KALISPELL CITY - COUNTY PLANNING BOARD MINUTES
May 13, 1980

Meeting was called to order in the Kalispell City Hall
at 7:30 P.M. Minutes were approved as corrected to
read, "Next scheduled meeting is May 13, not April 13."
Public Hearing Public Hearing was held on Orrin treich zone request
Streich on 13 acres near Kings Loop Mobile Home Subdivision and
Industrial C & C Plywoo_d_. S_t.r_ei_ch_ requested: 1. An amendment to
the Comprehensive Plan, 2. Change zoning from sub-
urban residential to Industrial, 3. Create a new zoning
district on 13 acres of "I-2". (Change 32 acres from
R-2 to I-2).

Recommenda- Amendment be denied. 2. Heavy industrial use is not

Doyle Tom Sands of Doyle Enterprises presented maps of Kings
Enterprises Loop Subdivision and a letter from the County Sanitarian
stating problems with ground water if land was subdivided
for residential use. Costs of land fill of 96,262 yards
at $351,000 was not economically feasible. Sands stated
Great Northern would purchase the land if zoning is
approved and a ten -foot buffer zone would exist between
Kings Loop and the log decking operations. He noted
fire danger was not a hazard as C & C has a 24-hour
watchman.

Public Comment
David McCoy, 448 Kings Way, President of Kings Loop
Homeowners Association, presented.45 names on a pet-
ition requesting the proposed zoning be denied. Prob-
lems listed were: noise, pollution, dust, dirt, day
and night stackers running, fire hazard from wood storage
and a hazard with children playing on log decking opera-
tions, access from Kings Way is now minimal and children
walk on the road to West Evergreen School, 4-wheel access
during winter, lower property values, ground water prob-
lems and contamination if mill ponds are used, trees
growing on lots when purchased have now died and were
never re -planted.

Orrin Streich noted C & C does not utilize a mill pond,

logs are peeled, and they have no intention of running
log trucks through Kings Loop. He presented a letter
from Plum Creek Lumber Company (See Exhibit "A").
Streich stated C & C Plywood would clean up 9 acres
adjacent to Kings Loop and he has contracted to plant
250 Lombardi Poplars. Cause of tree deaths has not been
determined.

James Carlon, Sheehey, Lon Mitchell, Duane Carlon,
Landowners
Burt and Agnes Engebretson, Mark Bergett, all of Kings
Loop, publicly stated their objections as follows:
Trucks are now using Kings Loop roads, too much noise,
strip zoning, safety danger of children playing on log
decks, traffic hazards, fencing would not stop the noise,
use of mill ponds. Zoning changes should be denied as
existing problems would be compounded. Lots were pur-
chased with the understanding that adjacent area would
be residential.
Streich Streich re -affirmed his position that area was economic -
Opinion ally unfeasible for further residential development and
noted C & C employs 250 people. Sands questioned validity
of Kings Loop Petition and Board stated it was not nece-
ssary at this point to determine its legality.
Board Comments Board answered Kings Loop road problems by advising
residents to petition and hire an attorney to close a
hazardous road. Also, landowners could petition the
County Commissioners with 51% signatures and request
to be zoned. Present mobile homes are taxed as real
property.

Decision jukich felt the Plum Creek letter was too open-ended.
Tabled LeDuc moved to table any decision until May 27th as
further consideration was needed to determine a work-
able land -use solution compatible for both parties.
Second by Peters. Corbitt and Paliga opposed. Motion
passed and decision was tabled until May 27th.
New Business Smith read a letter from Nick Verma regarding Kalispell
Traffic Operations and its study stages. Also, a letter
was presented from the Department of Health and Environ-
ment on the Tamarack Woods Phase I Development and its
impact. (Located South of Lakeside near old Tamarack
Restaurant) Board cannot act on this proposal.
Meeting was adjourned at 9:00. Next meeting is scheduled
for May 27th, 7:30 P.M. in the Kalispell City Hall.

The land, if purchased, would most likely be used 'as .a.
buffer zone between the residences now located in Kings
Loop and the stud mill.. It would probably be utilized'

We. do have twenty-four hour watchman service, which is
required'by our insurance company, to alleviate your
questions concerning fire hazard; fire.prevention carries
a high priority.with us throughout our entire operation as
it is -of utmost, importance.
