RESOLUTION NO. 6210A
A RESOLUTION ADOPTING A SOLID WASTE MASTER PLAN AND ADJUSTMENT
OF THE FEES, SCHEDULES, RATES, AND CHARGES IMPOSED ON THE PROPERTY
OWNERS AND CUSTOMERS OF THE CITY OF KALISPELL SOLID WASTE UTILITY
AS DESCRIBED IN EXHIBIT IA.
WHEREAS, a City of Kalispell Solid Waste Master Plan, as shown on the attached Exhibit 2,
has been developed in consultation with a consultant which evaluated the current
system and programs, identified key near and long-term trends, and provided a
framework to guide the city's solid waste collection program through financial and
operational policies necessary to ensure sustainable service at established levels;
and
WHEREAS, it is necessary and prudent, pursuant to authority granted to municipalities operating
utility services by Section 69-7-101 et seq., MCA, for the City of Kalispell, from
time to time, to study and review the fees, schedules, rates, charges and
classifications it charges to its customers for solid waste utility services; and
WHEREAS, in addition to the cost of service and revenue requirement analysis to support
current levels of residential and commercial services for the near term and long
term, a series of business alternatives and strategies were reviewed and
recommended for implementation, including increasing assessments; and
WHEREAS, two (2) assessment options were proposed that would each meet the needs of the
city and its utility customers; and
WHEREAS, on June 3, 2024 the City Council passed Resolution No. 6196 stating its intent to
adopt the recommendations of city staff and set a public hearing for June 17, 2024
on the proposed amendments to the fees, schedules, rates, charges, classifications
and regulations of the solid waste utility service of the City of Kalispell and gave
the necessary Notice thereof as required by Section 69-7-111, MCA; and
WHEREAS, the public hearing was duly held by the Kalispell City Council at a public meeting
thereof in the Kalispell City Hall beginning at 7:00 o'clock P.M. on June 17, 2024,
and all persons appearing at the hearing and expressing a desire to be heard were
heard, and all written comments thereon furnished to the City Clerk at the meeting
prior thereto were also given full consideration by the Council; and
WHEREAS, the Kalispell City Council hereby finds the proposed amended fees, schedules,
rates, charges, classifications and regulations of the solid waste utility service to be
reasonable and just; and
WHEREAS, the Kalispell City Council therefore considers it proper and necessary at this time
to amend the fees, schedules, rates, charges, classifications and regulations imposed
for solid waste utility service to its inhabitants and other persons served by the City
of Kalispell Solid Waste Utility.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
KALISPELL, AS FOLLOWS:
SECTION 1. That the fees, schedules, rates, charges, classifications and regulations applicable
to the use of the City of Kalispell Solid Waste Utility and other services performed
by the utility as set forth in Exhibit "IA", attached hereto and by this reference
made a part hereof, are found to be just and are hereby established and adopted to
be imposed for the solid waste utility service to the inhabitants of the City of
Kalispell as set forth in Exhibit "IA".
SECTION 2. This decision is final ten (10) days after filing of this Resolution with the City Clerk.
The City Clerk shall file a copy hereof with the Public Service Commission of
Montana at that time.
PASSED AND APPROVED BY THE CITY COUNCIL AND SIGNED BY THE MAYOR OF
THE CITY OF KALISPELL, ON THE 1 ST DAY OF JULY, 2024.
