September 10, 2024
CALL TO ORDER AND ROLL
The regular meeting of the Kalispell City Planning Board and Zoning
CALL
Commission was called to order at 6:00 p.m. Board members present were
Chad Graham, Doug Kauffman, Rory Young, Tim Stocklin, Joshua
Borgardt, and Shelby Odell. Pip Burke was absent. Jarod Nygren, PJ
Sorensen, Kari Barnhart, and Kirstin Robinson represented the Kalispell
Planning Department. Keith Haskins represented the Kalispell Public
Works Department.
Odell moved and Kauffman seconded a motion to approve the minutes of
APPROVAL OF MINUTES
the August 13, 2024 meeting of the Kalispell City Planning Board and
Zoning Commission.
VOTE BY ACCLAMATION
The motion passed unanimously on a vote of acclamation.

Sorensen updated the board on the August 13, 2024 agenda items.

Sorensen updated the board on the upcoming October 8, 2024 Planning
Commission Meeting.

Graham advised Staff that he wants a PUD condition that there be a traffic

light at the intersection of Hwy 93 and Tronstad Road prior to any
development regardless of MDT's traffic warrants. Nygren stated that the
commission would need to make that finding based on public comments.
Young stated that MDT controls the highway and that there could be a
potential liability for the city if the subdivision could not move forward.
Haskins advised the commission that MDT relies on the national standard
for traffic safety but has agreed to accelerate the timeframe for installing
the traffic light. Nygren advised the commission that it can make a finding
of fact that can warrant the light prior to building the first house. Nygren
also reminded the commission that the previous application for this project:
that there was a condition for the light to be designed and bonded for at the
final plat of Phase 1. Young asked staff if the traffic impact study includes
Silverbrook and future development of the area. Haskins was not sure but
stated that if it was, the warrants may be met sooner. He also added that the
developer is willing to use projections in their planning. Staff advised the
committee that the developer will improve portions of Tronstad between
Quail Meadows on the north side, that the water rights on side would come

to the city, there is capacity within the current water and sewer systems,
and that storm would be added. Young confirmed with staff that the
development would not affect taxes of nearby property owners. Sorensen
reminded the commission that state law does not allow impacts on schools
the be the sole factor in their decision to approve or deny a subdivision.
PUBLIC COMMENT I Jim Jahner-- 200 Tronstad Rd — Opposes the project and has concerns with
traffic, water supply, and density.
Jessica Bubar — 250 Highland Dr — Opposes the project and has concerns
for the use of Highland Drive which is not developed.
Kyle Voigtlander — 840 41h St W — Opposes the project and agrees that a
traffic device is needed. Also, stated that there is not enough room for
trucks, trailers, and dump trucks to turn onto Hwy 93 in the proposed
intersection. Has concerns about first responder response time, higher
taxes, storm water runoff, snow plowing, water and garbage rate increases,
and safety.
Dan Munzing — 213 Tronstad Rd — Opposes the project and has concerns
about blind hills on Tronstad Rd and stated that Tronstad Rd and Whitefish
Stage Rd need to be improved. Also has concerns about the additional
traffic that the new Costco at Rose Crossing will bring and wants the
infrastructure in prior to development.
Sharon DeMeester — 415 Chestnut Dr — Stated that the right turn only lane
on Hwy 93 has created more traffic on Sirucek Ln which is impacting her
neighborhood. Has concerns about infrastructure and the new subdivisions
in her area.
Jeff Muller 45 Tronstad Rd - Opposes the project and would like to see
the infrastructure put in prior to development for safety reasons. Has
concerns about traffic.
Dave Kaupp 236 Tronstad Dr Opposes the project and has concerns
about traffic on Tronstad Rd and Whitefish Stage Rd, the proposed signal
on Hwy 93, density, and first responders response time. Would like this
project to go back to the County.
Mae Osborne -- 67 Tronstad Rd Opposes the project and agrees with
previous comments regarding safety and density. Feels that the project is
not consistent with the area.
Travis Taylor - 1210 Birch Grove Rd Opposes the project and has
concerns with density, safety, traffic, Reserve Dr construction, and losing
the character of the area. Would like the project put on hold and for the
developer to re-evaluate the density.
Ming Munzing - 213 Tronstad Rd — Opposes the project and feels that it is
still too dense and has concerns about infrastructure, traffic, and safety.

Eric Mulcahy - Sands Surveying - Representative for the Applicant - Is
available to answer any questions and stated that the project meets the
growth policy and zoning requirements. Stated that the applicants planned
for less single-family homes and worked with MDT to put in the traffic
light in the first phase of the project based on the neighbors' comments and
concerns. Stated that he is hoping for the traffic signal to be put in at the
first phase of the final plat and that the subdivision fits the area since there
the Quail Meadows and Silverbrook subdivisions are nearby.
Sandy Muller - 45 Tronstad Rd - Opposes the project and has concerns

about traffic and safety.
Mark Taylor - Applicant Partner - Provided an overview of the significant
changes that were made from the original application including a better
structure, phasing, buffers, and infrastructure. Stated that the MDT letter
does not mention warrants and that MDT is being proactive rather than
reactive. Stated that changes have been made that are better for the
community and they are doing more than most developers do to put in
infrastructure.
Kristine Hursch 210 Tronstad Rd Opposes the project and has concerns
about density. Stated that the Silverbrook residents have access to Hwy 93
and Church Dr which are developed while Tronstad and Whitefish Stage
Road are not developed. Stated that the project doesn't need to happen now.
BOARD DISCUSSION
Graham stated that private property owners are going through a legal
Iprocess
to do what they they feel is the best use of their land and that the
City of Kalispell looks at each application individually and cannot consider
other development. He also added that it is a big deal that the developer
will not allow duplexes and ADUs in the subdivision due to current
legislation.

BOARD DISCUSSION
Odell requested clarification from staff of the cash in lieu process. Young
asked what the changes are to the previous PUD; Sorensen stated that the
amendment is to address the area on the hillside. Kauffman stated that this
amendment was a step in the right direction.
PUBLIC COMMENT
Mike Brodie - WGM Group - Representative for the Applicant - Is
available to answer any questions and stated that all residents will have
access to the existing parks in the Northland Subdivision.
