MINUTES OF MEETING
APRIL 11, 1989
CALL TO ORDER The meeting was called to order by Vice President Therese Hash at
AND ROLL CALL 7:00 p.m. Those present were Hash, Hall, Fraser, Stephens, Robbins,
Carothers, and Sloan. Those absent were Furlong and Manning. David
Greer, Senior Planner, represented the Flathead Regional Development
Office.
APPROVAL OF MIN- Hall moved to accept the minutes of the meeting held on February 14,
UTES FEBRUARY 14, 1989 as mailed. Fraser seconded the motion and it passed unanimously.

Hash indicated to the members and the audience that the Board would
be acting in the capacity of the Zoning Commission for the purpose of
tonight's agenda. She further indicated that each area proposed for
zoning had been evaluated by the Flathead Regional Development Office
according to the statutory criteria and each member had copies of
those reports. Unless otherwise requested, there will be no need for
the staff to read these reports since the information is available to
each member.
BUCKALLEW Hash introduced the agenda item concerning the zoning of annexed
ADDITION territory known as the Buckallew Addition, located in the NE4 NE4 of
Section 12, Township 28 North, Range 22 West, M.P.M., Flathead
County, Montana.
Greer gave a summary of the location of the proposed annexation and
indicated that the Staff recommends that the area be zoned
Residential R-3.
Public Hearing Hash opened the public hearing calling for comments from proponents.
There being no proponents, she called for comments from opponents.
There being no opponents the public hearing was closed.
Motion Sloan moved to recommend the Residential R-3 zoning classification
for the Buckallew Addition. Carothers seconded the motion and it was
passed unanimously in a roll call vote.
Motion Fraser moved to accept the findings of fact as found in the Flathead
Regional Development Office report KA-89-2. Stephens seconded the
motion and it passed unanimously in a roll call vote.
COUNTY ADDITION Hash introduced the zoning of territory known as County Addition,
located in Government Lot 2 of Section 7, Township 28 North, Range 21
West, P.M.M., Flathead County, Montana.
Greer gave a summary of the location and the staff findings of fact
stating that the Staff recommends the area be zoned Public P-1.

Public Hearing Hash opened the public hearing calling for all proponents to comment.
There being no proponents, she called on opponents to comment. With
no public comment, she closed the public hearing.
Motion Fraser moved to accept the findings of fact as found in FRDO Staff
Report #KA-89-3. Robbins seconded the motion and it passed
unanimously in roll call vote.
Motion Hall moved to recommend zoning the area P-1 (Public). The motion was
seconded by Sloan and passed unanimously in a roll call vote.
Hash asked those in the audience to indicate which areas they are
here to comment on. Two people in the back row said they were
interested in the area along Three Mile Drive and south of the Junior
High School. Another gentleman indicated that he was interested in
the Grandview Addition.
NORTHWEST TRACTS Hash directed the Board to agenda item 14 concerning zoning of an
area known as Northwest Tracts Addition located in the S2 of Section
1, Township 28 North, Range 22 West, M.P.M., Flathead County,
Montana.
Greer gave a brief summary showing the location of the area on the
city map and summarizing the findings of fact of the staff. He stated
that there are two different zones being recommended. The property
along Meridian Road that is owned by the Telephone Company is
recommended to be zoned I-1 (Light Industrial) and the remainder of
the area is recommended to be zoned R-3 (Residential). Greer gave a
description of the R-3 zoning and what it allows.
A lady in the audience stated that she had two acres in that area and
wanted to know if they would break down her land and tax her for a
bunch of lots. Greer stated that the two acres will be viewed as one
tract of land for taxing purposes.
Public Hearing Hash opened the public hearing calling for comment from proponents of
the zoning. There being none, she called for comment from opponents.
There being no comments from the public she closed the public
hearing.
Motion Hall moved to accept the findings of fact by the staff in report #KA-
89-13 and recommended that the area of the property owned by the
Telephone Company be zoned I-1 and the remainder of the area be zoned
R-3. Sloan seconded and the motion passed unanimously in a roll call
vote.
GRANDVIEW Hash directed the Board to agenda item #8 to consider the zoning
ADDITION proposed for the area known as Grandview Addition, located in
Government Lot 1 of Section 1, Township 28 North, Range 22 West,
M.P.M., Flathead County, Montana.
Greer gave a brief review showing its location on the city map. It is
one lot and its access is a 20 foot easement through existing lots

off of Harrison Boulevard. The staff recommended that the area be
zoned R-3 as the surrounding area is also zoned that.
Public Hearing Hash opened the public hearing calling for proponents to comment.
There being no proponents, she called for opponents to comment.
Elmer Absalonson, owner of the lot, objected to the property being
zoned R-3 because he did not feel that the best use of the land would
be for a single family residence. Currently, it is a contractor's
storage yard. Mr. Absalonson stated that the property is surrounded
by multi -family and with the Community College locating across the
road they have been contemplating student housing for that property.
There has also been thoughts of mini warehouses in that location
since there are a number of townhouses and apartments in the
vicinity. In light of that he felt that he would rather have the
property zoned I-1 or RA-1.
There being no other comments from opponents, Hash closed the public
hearing.
Board Discussion Hall stated that the current use of the lot would be grandfathered
into whatever the property is zoned.
Hall felt that he could go along with RA-1 before he could go along
with I-1. Carothers agreed.
j Absalonson asked Greer what the city standards are for a road into
- that property if he were to develop it for student housing. Greer
stated that according to the subdivision regulations the requirement
is for a 60 foot right of way; but, if he did not have to go through
a subdivision review, Greer was not sure what the city standards
were. Fraser felt that access was very poor and would not meet the
city standards.
Sloan suggested that if the property was zoned R-3 now, Mr.
Absalonson could come back in the future when he has determined what
he wants to do with the lot and request a zone change. If the zone
change were to be for RA-1 he could maybe get some of the neighboring
properties that have apartments and townhouses on them to be included
in that RA-1 zoning. Carothers agreed.
Motion Sloan moved to accept the findings of fact of FRDO Staff Report #KA-
89-7 and recommended that the area be zoned R-3. Fraser seconded the
motion and it passed by a majority in a roll call vote. Hall opposed
the motion.
Hash stated that since the three members of the audience have
departed perhaps Greer could give a summary of the proposed zoning
for all of the remaining additions and then they would conduct one
public hearing for the remainder.
DRY BRIDGE ADD. Greer stated that the recommended zoning is Residential R-2 for this
addition located in the NW4 SE4 of Section 17, Township 28 North,
Range 21 West, M.P.M., Flathead County, Montana.

