MINUTES
January 25, 1983

The meeting was called to order at 7:00 P.M.'
by Ed Trippet in the Council Chambers, Kalispell
City Hall-
Mohn presented a brief synopsis of the Planned
Unit Development proposed Amendments.
Palmer stated that on page 2, #5, that the
time table was not practical and asked how
long PUD's were being used in other areas.
Verma stated that it began in approximately
the mid-70's and that 80% to 90% of the cities
use this.
Jukich asked Verma if the PUD did not fit
with the Comprehensive Plan, how could this
be handled.
Verma replied that sooner or later it would
come up with a provision, and that the nature
of the project may or may not require an Amend-
ment to the Comprehensive Plan.
Wright asked if a developer needs to submit
a time table.
Verma said that this is a decision that is
made by the developer and that there is no
statutory time limit.
O'Boyle stated that in a new town, the zoning
would be fine, but not in an old town like
Kalispell and that under a PUD it would not
be given any freedom.
After further discussion, Palmer moved to
recommend the following:
The Kalispell City Zoning Ordinance be amended
to include the PUD Zoning Classification ap-
plicable to all properties within the City
boundaries, subject to the following:

1. The City -Attorneys summation and recom-
mendations in reference to the legal aspects.
2. This is to be accompanied by the minimum
of three cities, of comparable size and
area, response to the following questions:
a. Do you currently have a Planned Unit
Development zone?

c. How many PUD's have been developed?
d. How many zoning classifications do you
have within your city area?
e. Does it encompass all of the City property
boundaries?
f. Do you feel that there is additional
expense in administration of a PUD? If
so, approximately how much?
g. Have there been any problems with en-
forcement of or in a PUD?

h. If given the opportunity, would you
re—enact the PUD?
Seconded by Shank. Unanimous vote. Motion
carried.
