06-10-80 Zoning CommissionKALISPELL ZONING COMMISSION MINUTES June 10, 1980 Members Present: Jack Heller, Chairman Roger G.raham, Norma Corbitt Ann Smith. Minutes Amended Meeting was called to order in the Kalispell City Hall at 7:45 P.M. Minutes of the May 27th meeting were amended as follows: Dorothy Garvin was unable to serve as Chairman of the Kalispell Zoning Commission as she was not a city appointee. Jack Heller was elected Chairman; Norma Corbitt, Vice -Chairman; Roger Graham, Secretary. Minutes approved as amended. Public Hearing, A public hearing was held on the Meridian zoning. Mohn Meridian Zoning read the recommendations of the FRDO as stated in a letter of June 9th to Forrest Daley, signed by Nick Verma. (See Attached) Bill Astle, Attorney for the landowners residing in the area South of Storms Meridian Lots, read the ATS recommendations stated in a letter of August 2, 1979, which recommended high -density urban. This would create a buffer zone which the homeowner's felt was acceptable. An ATS letter of December 26, signed by Gary Hill, stated there was no need for Industrial Zoning to extend _beyond the railroad tracks. Astle stated a need to honor the Comprehensive Plan and re- main residential. Charles O'Neill, owner of 6 lots in Meridian Zoning, felt the area was ideal for light industrial and bought that property with an understandingof its non -conform- ing uses and zones. He felt the area was already light industrial. Smith stated the Board's prior recommenda= tion was industrial and the Zoning Commission had recommended RA-1. Heller questioned uses in that area if zoned B-3 or light industrial. Smith explained the Supreme Court's considerations when considering law- suits. Forrest Daley presented a schedule with B-3 and B-4 zoning. Mr. Getz, owner of a welding shop in the area since 1949, stated the original zone in 1948 was industrial. Heller stated it was a question of the present primary land ^� use. Astle stated residents of the area do not object,. �J to the present businesses and asked the Board to con sider the entire area, not just spot zoning..... -He ahso' requested the Board to consider the wisdom of I:;the Com- prehensive Plan. Heller referred to Daley's.7ist of 0 �J U existing light industrial uses. Astle stated the residents could live with the existing zoning, but requested the Board to leave the floodgates closed. Mohn stated when selling property, the existing zoning or businesses have the right to remain as is. Astle stated B-3 is not used as a buffer zone as stated in Verma's letter. R-1 is specifically termed as a buffer zone. O'Neill stated he does not have any present plans to place any industries on his lots, but another party has plans for an alcohol plant. Mr. Kurt, representative of an existing Tree Company in the area, stated his Washington manager will take legal action to get light industrial zoning for the area involving their operations. Astle stated Jeff Juston has the most recent develop- ment in the area with the building of his home in 1979, which is compatible with the present zoning. Smith stated her preference was to recommend B-3 for the whole area because residential or!!industrial would cause a hardship. B-3 would be a compatible compromise. Corbitt stated Meridian presently has too much traffic. Graham was 'concerned with the school across the street from an Industrial area which would create a health and safety hazard as the school would never be moved. Forrest Daley requested the Board to consider city taxes and recommended Industrial for tax base and employment. Heller suggested zoning one-hal.f light industrial and the other half RA-3. Break, 8:45 to 8:55. Recommended Mohn stated RA-1 and RA-2 can be used as a buffer zone, Zoning which allows high density multi -family uses. Land values would be more stable if RA-2 was used (see map attached). Huston stated B-3 would border the school. Astle noted that was an improvement, but some residents still border B-3. He explained to the Board I-1 would start a trend by zoning past the Rd,il- road tracks. Heller stated the trend already existed. Motion Passed Graham moved to recommend to the city council a zoning of I-1 on the North half and RA-2 on the Southern half with no B-3 zoning. Corbitt second. Heller, Graham, Corbitt, Aye.
