BACKGROUND: The WWTP Fermenter Rehabilitation Project generally consists of
rehabilitation of the existing fermenter.
BIDDING RESULTS: Bids were opened on September 5, 2024, at City Hall. Two responsive
bids were received from DN Tank, LLC and Swank Enterprises, Inc. Below is a summary of bid
amounts listed from high to low and summarized as follows:

RECOMMENDATION: HDR Engineering, the engineer of record for the City, reviewed the
bids, the submitted documentation, and submitted references. Based on their review, DN Tanks,
LLC was determined to be a responsive and responsible contractor who has successfully completed
similar projects of size and scope. Based on HDR's evaluation and review of the bid and
references, staff recommends awarding the bid to DN Tanks, LLC.
FISCAL EFFECTS: The total project construction cost will be funded as allocated in FY 25
budget as follows:
$1,000,000 ARPA Grant Fund -Line item 922
• $160,368— WWTP Replacement Funds Line Item 922 Fermenter Reconstruction
• $2,267,750 State Revolving Loan (SRF) — Line Item 922 Construct New Fermenter
(rehab)
ACTION REQUESTED: Motion to award the bid for the Fermenter Rehabilitation Project to
DN Tanks for $2,389,500.
ALTERNATIVES: As suggested and approved by the City Council.

Subject: WWTP Fermenter Rehabilitation Bid Review
Dear Susie,
The purpose of this letter is to report on HDR's (Engineer's) review of the bids received by the
Kalispell Public Works Department on September 5, 2024 at 2:00 pm local time via QuestCDN for the
WWTP Fermenter Rehabilitation project. Bids are to be evaluated to determine which bid is the
lowest responsive and responsible bid. The bid review findings are presented in the following
paragraphs.
BIDS RECEIVED
Bids were received from two prime bidders. The bidders are listed in Table 1 below.

Perthe Contract Documents, bidders are allowed twenty-four (24) hours after the bid opening to
request a modification to their bid orwithdrawal their bid. No requests for modification or withdrawal
were received by the City Clerk within this time frame.

The Engineer's bid evaluation for responsiveness is based upon the following criteria:
• Bid security (10 percent of total bid) included with bid package.
• Evidence to conduct business within the State of Montana determined by possessing a valid
and current Montana Contractor license.
• Completion of the following documents:
o Bid Form
o Proposed Equipment Manufacturers and Suppliers
o Proposed Subcontractors
• Debarment Certification Form
• Acknowledgement of Addendum No. 1

DN Tanks listed DN Tanks of Montana, LLC with their bid information. A search of the public works
contractor license database on the Montana Department of Labor and Industry website indicates
Public Works License number of 258905 is in fact for DN Tanks of Montana, LLC. Table 4 lists the

Contingent upon review and approval by Montana Department of Environmental Quality and the
American Rescue Plan Act (ARPA) funding agency, the Engineer recommends the City award the
