07-10-90 Planning BoardKALISPELL CITY -COUNTY PLANNING BOARD AND ZONING COMMISSION MINUTES OF MEETING JULY 10, 1990 CALL TO ORDER The meeting was called to order by Lee Carothers, Vice President, at AND ROLL CALL 5.-OR p.m. Those present were Manning, Fraser, Stephens, Gould, Carothers, Sloan, Hall and Furlong. Hash was absent. David Greer, Senior Planner, represented the Flathead Regional Development Office. APPROVAL OF Manning moved to approved the minutes for the meeting held on June MINUTES 12, 1990. Sloan seconded the motion and it passed unanimously. STILLWATER Carothers introduced the request by LHC, Inc. and Roger L. Claridge ZONING DISTRICT for County RA-1 and B-8 zoning in an area generally described as being located in the north half of Section 30, Township E9 North, Range 21 West, M.P.M., Flathead County, Montana. Greer gave the staff report stating that LHC, Inc. owns part of the area to be zoned and Roger L. Claridge owns another portion. Greer showed five exhibits. Exhibit A gives the legal description the whole area to be zoned. Exhibit B gives the legal description of the area to be zoned B-6. Exhibit C gives the legal description of the area within the Kalispell Planning Jurisdiction to be zoned RA-1. Exhibit D gives the legal description of the area north of Rose Crossing and out of the Kalispell Planning Jurisdiction. Greer explained that this is a complicated process because this request comes prior to the finalization of the Evergreen and Vicinity Zoning District, which places a SAG-1 zoning designation on the properties within the Kalispell Planning Jurisdiction. The SAG-1 zoning designation will be in place before this request goes to the County Commissioners for their action. After reviewing the statutory criteria and finding the proposal to be in substantial compliance with the Master Plan, the staff recommendation is for the approval of the zone changes and creation of the Stillwater Zoning District. Greer explained that they could either reject the proposal or recommend approval. In their recommendation for approval, they could either change the zoning as proposed in the Evergreen and Vicinity Zoning District to the B-S and RA-1 zoning classifications for the area within the Kalispell Planning Jurisdiction or they could establish a new zoning district by rescinding the zoning established by the Evergreen Zoning and Vicinity District. Greer reviewed the findings of Staff Report #64. Relative to traffic, Greer added that there would be considerable trip generation with the development of a destination resort and townhouse development as proposed. The Board could expect about 5 vehicle trips per parking space associated with the golf course, 9.7 vehicle trips per day for the single family dwellings, and 18 per room for the resort hotel. Fraser asked what difference there is if the property goes into one zoning district known as Stillwater Zoning District as opposed to a zoning change for Evergreen and Vicinity? Greer stated that if it is not a new zoning district, the Stillwater ,coning District would consist of 80 acres as opposed to 294 acres. The area south of Rose Crossing would be either part of the Evergreen and Vicinity Zoning nDistrict or it would become part of the Stillwater toning District. The results would be the same. Eraser asked if one process is less cumbersome than the other? Greer felt that there could be little difference. Gould asked if the City is providing the services. Greer stated that the plan states that the City will provide city sewer and that the city has -First right of refusal to provide city water. If the city refuses city water then they can get water from Evergreen dater. Gould remarked that it seemed that the project was contingent upon getting city services. Public Hearing Carothers asked for opponents to comment on the proposal first. There were no opponents. Carothers then called on comments from the proponents. Gene Phillips, representing LHC, stated that he could address any questions that the Board may here as can Roger Claridge who is also present. Mayor Roger Hopkins stated that he is in favor of this and added that there does not appear to be any difficulty to providing sewer and water. There being no further comments from proponents, the public hearing was closed. Board Discussion Furlong expressed confusion on the two ways possible to go with this tonight. He asked what is the best way to go that creates the least confusion down the road. Greer stated that the processes are exactly the same and that the only advantage of creating one zoning district is that it involves a single ownership and development. north of Pose Crossing there will definitely be a new zoning district for the 80 acres there. If the Board decides that the entire project should be in the same zoning district then there needs to be a rescission of the zoning on the property located within the Evergreen and Vicinity Zoning District. Carothers asked which way the developers would like to have it done? Gene Phillips stated that they are comfortable with either way of doing it. Gould felt that since the Evergreen Zoning District was just completed he hesitated to make a sudden change. Therefore, he felt that the Board should change the zoning in the Evergreen and Vicinity Zoning District and allow the Stillwater Zoning District be the 80 acres outside of the planning jurisdiction. Sloan asked what the status of the Evergreen and Vicinity Zoning District was. Greer stated that the protest period ends next week. Motion Sloan moved to recommend approval of the changes to the zoning to B-6 0 for property as presented in Exhibit B and RA-1 for property t"? presented in Exhibit C rased on the findings of fact of the FRDO staff report. Furlong seconded and it passed unanimously. OLD BUSINESS None. NEW BUSINESS Greer encouraged the Board to attend the Which Way to Tomorrow meeting in Whitefish at 7:00 p.m. Gould asked what the status of the letter that was to be drafted concerning the highway beautification project. He also passed out further information concerning data relating to the designs of the Kalispell -Whitefish and Kalispell to Somers highway projects and traffic volume data. He noted that the traffic projections for the Highway 93 Corridor appear to be underestimated which could lead to an inadequately designed highway for the future.
