Thompson Garmen Meadows Lois Randall Others present: 1 APO -Staff Representative 48 Guests The meeting of the Kalispell City -County Planning Board was called to order by President Fran.Letntnger at'8:00 p.m. A motion by Dorothy Garvin,.seconded by Dale Haarr approved the minutes of May 11, 1976, as mailed. The Hearing on Slama Addition was continued, and the Staff gave a brief summary of.the proposal. Dale Williams provided additional tnformatton.from the Kalispell On -going traffic committee wtth regard to access of the proposed street to the County Road known as West Wyoming. Additional comment was received from area landowners with con- cern voiced on items such as, property values, neighborhood character, park, traffic, school impact and general opposition. After discussion by the Board, Dale Haarr moved: that the Board recommend to the city that the Slama Additton be annexed as No. 1 Residential but that due consideration be given to the objecttons of adjacent -landowners: Seconded by Dorothy Garvin; Lupton moved to amend the motton to: 1.) accept Park in Iteu of cash, 2.) that the questton of ownership of West Colorado between 5th. Ave..W. N. and the Slama Property be resolved in favor of the City, and 3.) that the city give due consideration to access to West Wyoming. Seconded by Lois Randall. Charles Hash abstained. Motion carried. Motion was approved as amended. The Staff, gave a b.rtef revtew.of'the proposals, an.d passed out suggestions for covenants received from tKe Soil Conservation Distrtct: Joe Daley, an attorney representing Mr. and Mrs. Marlow Foy, pointed out some potential problems concerning the use of the existing water system in Country Village Phase II. Harvey Knebel moved; that the APO Staff be directed to inform the County Commissioners of the existing problem on the present community water system and that the present water contract be reviewed and the problem resolved. A copy of the contract was to be submitted to the County Commissioners. Seconded by Dorothy Garvin. Motion carried. Garmen Meadows and William Lupton abstained. Following further.dts.cussion Dale Williams, moved .that: .th_e. Board recommend to. the. County CQmm[!5s.iQners that Country Village Il and Mission Village Il be given preliminary approval subject to the following conditions: 1.) The items recommended by the Staff, A. Mission Village II 1. That all water and sewerage systems be approved by the State Department of Health and County. `San%tarian, and 2. that Lot 1, preliminary plat, be -dedicated to the County for a park in conjunction with the pre - .existing proposed park, and 3. that covenants as proposed for Mission Village II be amended to provide for leash control or'confine- ment..of dogs, and 4. that all deeds and covenants 4nom tkis day 4oAwaAd be prefaced with a statement notifying purchasers of agricultural uses adjacent to this site and of the potential problems which may arise, and that the conservation district be contacted for any questions as to these potential problems, and 5. that no.commercial lots. shall have through vehicular access, and 6. that roads be constructed according to county, standards and proper sized.culver'ts be installed to promote drainage to the exis.ti^ng drainage drop in Lot.], and 7. that the final covenants contain the following items: 12, 4 &.6.of Conservation Dis.trlct items. 17.. Inspection of gardens can be carried out in search of any disease harboring plants, shrubs or -trees, and..if found, can be disposed of. 2. The subdivision will have a s:trict,_enforced leash law. The.pets will be restricted to owners: property. 4. The developer and;the lot owners shall be res-ponsible for dog proof fencing when development borders farms or roads adjacent to agriculture. 6. All lot owners will be fully responsible for control of noxious weeds on their property. These weeds shall be those designated by� county and state laws.. and that these covenants be reviewed by the 2. 0 County Attorney for proper wording prior to final approval and B.. That all water and sewerage systems be approved by the State Department of Health and County Sanitarian, and 2. that the natural drainage through Lot. No. 32 have a 20' drarnage'way easement, conveyed to the county. Said easement would be owned and maintained by the lot owner but would exclude the placement of permanent structures. Covenants contain items 1, 2, 4 & 6 of Conservation District proposed covenants, and. that final wording be reviewed by the County Attorney, and that 7. the County Commissioners be advised of existing water problems. Motion Carried. William Lupton and Garmen Meadows. abstained. Conservation Conservation District Proposed Agricultural Policy Guidelines District Proposed were distributed for review and discussion at the June' 8 Agricultural Policy meeting. Guidelines.
