11-28-7811-28-78 Discussion of Plan of Action on Final Zoning Plan. Annexations: Double LL Addn. Tracts 5CC & 5CF SE4 of the NE4-of /Sec. 12, T28N, R22W F1thd Cty, Mt. Located N of 2 Mile Dr. & W of Meridian Rd, adj to Stubbs Addn. (S.R.) (Tabled till next Meeting). A regular meeting of the Kalispell City -County Planning Board, was held November 28, 1978; Tuesday, at 7:30 p.m. in the Flathead County Courthouse East Community Room, 723 5th. Avenue E. Kalispell, Montana. Members Present: Dale W. Haarr Bob LeDuc W. J. Lupton Walter Griffin Fran 011endike Dorothy Garvin Garmen Meadows James J. Thompson Others Present: 3 APO Staff Representatives James E. Mohn Planning Dir.1 Gary Hill Steve Petrini, Approximately 6 Guests Chairman Dale Haarr called the meeting to order at 7:35 pm. Gary Hill outlined the general directions which were: 1. Amend the Comprehensive Plan to accommodate the 1990 housing demand. 2. Work with the Chamber of. Commerce and the group of area industrial leaders to look at current development trends. 3.' Update the circulation system through coordination with the T.A.C. 4. Establish area goals with development objectives. 5. Have the City Attorney prepare the final zoning report. He indicated that he felt zoning regulations should not be liberalized so as to maintain compatibility with county -wide comprehensive zoning. Bill Lupton stated that the zoning regulations must consider current uses in establishing zoning districts as proposed. Walt Griffin stated that due to the items of business on the agenda that the Board proceed with the annexation request and come back to 'the zoning later on in the evening. Seconded by Garmen Meadows. Further action was continued to later in the evening. Jim Mohn reviewed the -Double LL Addn. and prepresented Staff recommendations which called for annexation of the Double LL Addn. property as R-5 with existing uses to be accepted as non -conforming use. Mr. Gene Lenz asked to go on record as requesting commercial zoning for property, since that is the current use and the owners plan to continue to use and do not wish to be restricted because of non -conformity with the zoning. There was some discussion as to the additional 20' r/w along the west boundary which has been requested by the Staff. This did not appear to be a problem with respects to acceptability of the annexation. Additional consideration and discussion was given to a petition submitted from several landowners along Meridian Road which requested commercial zoning for all properties fronting on Meridian Road. The developer stated that they had signed the necessary contracts allowing them to hook-up to city sewer and stated that.city water had already_ been extended to the development several years ago. This brought about considerable discussion by Walt Griffin as to annexation procedures and policies by the city. Mohn/ee 12 12-78 The developers indicated that enlight of the contracts which had already been.signed.between-the city and the owners, that they saw no need to expedite the annexation procedures in zoning. Enlight of this fact, Bill Lupton moved to table the.Double LL Addn. till a future date, seconded by Fran Ol lend i ke. :.. .Discus.sion.followed relating to the disposition of the final zoning plan'and.Jim Thompson stated that.enlight of an additional study on the Meridian Road area, as part of the final zoning plan, that a final recommendation should be tabled rather than make it.a zoning recommendation, which maybe incompatible with the final zoning recommendation. The question -was called for, motion carried. Jim Mohn briefly reviewed thestatus of the .project as continued from .the previous meeting, -and there was some discussion from the public comment received during the hearings on the zoning. plan recommendation held November 15, 1978• Discussion of theproject area in -relation to zoning regulations as they exist to date. After considerable discussion Jim Thompson moved that' the Planning Board that that portion of the property currently.in.the' county be annexed into the City with an.RA-.1 zone and stated at the time .of the* rezone he would recommend. RA' 1 zoning, on the contiguous property which is currently in the City. Motion was seconded by Garmen Meadows. The question was called for; motion carried. A communication from H James Oleson,, was read by Chairman Dale Haarr, dated November .17, 1978, which indicated concern over the new proposed zoning regulations for the area in relation to availability of areas for mobile homes. .(copy attached).
