LO The Kalispell City Planning Board and Zoning Commission,after due and proper notice,on December 12, 2023, held a public hearing on the application, took public comment and recommended that the application be approved subject to nine conditions. After reviewing the application, the record, the Kalispell Planning Department report, and after duly considering the matter,the City Council of the City of Kalispell,pursuant to the Kalispell Zoning Ordinance,hereby adopts Kalispell Planning Department Conditional Use Report#KCU-23- 06 as the Council's findings of fact, and issues and grants to the above-described real property a conditional use permit to allow the construction of four(4)multi-family residential units as part of a mixed-use development in the RA-2 zoning district, subject to the following conditions: 1. Commencement of the approved activity must begin within 18 months from the date of authorization or show that a continuous good faith effort is being made to bring the project to completion. 2. The development of the site shall be in substantial conformance with the submitted application and architectural/site plan drawings. 3. The recommendations of the Geotech report shall be followed. 4. Prior to issuance of a building permit, the Fire Chief shall review and approve the project to ensure it is constructed in accordance with fire code standards, including, but not limited to, access,fire flow,and fire hydrants. Any necessary fire hydrants shall be located as required by the Fire Chief. 5. Prior to obtaining a building permit,the properties shall be aggregated or have the property lines otherwise addressed. G. An access to the existing manhole on the back side of the building shall be provided. If the access is from the parking lot, the access shall be located so that it is not blocked by parking spaces or other obstructions. 7. The applicant shall provide an easement for all public infrastructure that is not currently encompassed in an easement. S. Prior to issuance of a building permit,the developer shall submit to the Kalispell Public Works Department for review and approval a storm water report and an engineered drainage plan that meets the requirements of the City of Kalispell Construction and Design Standards. The design shall incorporate recommendations from a geotechnical firm if infiltration is used in order to not negatively affect slope stability on the bluff. Also prior to receiving a building permit, the developer shall submit a construction storm water management plan to the Public Works Department. 9. Prior to building permit issuance,any garbage location and/or enclosure shall be approved by Public Works. Dated this 2nd day of January, 2024.
