BACKGROUND: In April of 2023, Council awarded Schedule 2 of the 2023 Kalispell Tank
and Wells Project to Landmark Structures for $12,462,000.00. Schedule 2 is for the construction
of a 1-million-gallon elevated tank in the upper pressure zone and the installation of a well
facility on the same lot. Three previous change orders have been approved on the project for a
total decrease in contract price of $86,220.00. Change Order 4, as described below, is greater
than $80,000 and therefore Council's approval is required.
The design covered by the current contract provides a direct temporary access to the site from
Highway 93. Due to access control requirements on the highway, a permanent access could not
be approved by MDT at this location, so a temporary approach was conditionally approved. The
conditional approval only allows a gravel access and requires the temporary access to be
removed once another access can be provided via future development of Eagle Valley Ranch.
The design for the temporary direct access would require a large cut into the hill to access the
tank lot, see Figure 1 below. If constructed, when the access is removed in the future per the
conditional approval, much of the frontage would have to be regraded and material hauled in to
restore the highway buffer area. Additionally, per the City Zoning Regulations, the Entrance
Corridor Standards require a pedestrian path to be extended through the frontage of the corridor
which cannot be accommodated with the temporary access.

Rather than completing the access into the area twice, regrading and relandscaping the frontage,
city staff contacted the adjacent property owner in an effort to obtain a permanent access into the
lot which could be completed with the current project and limit throwaway costs. An agreement
was reached in which the access location would be moved to the north and a permanent easement
would be granted to the city. The permanent access would follow the temporary construction
access easement already granted for the project.
Per the agreement, the city would construct the access into the lot which could also be used for a
portion of the pedestrian path requirement on Eagle Valley Ranch's highway frontage. The new
location also allows the required pedestrian path to be constructed with the project, see Figure 2.
Due to the grades of the hill, the pedestrian path had to follow a circuitous path around the tank
in order to not exceed maximum grade requirements.

In addition to the construction of a permanent access and path, Change Order 4 also includes
modifications to the proposed well pump (amounting to about $7,000). A change order proposal
was received on 9/20/24 for a total cost increase of $158,145.00 and 14 days.
If the Change Order is approved, there will be a net increase in the original contract price of
$71,925.00 or 0.58% for all four change orders on the project.

Kalispell Tank and Wells Project for an increase in the contract price of $158,145.00 and the
addition of 14 days.
FISCAL EFFECTS: Adequate funds were budgeted to cover this increase in contract price.
