01-10-781-10-78 The regular meeting of the Kalispell City -County Planning Board was held Tuesday, January 10,.1978 at 7:30.p.m. in th.e Flathead County Courthouse East, 723.5th..Avenue East, Kalispell, Montana Conference Room. Lupton Others Present:. . . 2 APO Staff Representatives 33 Guests The meeting was called to order at 7:55 p.m. by Chairman Jim Thompson. Minutes approved. Chairman Jim Thompson asked if there were any additions or corrections to the minutes of December 13., 1977 meeting. Fran Ol,lendike moved that the minutes be approved as mailed. The motion was seconded by Dorothy Garvin and carried. Public Hearings: President Jim Thompson then reviewed for the audience the procedure Procedure- governing the public hearings. Jim stated thatfirst of all the Staff Report would be read, secondly public comment for and then opposed would be heard by the Board, that questions could then be asked by Board Members and then consideration and action would be taken by the Planning Board. President Jim Thompson then asked Jim to read the Staff Report. Hidden Meadows Mobile Jim Moh.n then reviewed location of the Hidden Meadows Mobile Home Park Expansion. Home Park Expansion project and read the Staff Report and the recommendations. Jim Moh.n then reada letter from D. K. Marquardt regarding subject Mobile Home Park, copy attached hereto. Jim Mohn then presented a list of people opposed and in favor of the proposed Hidden Meadows Mobile Home Park Expansion project, copy attached hereto. President Jim Thompson then asked if there were any people who wished to speak in favor of the proposed Hidden Meadows Mobile Home Park Expansion project. Pat Sherlock, an attorney, representing the developer, spoke about the development. He stated that the project is now down to 18 units and within the recommended plan density. He stated that zoning for the area, as proposed by the residents, would be stalled until this matter would be resolved. He further stated that this property can not be effectively used for any other use. Patty Seamon stated that it was very difficult to find mobile home space in Flathead County. More mobile home park spaces are necessary to accommodate the increasing number of mobile homes within the valley. She further stated that she has lived in a mobile home for the past 20 years and that she has been selling mobile homes.for the past 7 years. Jim Newcomb stated that he lived in a mobile home and also sells mobile homes on a parttime basis. He also reiterated that more mobile home spaces in Flathead County are needed. He stated that those spaces should be in well designed and well constructed mobile home parks. 1. Richard Huegliani, a real estate appraisor, stated that in his opinion the proposed development is compatible with the area in which it is located and further that he feels it is the highest and best use of the property. Mr. Sherlock then reviewed with the Board photos taken in the area and of the existing mobile home park. Mr. Sherlock then stated that he felt all the objections previously errored had been met and therefore the mobile home park expansion project should be approved. President Jim Thompson then asked if there were any others in attendance who wished to speak in favor of the project. There being none, he then asked for comments opposing the proposed Hidden Meadows Mobile Home Park Expansion. Norman Beyer stated that the Commissioners did not indicate to him that they were willing to postpone the proposed Caroline - Collier Zoning District. He further stated that the proposed plan does not stop traffic from entering Collier Lane. Agnes Jacobson stated that there is too much traffic within the area and that the water table is high. Jim Lawrence stated that Mr. Slack did invest a considerable amount to purchase the property, but so did the other property owners within the area. Mrs.Aunie stated that she and her husband had built many homes within the area and that she has a nice home in the area. She further stated that covenants were placed on all the other property within the area but not on the piece of property that was eventually developed as the mobile home park. Bill Pratt stated that there are shallow wells in the area; that mobile home parks do lower property values; and that the schools are already crowded. Patty Seamon stated that mobile home pay about $300 in taxes as well as the taxes which the court owner pays on the improvements and land of the mobile home park. Jim Thompson then asked Jim Mohn to read the letters submitted to the Board of County Commissioners by the Kalispell Planning Board regarding this proposed development. Jim Mohn then read the communications. Copies attached hereto. Jim Thompson asked if there were any further comments for or against the proposed project. There being none, Jim Thompson closed the public hearing and recessed the meeting for five minutes at 10:00 p.m. Jim Thompson reconvened the meeting of the Kalispell City - County Planning Board at 10:07 p.m. After