ADMINISTRATIVE CODE Adopted July 1, 1991 Section 2-20 Manner of Addressing Council a. Each person not a Council member shall address the Council, at the time designated in the agenda or as directed by the Council, by stepping to the podium or microphone, giving that person's name and address in an audible tone of voice for the record, and unless further time is granted by the Council, shall limit the address to the Council to three minutes. b. All remarks shall be addressed to the Council as a body and not to any member of the Council or Staff. C. No person, other than the Council and the person having the floor, shall be permitted to enter into any discussion either directly or through a member of the Council, without the permission of the Presiding Officer. d. No question shall be asked of individuals except through the Presiding Officer. Page 2 of 2 CITY OF KALISPELL To: Doug Russell, City Manager From: Susie Turner, Public Works Director Re: Lead Service Line Replacement Funding Review Meeting Date: September 23, 2024 Background: Kalispell operates a Community Public Water Supply and is required to comply with the drinking water rules and regulations set forth by the State of Montana Department of Environmental Quality (DEQ) and the Environmental Protection Agency (EPA). During the August 26th Work Session, the current Lead and Copper Rule Revisions (LCRR) and the proposed Lead and Copper Rule Improvements (LCRI) were reviewed and discussed with the Council. The proposed LCRI rule mandates that water systems replace at least 10% of the service lines in their replacement pool each year, averaged over a 3-year period, and complete this within 10 years where applicable. During the work session, several funding options were presented to the Council for review, including: 1. Utilizing the SRF loan program to fully fund the replacements (60% forgiven and 40% debt) with the Water Fund. 2. Customer pays directly for the cost: A. City manages the replacement construction and covers the upfront cost, offering customers a 5 to 8-year deferred repayment plan. B. City manages replacement construction, and the customer pays the full amount at the time of construction. C. Customer replaces their service line with their own contractor and pays the full amount at the time of construction. 3. Other options as suggested. Upon review of the options, the Council requested that staff perform an additional review of the Water Fund to ensure it would be able to uphold the debt credit and financial policies if the first option was selected. Meeting Discussion: During this meeting, staff will review the financial status of the Water Fund if the City were to incur debt for lead line replacements (option 1). Staff will also seek direction from the Council on the preferred funding option to meet the lead service line replacement mandates.
