L REPORTS, RECOMMENDATIONS,AND SUBSEQUENT COUNCIL ACTION 1. Resolution 6178 - Eagle Valley Ranch Phases 4-6 Preliminary Plat This item would approve the Preliminary Plat for Eagle Valley Ranch Phases 4-6, containing a total of 138 lots with single family, apartment/offices and a commercial lot on 39.8 acres. Seeing none, he closed public comment. 00:17:45 Motion to approve Resolution 6178, a resolution conditionally approving the preliminary plat of Eagle Valley Ranch Phases 4-6, more particularly described as a tract of land located in the west half of Section 19, Township 29 North, Ranee 21 West, P.M.M., Flathead County, Montana. Councilor Hunter provided discussion on the motion. Vote on the motion. Seeing none, he closed public comment. 00:26:51 Motion to approve a request from Peter Gulenko (Volta Rentals, LLC), for Conditional Use Permit KCU-23-06, a conditional use permit to allow four (4) multi-residential units as part of a mixed-use development, subiect to ten conditions of approval,located at 63 and 65 Page 3 of 6 Kalispell City Council Agenda, January 2, 2024 Village Loop and more particularly described as Lots lA and 1B of Village Heights, according to the map or plat thereof on file and of record in the office of the Clerk and Recorder of Flathead County,Montana. 00:27:37 Councilor Hunter provided discussion on the motion. 00:28:22 Mayor Johnson provided discussion on the motion. J. CITY MANAGER, COUNCIL,AND MAYOR REPORTS (No Action) City Manager Doug Russell provided the following reports: • Following the Legislative session there are multiple legislative bills being challenged in court. The courts have issued a preliminary injunction on Senate Bill 323 and 528. • As seen in the most recent City Manager's Report, the Urban Renewal Agency is recommending an increase in allowable funding for some of our tax increment financing programs. He confirmed that the council would like this item to go directly to a regular meeting for approval. • The work session next week includes discussion on Senate Bill 355, state local infrastructure program funds, $315,000 allocated to Kalispell for existing infrastructure. Staff will bring forth a list of potential projects identified. • Also at the next work session, Manager Russell will go over a levy presentation. • The City will host the Kalispell Chamber of Commerce UNWIND event related to the Emergency Responder Levy on January 9, from 5 to 6:30 p.m. — staff will post as a potential Council quorum at the event. The City is also scheduled to speak about the levy at the February Chamber Luncheon. 00:34:07 Councilor Daoud spoke regarding the upcoming political climate. 00:34:58 Councilor Hunter spoke regarding a recent Daily Inter Lake article on local real estate and provided discussion on the article. 00:36:22 Councilor Gabriel spoke with appreciation related to the report during action item 2 related to sluffing and the history of that issue. She then also referred to the recent article on real Page 4 of 6 Kalispell City Council Agenda, January 2, 2024 estate and the number of units under construction and recently built and asked questions about future occupancy. 00:37:23 Planning Director Nygren responded to questions saying there are about 800 units currently under construction with another 900 having been built since 2019 speaking further about details including about 160 units that will be income restricted. 00:38:49 Councilor Graham provided discussion on the real estate comments that have been made. 00:39:17 Mayor Johnson spoke regarding a District Court Order related to a suit against the state from Montanans Against Irresponsible Densification LLC that he had forwarded to staff and encouraged Council to review the Order. 00:39:53 Mayor Johnson provided discussion regarding the failure of the State to hold a special session. He then spoke regarding a Judge's stay on state legislation related to housing. K.
