G. PUBLIC COMMENT
Mayor Johnson opened general public comment.
00:03:18 Paul Travis, Public Comment
Travis of 264 White Pine Road spoke on behalf of Flathead Land Trust who are working on a
project with Trust for Public Land and the Foys to Blacktail Trails Organization to purchase and
protect land adjacent to Herron Park. He spoke further about the land and the project explaining
their objective is to purchase a conservation easement that would be put into place with the Foys
to Blacktail Trails the long-term owner. Travis explained that this property is important for many

reasons including its ease of accessibility to Kalispell for recreation and would provide free
public access for hunting, biking, hiking, etc. The land is also important to wildlife. Travis
further spoke regarding the benefits of this project, its supporters, and explained that Flathead
Land Trust and its partners would request a letter of support from the Council for a USDA
Federal Grant they are submitting.

H. REPORTS, RECOMMENDATIONS, AND COUNCIL ACTION
1) Gardner/Anderson Ranch Annexation, Zoning and Combined Planned Unit Development
Overlay"7 a
This item considers a PUD that includes annexation of 6.5 acres at 2995 Hwy 93 South with
zoning of B-5 (Industrial Business), and annexation of 30.8 acres at 330 Demersville Road
with zoning of R-3 (Residential). The PUD overlay also includes 57.1 acres zoned B-5/PUD
between United Drive and Lower Valley Road.

Assistant Director of Development Services P.J. Sorensen provided the staff report.

Mulcahy with Sands Surveying spoke representing Colton Behr and Todd Gardner. He explained
their Civil Engineer Brandon Tyce was also present. He said they are in full concurrence with the
conditions imposed. He spoke regarding the reasoning behind the partnership between the
landowners. He then answered questions posed by Council Member Hunter explaining they are
intending single family with 4500 square foot lots with smaller homes.

Theis with Civil Solutions answered questions from Council Member Hunter explaining what
they would need to put in place to handle stormwater.

00:37:12 Motion and Vote to approve Resolution 6224, a resolution to provide for the
alteration of the boundaries of the City of Kalispell by including therein as an annexation
certain real property described as a tract of land located in Section 28, Township 28, Range
21 west, P.M.M., Flathead County, Montana and more particularly described as Tract 1 of
Certificate of Survey No. 2829, excepting therefrom, that portion granted to the State of
Montana in judgment and final order of condemnation, recorded April 24, 2006, as Doc.
No. 2006-114-08400, records of Flathead County, Montana, to be known as Gardner
Addition No. 474, to zone said property in accordance with the Kalispell zoning ordinance,
and to declare an effective date.

00:40:18 Motion and Vote to approve Ordinance 1926, an ordinance to amend section
27.02.010, official zoning map, City of Kalispell zoning ordinance, (Ordinance no. 1677), by
creating a planned unit development overlav to be known as Gardner/Anderson Ranch
PUD over certain real property more particularly described as five tracts of land, situated,
lying, and being in the south half of the northwest quarter, and in the southwest quarter, all
of Section 28, Township 28 north, Range 21 west, P.M.M., Flathead County, Montana, and
more particularly described as follows to wit: Tract 1 of Certificate of Survev No. 2829
(records of Flathead County, Montana); Tract 2 of Certificate of Survev No. 14830 (records
of Flathead County, Montana); Tract 1 of Certificate of Survev No. 17238 (records of
Flathead County, Montana); and Tract I of Certificate of Survey No. 22772 (records of
Flathead County, Montana); containing 94.426 acres; subject to and together with all

This item considers a major preliminary subdivision plat with 31 lots on 8.1 acres as part
of the Starling Planned Unit Development. This phase is located to the west of existing
phases and incorporates extensions of Timberwolf Parkway and August Way.

I. CITY MANAGER, COUNCIL, AND MAYOR REPORTS (No Action)
City Manager Russell provided the following report:
• The next work session will include a discussion on work force housing and tax increment
financing policies. The Warming Center agenda item will be taken up again on September
16, after being postponed. The September 23 work session will include further discussion
on lead line replacement funding.
• As requested by Council an invitation has been made to the League of Cities and Towns
to speak with Council related to the legislative process after the resolution platform is
adopted by the League Board in October.
• Following up on previous discussions to establish a Council Sub -Committee to discuss
the possibility of a Trail Connection District. Fisher, Graham and Hunter have

volunteered for the Subcommittee that would look to identify what potential priorities
and funding might be to bring back to Council for discussion. Staff will look to start
those meetings towards the end of the month.
Manager Russell referred to the request for a letter of support from Flathead Land Trust
asking Council how they would like to grant the request.
00:59:44 Council Member Hunter declared he is an employee of the Flathead Land Trust and
recused himself from discussion on this matter.
00:59:54 Council Members indicated they were amenable to providing Flathead Land Trust with
a letter of support for their grant application.
01:00:23 Council Member Carlson asked for details about the community event planned by the
Bibler Family Trust related to the Ashley Creek Park project, confirming the pop-up event is
planned for Thursday, September 5, 2024, from 5 to 7 pm with parking at the end of Fenn Way.
01:01:16 Council Member Hunter may not be present for the September 23 Council meeting and
asked that his previous work session comments on the lead service line funding be considered
during that conversation.
