The regular meeting of the Kalispell City -County Planning Board
was held on June 14, 1977, Tuesday, at &:30 p.m. in the
Flathead County Courthouse -East, Community Room, 723 5th. Ave. E.,
Kalispell, -Montana.

The meeting was called to order by.President Jim Thompson
at 7:40 p.m.
Fran 011endike moved that the minutes of May 24, 1977 be
approved'as mailed; seconded by Dorothy Garvin: motion carried.
Pursuant to Public Notice published in the May 29, 1977
edition of the Daily' Interlake, a public hearing by the
Kalispell City County'Planning Board,: Acting as the Zoning
Commission,'was'held on .the following:
1. Petition for a zone change :to permit duplexes and four
plexes by O..M. Parker.
2'.. Petition for a zone change from SAG-1 to R-4 by
Zeruah Kaufman.
Petition of 0. M. Parker,
President Jim Thompson opened,the.pub;l•ic.hearing and asked
Jane Lopp, of the A.P.O.Staff, to review the request. Public
comment followed. Mr. 0. M.,Parker-stated that he intended to
resubdivide the lots after -rezoning: A letter in opposition
from the owners of Greenacres West was read. The Board
discussed the criteria of the.RA-:1 Zone,which permits duplexes
and four plexes,as it relate-d.. to 'public facilities which
are not available. There being•no,further comment, the
hearing was closed. Fran 011.endike moved that the Kalispell
City County Planning Board recommend;to the Board of County
Commissioners of Flathead County that the request of
Mr. and,Mrs, O. M.'Parker be denied -because it does not
conform to the zone criteria; seconded by Walt Griffin:
motion -carried (8-0),

President Jim Thompson opened :the public hearing and asked
Jarie.Lopp, of the A.P.O.Staff, to review.. the request. Public
comment followed. Letters from.Lyal Everett in support
and Mr.,and Mrs, Marsh in opposition.were read. Bill Doyle,
.;rep;r.esentl n.g., ;the Bevel opers . Jack Barrett. and Tom Tonk i nson
stated that the area was close to town and that they think
it is a good place for high density residential use.
Mr. Barrett stressed the need for lots and that West Reserve
Drive would be four lanes in the -near future:
Mr. Tmkinson said that the site was equidistant from
Kal-ispell, Whitefish and Columbia Falls and more people are
needed in the area to get a big supermarket in Evergreen.

He also felt that 1, 5 and 10 acre tracts tend .to become
full of weeds,.that-if developed properly the project would
not devalue adjacent property, that taxation would compensate
for added cost to the school district and many people could
only afford a small lot and house. According to Mr.Tbmkinson
139 lots were necessary. to justify a sewer system.
Darrell Shafer, a builder, supported the zone change, stating
it would be an asset compared to,a mobile home hodge podge.
Concern was expressed by Eloise Hinman, resident, about
.the high.water table. John Jump, resident, said he agreed
with Mr. and Mrs. Marsh and that the children would cause
overcrowding, property would be devalued and this development
shouldn't be at the existing owners expense., For the. first
time next year the Evergreen schools will not be'overcrowded,
according to Kay Adkins, a resident, but this development
would require another school bu,i,l.ding program. Larry Merical,
resident, commented that many residents had sha`Tlow wells
and were concerned. He also objected to the density and said
people live in the area.to avoid the small town lots and the
result of granting R-4 would be to create instant city.

Roger Richmond,'resi.dent reiterated the potential school
problem. Barbara Jamotte,.resident, expressed concern about
safety and •felt'train and vehicular traffic were problems.

She also said she questioned the demand for small lots.
Roy .Ellenberg,Irepresenting'C&C Plywood and Mont. Lumber
and Plywood Inc. stated that high density residential use
would have conflicts with industry and that.the ,ind.ustrial
zone should be expanded along the .rai;lroad tracks.
J.'im Thompson asked if'a lower density might still make a
sewer system feasible, but the developers said no.
Bill Lup.to.n suggested Mr`..Barrett.and.Mr. Tomkinson consider
a sewer s.ystem.cost analysis for 9600°sq, ft. lots. He also
questioned whether the policy of discouraging intense
residential development north of West Reserve on the bench
applied in this area.* Ray;Lybeck�`asked about availability
of Evergreen water. .Mr. Tomkinsonresponded that the
development could be annexed to the district. After asking
how the zone chan'ge'related to the`Comprehensive Plan and
existing zoning, .Garmen'Meadows`quest'loned whether the Board
was doing-a`turn around if they recommended approval. He
then asked the developer what constituted a public sewer
facility and questioned the limited access for the density
requested. -Walt Griffin repeated that the questions was
really one of density. Jim Thompson inquired whether the
area might not be better suited to'industrial than residential.
Jay Shropshire, who resides i'n the area, said he was
concerned.with.the objections` to the zone change but would abstain
from voting. 'There being 'no further discussion, the hearing
was closed.. Ray Lybeck.moved that the Kalispell City
County Planning Board recommend to the Board of County
Commissioners of Flathead County that the request of
Zeruah Kaufman to change the SAG-1 Zone to R-4 be denied

because densities exceed the recommendations of the Kalispell
Comprehensive Plan. Seconded by Garmen Meadows: motion
carried: (4 - 3) Griffin, Meadows, Knebel and Lybeck voting
aye; O11'endike, Garvin & Lutpon, nay; Shropshire abstaining.
The Board discussed the Fiscal 1977-78 Budget. Fran
moved that the budget.be approved; seconded by.Dorothy
Garvin; motion carried.
Bill Lupton moved that the mileage claims be paid; seconded
by Garmen Meadows: motion carried.
The Board discussed policy and procedures for review of
subdivisions and zoning. The staff was asked to check that
the developer provides the necessary information before accepting
the proposal and starting the review period. Bill Lupton
inquired whether the plan was a guide and if each request to
the Board was judged on i:ts own merits. Ray Lybeck stressed
fairness and that all should.be treated equally.
The Staff was asked to prepare a report similar to the one
on subdivisions, for zoning requests and changes, The Board
then discussed the extra territorial zoning and building codes.
At 11 10,.Walt Griffin moved that the meeting be adjourned;
seconded by Garmen Meadows: motion carried.