EIGHTEENTH ST. Greer stated that B-2 (General Business) is recommended for the
property south of Eighteenth Street East. The proposal is for
territory located in the NE4 NW4 of Section 20, Township 28 North,
Range 21 West, M.P.M., Flathead County, Montana.
EIGHTH STREET
Greer said the staff recommendation is for RA-1 (Residential
Apartment) for this territory located in the SE4 of Section 18,
Township 28 North, Range 21 West, P.M.M., Flathead County, Montana.
HERITAGE ADD.
The staff recommendation for this territory is RA-1 (Residential
Apartment) which is located in Government Lot 6, Section 6, Township
28 North, Range 22 West, M.P.M., Flathead County, Montana.
INDIAN ADDITION
This territory is recommended by the FRDO staff to be zoned R-3
(Residential) and is located in Government Lot 1, Section 1, Township
28 North, Range 22 West, M.P.M., Flathead County, Montana.
MERIDIAN TRACTS
Greer showed this territory (located in Government Lot 1 of Section
7, Township 28 North, Range 21 West, M.P.M., Flathead County,
Montana) and stated that the proposed zoning is.R-3 (Residential).
MILLER ADDITION
Greer stated that the proposed zoning is for R-3 (Residential) for
this territory located in Government Lot 1 of Section 1, Township 28
North, Range 22 West, M.P.M., Flathead County, Montana.
NORTH MERIDIAN
This territory located in Government Lot 7 of Section 6, Township 28
North, Range 21 West, M.P.M., Flathead County, Montana is recommended
to be zoned RA-1 (Residential Apartment).
SALISH COURT
Greer stated that this territory located in the W2 SE4 of Section 1,
Township 28 North, Range 22 West, M.P.M., Flathead County, Montana is
recommended to be zoned R-3 (Residential).
SLIVERS ADDITION
This territory is located in a portion of the LeDuc Addition and is
recommended to be zoned Residential R-2.
SUNNYVIEW ADD. Residential Apartment RA-1 zoning is proposed for this territory
located in Government Lots 6 and 7 of Section 6, Township 28 North,
Range 21 West, M.P.M., Flathead County, Montana.
THIRD AVENUE Greer stated that the staff is recommending Residential Apartment RA-
1 zoning for this territory located in the SW4 of Section 17,
Township 28 North, Range 21 West, M.P.M., Flathead County, Montana.
TWO MILE ADDITION The staff recommends a zoning classification of Residential Apartment
RA-1 for this territory located in the SE4 NE4 of Section 17,
Township 28 North, Range 21 West, M.P.M., Flathead County, Montana.
WYOMING ADDITION There are two zones recommended for this territory that is located in
Government Lots 1 and 2 of Section 7, Township 28 North, Range 21
West, M.P.M., Flathead County, Montana. Greer stated that two lots
fronting on Meridian Road are recommended to be zoned B-1

(Neighborhood Business) and the remainder of the area is recommended
to be zoned Residential R-4.
Public Hearing Hash opened the public hearing on the recommended zoning for all of
the above listed additions to the city. She called for proponents to
comment. There being none, she called for comment from opponents.
With no public comment, she closed the public hearing.
Motion Following a brief board discussion, Hall moved to accept the findings
of fact as found in FRDO Report #KA-89-4, KA-89-5, KA-89-6, KA-89-8,
KA-89-9, KA-89-10, KA-89-11, KA-89-12, KA-89-14, KA-89-15, KA-89-16,
KA-89-17, KA-89-18, KA-89-19 and recommended the zoning
classifications for each of the additions as recommended by the
Flathead Regional Development Office in their staff reports. Fraser
seconded the motion and it passed unanimously in a roll call vote.
OLD BUSINESS Sloan asked about the status of Evergreen zoning. Greer stated that
the Commissioners have asked Earl Bennett to include enough money in
next years legal notice budget for advertising that zoning again.
Sloan asked if the Commissioners could have left out the area of
concern along Whitefish Stage Road. Greer said they could have. Sloan
then expressed concern over the ground lost by waiting another year
for the zoning to be completed in that area. Greer commented that the
office is getting a lot of requests concerning various building
proposals in the Evergreen area that might not have been appropriate
uses under the proposed zoning.
NEW BUSINESS Greer commented that Clete Daily, who is conducting the study of
Highway access points on Highway 93 North, would be attending the
next several Planning Board meetings in order to keep the Board
apprised of what is taking place and the progress of the study. Greer
added that the Board will be required to hold the public hearing on
whatever is proposed and make a recommendation to the TAC.
ADJOURNMENT Sloan moved to adjourn and it was seconded by Stephens. The meeting
was adjourned at 7:55 p.m.
