N. LEGAL DESCRIPTION: A tract of land, situated, lying and being in the northwest quarter of
Section 20, Township 28 North, Range 21 West, P.M.,M., Flathead
County, Montana, and more particularly described as follows to wit:
Cl Parcel 1 of Certificate of Survey No. 12729 (records of Flathead County,
Montana), and containing 23.333 Acres; Subject to a public roadway
known as 18th Street being 50 feet in width, and lying south of and
along the most northerly line of the above described Parcel 1.
EXCEPTING therefrom Portion A of the Amended Plat of Lot 2, Block
1, Airport Addition to Kalispell (records of Flathead County, Montana)
ZONE: I-1 (Light Industrial) and P-1 (Public)
The applicant has applied to the City of Kalispell for a conditional use permit to allow the
construction of a parking lot at 1825 Airport Road in the Airport Affected Area.
The Kalispell City Planning Commission, after due and proper notice, on May 14, 2024, held a
public hearing on the application, took public comment and recommended that the application be
approved subject to 11 conditions.
After reviewing the application, the record, the Kalispell Planning Department report, and after
duly considering the matter, the City Council of the City of Kalispell, pursuant to the Kalispell Zoning
Ordinance, hereby adopts Kalispell Planning Department Conditional Use Report #KCU-24-01 as the
Council's findings of fact, and issues and grants to the above -described real property a conditional use
permit to allow the construction of a parking lot at 1825 Airport Road in the Airport Affected Area, in
the I-1 P-I zoning district, subject to the following conditions:
That commencement of the approved activity must begin within 18 months from the date of
authorization or that a continuous good faith effort is made to bring the project to completion.
That the development and use of the site shall be in substantial conformance with the submitted
application and architectural/site plan drawings.
3. A building permit is required prior to beginning construction of the parking lot.
4. Final design of the parking lot shall comply with parking design standards under the zoning
ordinance and other applicable city standards.
Any exterior lighting installed in conjunction with the development shall comply with Chapter
27.26 of the Kalispell Zoning Ordinance. In addition, any light pole shall be less than the allowable
height under the airport ordinance and FAA standards.
The paving shall be repaired/replaced with an appropriate design to be designed and submitted by
the applicant for review and approval by the Site Development Review Committee.
7. Prior to commencing any development of the property, the applicant shall demonstrate that all
airport -related regulations have been satisfied.
Storm water runoff from the site shall be managed and constructed per the City of Kalispell
Standards for Design and Construction. Final design will be approved by Kalispell Public Works
Department prior to building permit issuance.
Prior to receiving a building permit, the developer shall submit a construction storm water
management plan to the Public Works Department.
10. Any new or changed stormwater design shall meet the recommendations in FAA Advisory Circular
(150/5200-33C, dated 2/21/20).
11. Access to the property is restricted and access through the gate shall be coordinated with the
airport management.
