07-14-81 Zoning CommissionKALISPELL CITY ZONING COMMISSION MINUTES July 14, 1981 Members Present: Jack Heller, Chairman Ann Smith Ron Nance Others Present: Jim Mohn, FRDO Planner Minutes Approved Meeting was called to order by Chairman Heller at 7:30 P.M. in the Kalispell City Hall. Minutes of the previous meeting were approved as mailed. Zoning Amendment The Commission considered a request by Joel Ventre Request for amendment of the Official Zoning Ordinance of the City of Kalispell, to amend Table 3-1, Appendix B, to provide for "secondhand store" as permitted use in B-3 (General Business) and B-4 (Community Business) Zones. Discussion Ventre requested the change to allow operation of Ua flea market on property presently owned by Ron Pack and located west of the Fairgrounds on Meridian. Property is presently zoned B-4. The "flea market" would be a large scale seasonal operation with temp- orary partitions. A gate fee would be charged for drive-in traffic; the area covers about 62 acres with parking in the rear. Heller suggested using the Drive -Inn Theatre during the summer months. Ventre stated parking would be a problem. Heller stated he was not opposed to the concept of the flea market, but if he were an adjacent resident, he would be opposed. Smith noted area residents did not reside in the immediate vicinity. Mohn stated flea merkets would fit under the category of secondhand stores. Heller questioned sales from concession stands. Ventre stated that was a possibility, but there would be no alcohol sales. Tents or structures for protec- tion from the weather would be set up by stall rentors Heller questioned construction of fencing. Ventre stated it would not be fenced this year, but could be considered at a later date. Ventre stated he had similar operations in Orange County, California and Phoenix, Arizona. He noted he would be insured for $300,000. Heller again suggested use of the Drive -Inn or the baseball fields. Drive -Inn area is now zoned RA-1. Motion for Approval Smith moved to amend the Official Zoning Ordinance of the City of Kalispell to amend Table 3-1, Appendix B, to provide for "secondhand store" as permitted use in B-3 (General Business) and B-4 (Community Business) Zones. Discussion: Nance stated he could see no problem other than aesthetics. Smith stated city ordinances addressed litter problems and read the city ordinance concerning litter and containers. Ventre stated the operations would be open for inspection, if the City so desired. Plans for operation are from May to September.
