprecedented
number of conditions attached to this development. He spoke about how the Montana
Department of Transportation has made unprecedented concessions in allowing the traffic light
early on within the development and to ongoing discussions with MDT and to the millions of
dollars the Development Group is spending to make off -site improvements. He spoke to the
findings of fact. He spoke to commitment letters from home builders for 85% of the lots within
phase 1 showing the need for additional inventory within the Flathead valley.

L CITY MANAGER, COUNCIL, AND MAYOR REPORTS (No Action)
City Manager Doug Russell provided the following report:
• City Offices will be closed on Monday, November 11 for Veterans Day and there will not
be a Council meeting next week as some Council members and staff will be attending the
National City Summit conference next week.
• Manager Russell explained why the Montana League of Cities and Towns were not in
attendance to provide a report during tonight's meeting. He asked Council if they would

like the League to reschedule, Council declined. Kalispell legislative priorities will be
discussed at a future work session.
05:00:48 Councilor Fisher asked that a work session be brought forward related to the property
formally known as the Outlaw Inn.
Council and staff discussed the possibilities and limitations related to dealing with the property.
Staff will bring forth possible options again.
05:04:12 Council Member Hunter spoke regarding State workforce housing legislation, HB 819
that would require the County Commissioners to accept the state funding provided. He asked
whether Council would be interested in sending a letter from the City to the County in support of
accepting the funds. Council approved sending a letter of support.
Mayor Johnson asked the public to vote during tomorrow's general election. He also informed
the public that City offices would be closed for election day, November 5, and solid waste
services delayed by one day the remainder of the week.
