01-13-81 Zoning CommissionKALISPELL ZONING COMMISSION MINUTES January 13, 1981 Members Present: Norma Corbitt Ann Smith Roger Graham Others Present: Jim Mohn, FRDO Planner Mayor Happ City Council Members Norb Donahue Bob Hafferman Minutes Approved Meeting was called to order in the Kalispell City Hall at 7:30 P.M. by Norma Corbitt, Presiding. Minutes of the previous meeting were approved. Johnston Zone Mohn presented the FRDO staff report concerning an Change application by Harriet Johnston for a change in zoning classification from R-4 to I-1 on property located Southeast of the intersection of 4th Ave. E. and the Burlington Northern right-of-way. Purpose of the zone change request was to complete sale of the property to Roger Claridge, who owns adjacent properties with zon- ing of I-1. Claridge's intent is to use the property for mini storage warehouses. Land abuts light indus- trial on the North and West. Properties East and South are zoned residential. Subject property was previously zoned I-1 and no -reason could be found for its change to R-4a Mohn recommended approval of the requested change from R-4 to I'-1. Motion for Smith moved to recommend to the city council to change Approval on the zoning from R-4 to I-1 on both the Johnston and Johnston & Barnum Irene Barnum properties. Barnum properties are located East of the Johnston land. FRDO will notify adjacent landowners before City Council approval. Motion seconded by Graham. —motion Unanimous C� Mayor Happ questioned structures zoned R.-4 near the Barnum and Johnston properties. Houses are located to the rear of subject land. Mr. Francis O'Boyle questioned sewer line extensions and easements to the property as they would need to cross center street. The intended use does not now require sewer extensions. City Council members questioned the lack of notification of adjacent owners before this hearing. Mohn stated it is not required by statute, but agreed it would be better policy to notify adjacent owners. Hafferman concurred. Doug Johns stated Verma has the names and addresses of adjacent owners. Saverud stated Barnum owns additional land East of this property and sug- gested zoning all of the area along the tracks I-l. Doug Johns stated she intended to do this, but was presently working only on this property. Mohn ex- plained the zoning commission was proceeding rather than hold two public hearings. Motion was unanimous. Mohn expanded upon FRDO recommendations stating the Johnston and Barnum lands were hardly residential on the railroad tracks; land abuts I-1 zoning; and it is compatible with the Comprehensive Plan. School District Next on the agenda was consideration of a request by #5 Annexation School District #5 for annexation to the City of Kal- ispell with R-4 zoning. of LOU.-, 22, Block 2 of North- west Tracts north of Three Mile Drive. The lot adjoins the rest of the Junior High School site on the North and West. FRDO Approval Mohn and FRDO recommended approval of annexation as no adverse.affects are foreseen; city limits boundaries would be straightened; annexation of the county road up to the school parking lot would be facilitated; it is compatible with the Comprehensive Plan; a petition signed by the Board of County Commissioners had been filed requesting annexation of this road into the city; and municipal services are available at no additional costs. FRDO Conditions FRDO recommended the following conditions with annexa- tion: 1. School District #5 dedicate an additional 20-foot right-of-way from Lot 22 to increase width of the county road to the 60-foot city specifications. 2. The city shall not.be required to remove snow from the bike route along the county road and that Lot 22 be zoned R-4 as requested by School District #5. Board moves Corbitt read from a letter signed by the Flathead for Approval County Attorney. Smith moved to annex the property with R-4 zoning and recommending the city not be responsible for snow removal from the bike route along the county road, and the school board request the county to donate a small piece of the road on Three Mile Drive to the City. Motion Amended Supterintendent Allred stated he had a problem in ex- plaing to the school board the conditional annexation of a small piece of road. Smith explained that gen- erally, when annexing adjacent to a county road, the county is usually glad to give the road to the city. U After some discussion, Smith moved to amend the first motion and remove the condition of the road donation. Second Graham. Motion unanimous. There will be no correspondence from the Board decisions to the city as the City Council was present at this meeting. Zone Change Next on the agenda was consideration of a change in near BNRR & zoning classification from LM to CLM of the area located Davis Machinery South and Northeast of the Burlington Northern tracks near Davis Machinery and Balmer Bros. John Gordon, representing Davis machinery, stated his client is negotiating a lease from Burlington Northern. Norb Donahue stated he could see no reason to change the zoning unless Burlington Northern so requested. Councilman Saverud suggested FRDO correspond with BN for their views and then make a recommendation to the Zoning Commission. Motion for Smith moved to further contact B-N and receive a recom- Further Reports mendation from the FRDO. Smith discussed moving the C-3 zoning up to include the Depot because adjacent property is CLM. Smith stated it would be much simpler i if CLM and LM were combined. Gordon stated Davis Machinery is presently leasing the property and its present zoning does not allow all the uses required. The Council members present recommended more communi- cations between B-N, Davis Machinery and the Planning Board. Smith moved to recommend to the City Council that the city zone the area known as Depot Park and the Depot to C-3 (removing part of- LM): extend C-3 to the downtown redevelopment plan to include depot boundaries so the Chamber of Commerce can move into the Depot Building.
