Award Agreement to Robert Peccia & Associates for Professional Services in Response to Emerging Contaminant PFAS, for Water Source Replacements and/or Treatment Alternatives This item considers approval of an agreement for professional consultant services for the Water System's response to the detection of emerging contaminant Per- and Polyfluoroalkyl (PFAS) compounds. 3. Award Agreement to Robert Peccia & Associates for Professional Services for the Four Mile Drive Path Project This item considers approval of an agreement for the design and construction of a path along the north side of Four Mile Drive. F. COMMITTEE REPORTS G. PUBLIC COMMENT Mayor Johnson opened public comment. Rebbecca Miller, Public Comment Page 2 of 13 Kalispell City Council Minutes, May 6, 2024 Ms. Miller, resident of Kalispell, and Board Chair of Valley Neighbors, a local non-profit who assists immigrants in the valley, spoke regarding her positive experiences with immigrant families. She talked about the nature of change and working together towards positive paths forward. She talked about the negative and positive messages the organization received over the weekend. She invited the community to use the organization as a resource and said they are happy to talk with groups, etc., and encouraged the community to be welcoming. Ron Gerson, Public Comment Mr. Gerson, 4`" Ave East, agreed with the comments of the previous speaker saying he has worked with migrants since 2021 and can confirm how positive the experience has been speaking further about their characters and experiences becoming active and participating members of the community. He spoke regarding the harm caused by community members spreading misinformation, name-calling, and blaming; and the need to come together positively as a community. Mandy Gerth, Public Comment Ms. Gerth of Kalispell, Director of the Kalispell Heart Program, also serves as the Homeless Education Liaison for Kalispell Public Schools, and on the Education Outreach Committee of Community Housing Solutions of Northwest Montana spoke on a personal level on behalf of newly arrived immigrants to Kalispell. She spoke regarding her positive experiences with her children at the city parks meeting new immigrant families, and her positive experiences with them and their children in other capacities. She talked about these families' difficult experiences and hard work and dedication to education. She spoke regarding her sadness by voices of some elected officials over the last week that do not reflect the values she upholds. Sherry Anskou, Public Comment Ms. Anskou of Kalispell works for a global organization that gathers people's stories. She spoke to her experiences in interviewing communities and people that help those in need and newcomers and the positive experiences that those actions bring to a community. Ken Yakachak, Public Comment Mr. Yakachak spoke regarding being the son of an undocumented immigrant and how the community assisted his family when his father died. He spoke regarding his military service, and his ability to graduate from College. He spoke to the false information that has seen printed about Valley Neighbors, and to the positive community work they are doing. He spoke to the importance of serving the country and the community. Lori Holgate, Public Comment Ms. Holgate said she would like the Council ward map improved. She spoke to the difference between illegal entry persons and legitimate legal entry persons in the community. She spoke regarding her views on recent comments made by politicians. She spoke to her positive experiences and positive values she has seen with the legally entering families she has met, and the negativity she has heard towards them. Miranda Hernandez, Public Comment Ms. Hernandez of Whitefish spoke to her negative views regarding the documents released by the Flathead County Sheriff over the weekend relating to immigrants. She talked about the negative experiences people undergo that bring them to move to the United States. Page 3 of 13 Kalispell City Council Minutes, May 6, 2024 Rich Emanuel, Public Comment Mr. Emanuel of Kalispell spoke regarding his positive experiences working in a multicultural health care system. He then spoke regarding conversations about hardships on the reservations. He talked about his views related to determining the motives of people coming into the Country. Lois Wagner, Public Comment Ms. Wagner of Lawrence Lane in Kalispell spoke in support of Valley Neighbors talking about the services they provide. She talked about her positive experiences with the people and families she has encountered as a volunteer with Valley Neighbors. She spoke to the question raised by the previous speaker and her views on the responsibilities of responding to the needs of those that come and make all welcome. Rosemarie McKennon, Public Comment Ms. McKennon of Kalispell spoke on behalf of Valley Neighbors. She explained her experiences as an immigrant who married an American, and her experiences coming to Kalispell thirty years ago. She talked about her positive views of Valley Neighbors and her recent positive experiences with a new immigrant family, and positive experiences with community members who have been welcoming to them. She spoke to being appalled by polarization within the community. Jenee Shmounts, Public Comment Ms Schmounts, a Board member and volunteer with Valley Neighbors for three years spoke regarding her positive experiences getting to know the families they serve. She talked about the positive values of the people served and talked about the reasons why people immigrate. She continued with information about the employment and contributions they are making to the community. She encouraged elected officials to take time to get to know the new neighbors in the community. She spoke regarding her role at Valley Neighbors and the support they have seen from individuals and businesses. Walter Rowntree, Public Comment Mr. Rowntree of 22 5`h Ave East spoke regarding a study article he read related to effects of PFAS (per- and polyfluoroalkyl substances) by group. Valerie McCarvey, Public Comment Ms. McGarvey of 5`h Ave East spoke regarding her involvement with Valley Neighbors, why they were formed and details regarding their nonprofit status. She spoke regarding the legality of seeking asylum. She refuted statements made about Valley Neighbors and provided information about the family that has arrived in the valley. She spoke regarding seeing threats of violence online towards immigrants and asked people to seek the truth. ? Public Comment ? of Liberty Street in Kalispell spoke regarding the statement made by the Sheriff and in opposition to illegal immigration. Malerie Phillips, Public Comment Ms. Phillips of Whitefish spoke regarding her views on political statements and her views on the importance of policy decisions that assist with building enough housing, funding mental health care, etc., to combat hurtful statements