discussion by members of the board, Walt Griffin moved: -- "That the Kalispell City -County Planning Board recommends to the Board of County Commissions of Flathead County, that the 2. the preliminary plat of the Hidden Meadows Mobile Home Park be denied for the following reasons: 1. That the Kalispell City County Planning Board, Acting as a Zoning Commission recommended an R-2 zoning for this area, keeping in mind that the use is not compatible with an R-2 zone, and 2. that the proposal is not in the best interest of the immediate community or the City of Kalispell as a whole." The motion was seconded by Garmen Meadows and carried with Harvey Knebel abstaining and all other members voting aye. Twin Acres Mobile Home President Jim Thompson then opened the public hearing on the Park Expansion. Twin Acres Mobile Home Park Expansion project and asked Jim Mohn to read the Staff Report. Jim Mohn reviewed the location and the Staff Report and recommendations. President Jim Thompson then asked if there were any people in the audience who wished to speak in favor of the proposed development. The developer stated that he had no further comments at this time. Jim Thompson asked if there were any further comments in favor of the proposed development. There being none, President Jim Thompson asked if there was any one in attendance who wished to speak in opposition to the proposed project. Several adjacent. property owners asked for an explanation regarding access to the proposed expansion project. After the explanation of the Staff Report, that access be terminated and no loop road exist, the individuals stated that they had no opposition to the expansion project. Jim Thompson asked if there were any further comments from people in attendance. There being none, President Jim Thompson closed the public hearing - After discussion by members of the Board Garmen Meadows moved 'That the.Kalispell City -County Planning Board recommend to the Board of County tDmmissioners of Flathead County, that the preliminary plat of Twin Acres Mobile Home Park Expansion be given preliminary approval subject to the following conditions: 1. That a variance be granted from the street requirements to allow for -a 20' street width in accordance with the existing private drive, 2. that a variance be granted from the Greenbelt requirement "Landscape Buffer around the perimeter", in lieu of , selected tree planting .in line with that which is presently established in the original court, and further with those conditions granted, the following conditions be met: 3• 1." That the water and sewer systems and all other State Department of Health licensing requirements be approved, 2. that the design for the spaces be adjsted to follow the same as those established in the original and first expansion, 3. that the playground and recreational facilities as indicated in the letter to. the Staff, dated November 3, 1977, be provided prior to the spaces being made available for rent, and 4. that the proposed through private access road be changed to show termination in a cuMe-sac of a 45 ft. radius at the west end of the proposed expansion.and that the only access to be used at the northwest cornerof the property be strictly for the single family proposed residence, and 5. the entire property under this ownership be contingent for an R-5 zoning district in accordance with the Flathead County Comprehensive Zoning Regulations." The motion was seconded by B. J. Lupton and carried unanimously. Reimbursement of APO Budget- Steve Petrini presented a claim to the Kalispell Board from Acct. 603, $126.60 regarding reimbursement of funds expended from the APO Budget approved:. for Kalispell Zoning Ordinance printing costs. Dorothy Garvin moved that the claim in the amount of $126.60, as submitted by the APO be approved. The motion j was seconded by Fran 011endike and carried unanimously. Election of New Officers: President Jim Thompson then opened nominations for the office of President. Garmen Meadows nominated Dale Haarr; the President: Dale Haarr nomination was seconded by Dorothy Garvin. B. J. Lupton moved that nominations be closed and a unanimous ballot be cast for Dale Haarr for President. The motion was seconded by Garmen Meadows and :carried unanimously. Vice President: B. J. Lupton. Jim Thompson then opened nominations for the office of Vice - President. Garmen Meadows placed in nomination of B. J. Lupton. The nomination was seconded by Walt Griffin. Fran 011endike moved that nominations cease and a unanimous ballot be cast for B. J. Lupton for the office of Vice President. The motion was seconded by Walt Griffin.and carried unanimously. Secretary: Garmen Meadows. President Jim Thompson then open the meeting for nominations for the office of Secretary. Dorothy Garvin placed in nomination the name of Garmen Meadows. .The nomination was seconded by Fran 011endike. Dorothy Garvin moved that nominations be closed and that a uninamous ballot be cast for Garmen Meadows for Secretary.
