12-06-7912-6-79 A regular meeting of the Kalispell City -County Planning Board, in the Courthouse East Community Room, 723 5th. Avenue East, Kalispell, -MT. Tuesday October 23, 1979 Members Present: APO Staff: Wm. J. Lupton Jim Mohn Robert LeDuc John Kain Ray Lybeck Dorothy Garvin Meeting was called to order by William Lupton with the PUBLIC HEARING: Pines Resubdivision. Jim states that what the staff report talks about is the THE PINES RESUB changes in the method of ownership concerning the four DIVISION: lots involved. Up until the present time it has been Location; lots 9 -129 constructed as a condominum project, now the developer Porta Villa No. 2, wish to changes it to a townhouse unit, which in affect Addition #65, to the subdivides it even further and each unit will set on it's own City of Kalispell, spell parcel of land, and the balance of the commen area owned in Section 12, Sects joint tendency by the members in the 16 unit project. There have been some minor details worked out by the City Attorney. The project does meet the density by the RA-1 Zone. There is a conditional use permit and variance request pending with the Kalispell Board of Adjustment at this time. They will meet November 7, 1979. As far as the staff is concerned there doesn't seem to be any problem with that. John Kain asked does; the conditional use permit and the variance wait on what they might do or do they wait on what we might do? Jim answered "We are waiting on what they have." The question was asked why do they want to change them, in answer to this question was that they are not financeable under FHA financing for construction and for sales. As condominiums they are not FHA financeable when there is 11 or more condominiums in a project they will not mortgage them. Townhouses they treat the same as single family residents. Ann Smith asked how dose the Board of Adjustment come into it? Jim answered that this goes to them under their 'new powers. jim was aked what are they adjusting. Jim answer they are adjusting the minium area for clustered housing projects from two acres to an acre and a quarter, and they are also granting a new conditional use permit, which is required under the Ordinance. There is no change in the project at all, not in the size, cc 12-6-79 1. 12-6-79 El Dorita Village A portion of Tract 5AN, in NW4,NE', Section 12, T28N,R22W P.M.M. , West of Valley View Add. #16. Minutes approved of (7-24-79 & 10-9-79) use, or density, nothing in the matter changes except the legal description which would be Townhouses and not condominiums. There are two buildings complete now and the third building is about 70% complete, and a forth has the foundation only. John Kain made the motion that the resubdivision of the Pines Lots 9 - 12, of Porta Villa No. 2, Addition # 65 to the City of Kalispell that the conversion from the Condominium units to Townhouse units, baced on no objections or unfavorable action from the Board of Adjustments. The motion was seconded by Ann Smith. Motion was carried. The Minutes of July 24, 1979 and October 9, 1979 was motioned for approval, seconded and carried. Jim says what is being proposed is three residentual appart- ment structure, and one wondering recreational structure on a 2.8 -acre peace of land west of Valley View appartments it's the same developer as Valley View and the concept is the same however the architecture is not the same. As far as the plan and zoning are concerned, this Board recomend- ed a plan amendment to acomadate the project and annexation will be, made for RA-1 Zoning and again the developer have applied for a multiple •structur-es on a single Tract of land. The only problem the staff can see is with the traffic, one on the short term is there will be an increase on Liberty Street which everybody in this Adams Addition has been opposed in the past and the second is somewhere in the. future we need to establish a north south street to get some of the traffic off of Liberty street back down to Two Mile Drive. . Looking at the proposed site plan we don't see any real suitable way to begin to ask for the nesecarry right of way in this addition. The only thing that we can hope for is that the balance of the Tract that this parcel is being taken from will come in as a single development so that we can get an appropriate design to get the nescessary right of way projected to the south. John Kain asked Jim this was in the quarter corner of the area. Jim it was closer to the quarter corner section, but looking at the properties held in the immediate south .are in single ownership and there are about 60 ownerships there. What we are hoping for is that between that parcel of land and the property immediatly west of this El Dorita site that we can begin to get a collecter of that property. John Kain stated that it looks like a right of way already. is there. Jim explained that that was no longer there, it is strictly a drainage use now. But there is a half street there. 2. i 12-6-79 Ann Smith asked if there was a culdesac at the end of it. Jim said that he had a temporary culdesac. John Kain said that you cann't put curbs and gutters on a temporary culdesac and that he would want curbs and gutters in it, and that would be expensive. John Kain. says that .he is in favor of only putting up a baracade. Ann Smith asked if there is enough room for a firetruck to get in and out. Jim said he talked to the Fire Department. and they didn't see any problems, just recomended location hydrants. Ann Smith said that she was infavor of putting in the 38 foot street with curbs and gutters, and a temporary culdesac would not necessarily have to have curbs and gutters in it would be only temporary. John asked If the west end of this is on a drainage" Jim says it all drains south, the northend .drains southwest. The property will be contoured a little bit. from what there is now so that between the two, buildings at the north end so that there will be a crown in there so that it will drain east west away from the crown.. It will drain into a drainage easement and strom drainage along the south boundary and drain south to the south boundary then east to the drainage easement that goes through to the back Hawthorn East then south to Two Mile. Fran 011endike moved that we recomend approval of El Dorita Village Addition No. 109 to the City of Kalispell with the recomendation that they take into consitteration the Fire Cheifs recomendation for the hydrants. The Motion was seconded, and carried. Motion was made to adjourn the meeting, motion seconded and carried.
