12-12-23 - SignedKALISPELL CITY PLANNING BOARD & ZONING COMMISSION MINUTES OF REGULAR MEETING December 12, 2023 CALL TO ORDER AND ROLL The regular meeting of the Kalispell City Planning Board and Zoning Commission CALL was called to order at 6:00 p.m. Board members present were Chad Graham, Joshua Borgardt, Pip Burke, and Kevin Aurich. Rory Young, Doug Kauffman and Tim Stocklin were absent. Jarod Nygren and PJ Sorensen represented the Kalispell Planning Department. Keith Haskins and Patrick Jentz represented the Kalispell Public Works Department. APPROVAL OF MINUTES Aurich moved and Burke seconded a motion to approve the minutes of the November 14, 2023, meeting of the Kalispell City Planning Board and Zoning Commission. VOTE BY ACCLAMATION The motion passed unanimously on a vote of acclamation. HEAR THE PUBLIC None. KCU-23-06 — VILLAGE LOOP A request from Volga Rentals, LLC, for a conditional use permit to allow the MIXED USE construction of four (4) multi -family residential units as part of a mixed -use development located at 63 and 65 Village Loop. The building is anticipated to be two (2) stories tall with approximately 4000 square feet of office space on the main floor and the four dwelling units on the second floor. The conditional use permit is required for the multi -family units due to its location in an RA-2 (Residential Apartment/Office) zone. STAFF REPORT PJ Sorensen representing the Kalispell Planning Department reviewed Staff Report #KCU-23-06. Staff recommends that the Kalispell City Planning Board and Zoning Commission adopt staff report #KCU-23-06 as findings of fact and recommend to the Kalispell City Council that the conditional use permit for the four (4) multi -family dwelling units be approved subject to the conditions listed in the staff report. BOARD DISCUSSION Sorensen clarified multi -family CUPS as requested by Burke. PUBLIC COMMENT Tyler Tonjum - Representative for the applicant and would be happy to answer any questions. Ron Jarvis — 126 Winchester St -- Owner of 85 Village Loop — Mr. Jarvis stated that the city is not imposing as many stormwater requirements to the project as it did for his 85 Village Loop project in 2019. He also concerns about the slope, parking requirements, changes to the character of the area, and setting a precedent for mixed use projects. MOTION — KCU-23-06 Burke moved and Borgardt seconded that the Kalispell City Planning Board and Zoning Commission adopt staff report #KCU-23-06 as findings of fact and recommend to the Kalispell City Council that the conditional use permit for the four (4) multi -family dwelling units be approved subject to the conditions listed in the staff report. Kalispell City Planning Board Minutes of the meeting of December 12, 2023 Page BOARD DISCUSSION Burke stated that the stormwater issues will be addressed through geotech and the parking meets the requirements. Borgardt confirmed with Sorensen that this project will follow the same rules as were applied to 85 Village loop and asked for parking requirement clarification. Sorensen advised that parking requirements for commercial projects are based on the building size and residential projects are based on number of units. Graham confirmed with Sorensen that after Senate Bill 382 is implemented, conditional use permits would not go through the Planning Board. He also stated that this is a good use and adds more housing. ROLL CALL Motion passed unanimously on a roll call vote. KPP-23-11— EAGLE VALLEY A request from Spartan Holdings, LLC, for Eagle Valley Ranch Phases 4-6, which is RANCH PH 4-6 a major preliminary plat on approximately 39.8 acres of land containing a total of 138 lots (130 single-family, seven apartment/office, and one potential commercial lot) as well as parks, roads, and open space. It is part of the Eagle Valley Ranch Planned Unit Development, which overall is an approximately 107-acre mixed -use development approved in 2018 and expanded in 2022 that includes provisions for single-family, multi -family, and office/commercial uses. The Phase 4-6 property is generally located on the east side of US Highway 93 North, to the north of Eagle Valley Ranch Phases 1-3, to the west of Ponderosa Estates, and approximately 225 feet to the south of Ponderosa Lane. Staff recommends that the Kalispell City Planning Board and Zoning Commission adopt staff report #KPP-23-11 as findings of fact and recommend to the Kalispell City Council that the preliminary plat for Eagle Valley Ranch Phases 4-6 be approved subject to the conditions listed on the staff report, BOARD DISCUSSION Burke requested clarification of the noise mitigation of the commercial lot; Sorensen advised that it does not require noise mitigation. Sorensen explained the notification process to Graham as requested. Graham stated that there are traffic triggers that must be met in order for road improvements to be made and that MDT has different triggers than the City. Burke confirmed with Sorensen that the groundwater issue will be mitigated as part of the building permit requirements. Borgardt clarified with Sorensen that the Ponderosa community is not required to provide financial support for this project. MOTION — KPP-23-11 Aurich moved and Burke seconded that the Kalispell City Planning Board and Zoning Commission adopt staff report #KPP-23-11 as findings of fact and recommend to the Kalispell City Council that the preliminary plat for Eagle Valley Ranch Phases 4-6 be approved subject to the conditions listed on the staff report.
