05-26-81 Zoning CommissionMay 26, 1981 KALISPELL ZONING COMMISSION MINUTES Members Present: Ann Smith Norma Corbitt Ron Nance Ken -Way Zoning The Commission considered a request by Ken -Way Devel- RA-1 opment for RA-1 zoning designation on property known as Ken -Way #2 Addition No. 135. Property abuts R-5 zoning and is compatible with the adjacent area. FRDO recommended approval.of the requested change. Zoning Approved Smith moved to recommend to the City Council that the request for RA-1 Zoning by Ken -Way #2 Addition #135 be approved. Second Corbitt. Unanimous. Third Ave. East The Commission considered a request by Third Avenue Zoning - B-3 East Enterprizes for amendment to the Zoning Map of the City of Kalispell for a change from RA-1 to B-3 on property East of the new U.S. Forest Service Building on 3rd Ave. East and West of 5th Ave. East in Kalispell. FRDO Approval F.R.D.O. recommended approval of the request noting that there was no basis for objection; however, it did represent an encroachment of commercial zoning into a residential zone. F.R.D.O. stated the existing ordinance did not provide for any other solution to the parking lot use of the property. Zoning Approved There was no public comment. Smith moved to recommend approval of the zone change from RA-1 to B-3 based on F.R.D.O. evaluation and test criteria (See F.R.D.O. Report). Smith noted adjacent owners may present comments to the City Council. Second Nance. Motion Unanimous.. Ordinance "B" The Board considered a request by Jerri Swenson for Amendment (Swenson) amendment to the Kalispell Zoning Ordinance "B" to provide for "Real Estate Offices as a permitted use in the B-6 District reference Table 3-1. Mohn sug- gested the wording be re -stated in B-6 to read, "and other tourist related services"; and create a new category in 3-1 to allow for demand for car rentals or travel insurance offices that may be tourist re- lated. Mohn noted the intent was to allow tourist related businesses, but not to open the door to too j many types of offices. 5 Smith noted a problem with the word "general". The Board of Adjustment will determine the definition of "general". Heller stated his preference to identify specific services, rather than an arbitrary decision. Smith moved to recommend to the City Council to in— clude in B-6 that car rentals, travel agencies, travel insurance and real estate offices be a "conditional use". Heller objected to travel insurance business which would lead to insurance offices. Smith withdrew the motion. Amendment Approved Smith moved that car rentals, travel agencies and real estate be permitted uses in a B-6 zone, as an amendment to Appendix "B". Second Nance. Motion Unanimous.