towards others. Page 4 of 13 Kalispell City Council Minutes, May 6, 2024 Leana,_Public Comment Leana of East Kalispell talked about the hateful rhetoric she has seen this week and the importance of speaking up against it. She talked about her family's military service including the extensive military service of her grandfather who was an immigrant, and his commitment to the USA. She spoke regarding her volunteerism and values and of the values she would like to see within the community. Dee DeYouniz, Public Comment Ms. DeYoung, of Creston, a volunteer with Valley Neighbors spoke regarding her positive experiences serving the immigrant community and their positive values. She spoke regarding the history of immigration into the United States. She talked about her views on the negative effects of divisiveness and misinformation. She spoke regarding the reasons and struggles of people who immigrate. She talked about the misinformation being spread about Valley Neighbors. She read statistical information from the US Immigration website about the positive economic impact of immigrants. Min,- Munsing, Public Comment Ms. Munsing at 213 Tronstad Road, Kalispell thanked Council for their service. She then spoke in detail on her views about the crucial role that legal immigrants play in every community. She talked about her family experiences immigrating legally. She spoke about her views on current politics related to legal and illegal immigration, and her desire for policies that respect the framework for legal immigration maintaining safety and order. Courtney Brooks, Public Comment Ms. Brooks of Lakeside, an English language teacher spoke regarding working with people that Valley Neighbors has also worked with. She spoke about the struggles of learning a new language, and how hard she feels they work at passing citizenship tests, paying taxes, and working within the immigration system. She encouraged those wanting to learn more about the global community to attend an English language class. Sara Cole, Public Comment Ms. Cole of Lakeside spoke to her positive experiences with Valley Neighbors as they advocate and enroll students. She spoke to the positive experiences she has had with young students who are English language learners. She spoke of the positive values she has seen them show and how grateful she feels for them. REPORTS, RECOMMENDATIONS, AND SUBSEQUENT COUNCIL ACTION 1. Ordinance 1919 - Second Reading - Changes to Ch 24, Sidewalks This item considers amendments to Kalispell Municipal Code Chapter 24, Sidewalks. Page 5 of 13 Kalispell City Council Minutes, May 6, 2024 City Manager Russell provided an overview of this item. 00:59:42 Council Member Hunter asked about questions posed in a written public comment. 01:00:08 Public Works Director Susie Turner responded to questions about right-of-way permits and talked about the sidewalk standards that have been in place since 2005. 01:02:14 Mayor Johnson asked for clarification about sidewalk standards. Deputy Public Works Director Keith Haskins answered questions related to standards. 01:03:17 Public Comment Mayor Johnson opened public comment. Kisa Davison, Public Comment Ms. Davison, the owner of Iron Star Construction spoke to recent enforcement of standards that have been in place. She listed subdivisions that did not pour sidewalks to standard and the need now for building companies to remove and replace concrete to the standard. She would appreciate a staff review of this issue and asked right-of-way permit questions. Seeing no further public comment, Mayor Johnson closed public comment. 01:07:05 Motion to approve Ordinance 1919, an ordinance amending Chapter 24 Streets and Sidewalks, Articles 1 and 2 of the Kalispell Municipal Codes, declaring an effective date and authorizing the City Attorney to codify the same. CITY MANAGER, COUNCIL, AND MAYOR REPORTS (No Action) City Manager Russell explained additional information that was requested on the upcoming discussion regarding the Warming Center and asked for related Council direction. 01:36: % Council Member Hunter referenced his request. City Manager Russell reported that budget work sessions are scheduled for Tuesday, May 6, and Wednesday, May 7, 2024, at 6 pm., explaining the order of department review. 01:37:55 Council Member Daoud talked about the importance of setting the City budget and encouraged the public to take part in the budget work sessions or view the sessions. 01.-39:10 Council Member Hunter referenced a recent new article that an Evergreen Mobile Home park has changed ownership, and the residents received an eviction notice, and the possibility of increases to homeless numbers as a result. Page 11 of 13 Kalispell City Council Minutes, May 6, 2024 01:40:04 Council Member Hunter responded to public comments received regarding Valley Neighbors and the public comments from some public officials last week. He spoke to agreeing with the majority of the public comment this evening, and the obligation of public officials to get facts correct. He spoke to his views that comments made last week were irresponsible and full of assumption and have an impact on people. He spoke to his hope that violence does not befall anyone within the community. He further spoke regarding threats he has heard have been made against Valley Neighbors and their subsequent reporting efforts. 01:42:33 Council Member Dahlman spoke in agreement with Council Member Daoud about the importance of the public attending budget meetings. 01:42:54 Council Member Dahlman addressed the comments made about Valley Neighbors and her agreement with many of the statements made this evening. She feels humans helping humans is good for the community and would extend her word of kindness to all members of the community in the Flathead Valley and believes we have more in common than different. 01:43:50 Council Member Nunnally reminded everyone to vote tomorrow in the redo election for Council Wards 1 and 2. 01:44:10 Council Member Carlson said be sure to vote tomorrow. 01:44:26 Mayor Johnson spoke regarding congratulating and awarding Certificates of Recognition from the City for three individuals who participated and won Chess Championships at the State Level. Congratulations to: David Wilson — Montana State Scholastic Chess Championship for Elementary School Tirien Bodonyi-Kovacs - Montana State Scholastic Girls Chess Championship Eliel Bodonyi-Kovacs — Montana State Scholastic Chess Championship for Middle School 0 1:46: ] 8 Mayor Johnson spoke to multiple meetings in the past with the Sheriff, and the complexity of issues within society. He read a statement on his beliefs related to the law, society, and societal and political events. He spoke further about his views on the importance of following laws and when they are broken, fixing them through policy. He provided further details about his views on immigration laws and enforcement, the current state of the Country and his fears for the future of the Country. J.
