Following discussion, Council provided direction to provide a draft ordinance for Council consideration to address transactions in the right-of-way. Attached is a draft ordinance that is based off the ordinance from Springville, Utah. I am also attaching current Municipal Code Chapter 24 Article 7- which is our Encroachment Code that identifies that the public right-of- way should not be used for private or commercial gain. The proposed ordinance will enhance enforcement capacity of this existing Encroachment Code. I am also attaching current Kalispell Municipal Code 19-19 Certain Acts of Panhandling Prohibited, an ordinance out of Pasco County, Florida, 82-1 Dangerous Use of Public Right of Way, and an ordinance out of Springville, Utah, 23-2022 Unlawful Transfer on a Roadway. RECOMMENDATION: It is recommended that the City Council review and discuss the ordinances and direct staff accordingly. WHEREAS, the City of Kalispell has an interest in assuring the free, orderly, and undisrupted movement of motor vehicles on public roadways within City limits; and WHEREAS, the City finds it is necessary to protect and provide safety for people on certain roadways by limiting transfers between motor vehicle occupants and pedestrians in the roadways; and WHEREAS, it is in the best interests of the City, its residents, and its visitors to ensure that motor vehicle traffic is uninhibited by transfers in the roadway; and WHEREAS, in the interest of the health, safety, and welfare of its citizens, the City of Kalispell deems it appropriate and necessary to prohibit unlawful transfers on certain roadways within Kalispell city limits. NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF KALISPELL, AS FOLLOWS: SECTION 1. A new Section is hereby added to Chapter 19 of the Kalispell City Code as set forth in Exhibit A attached hereto. SECTION 2. If any section, subsection, sentence, clause, phrase, or word in this section is for any reason held to be invalid or unconstitutional, such decision shall not affect the validity of the remaining portions of this section. SECTION 3. This Ordinance shall take effect thirty (30) days after its final adoption by the City Council of the City of Kalispell, Montana. PURPOSE: It is the intent of this section to: 1. enhance the safety of pedestrians and motor vehicle occupants on public roadways and public parking lots within Kalispell city limits; and 2. assure the free, orderly, and undisrupted movement of motor vehicles on public roadways within Kalispell city limits; and 3. ensure that transfers between pedestrians and motor vehicle occupants within Kalispell city limits are undertaken in an orderly manner and do not create motorist distraction, frustration, annoyance, or hostility. This section is intended to apply evenhandedly to all persons who engage in the activities proscribed regardless of their intent or any message they may be attempting to communicate incidental to the proscribed activity. B. DEFINITIONS: For purposes of this section, the following definitions shall apply: ROADWAY: The paved portion of all public rights -of -way within Kalispell city limits excluding sidewalks and medians. LEGALLY PARKED: A vehicle that is standing, stopped, or otherwise appropriately parked in an area designed or legally authorized for parking. C. PROHIBITED CONDUCT: It is unlawful for a person: 1. while a pedestrian, to accept, take, or otherwise obtain possession or control of any money or personal property from a person within a motor vehicle while that motor vehicle is within a roadway or on publicly owned property used as an entrance or exit to a roadway; or 2. while a pedestrian, to give, hand over, or relinquish possession or control of any money or personal property to a person within a motor vehicle while that motor vehicle is within a roadway or on publicly owned property used as an entrance or exit to a roadway; or 3. while a driver or passenger in a motor vehicle in a roadway, or on publicly owned property used as an entrance or exit to a roadway, to give, hand over, or relinquish possession or control of any money or personal property to a pedestrian; or 4. while a driver or passenger in a motor vehicle in a roadway, or on publicly owned property used as an entrance or exit to a roadway, to accept, take or otherwise obtain possession or control of any money or personal property from a pedestrian. 5. Notwithstanding anything to the contrary in this section, the activities proscribed by this section shall not be unlawful if: a. such actions are required as the result of a traffic accident, medical emergency, or similar exigent circumstances; or b. such actions are directed by a peace officer or authorized traffic control officer in the course of their official duties; or C. the transaction is undertaken after the motor vehicle has been legally parked. D. PENALTY: Any person convicted of the violation of any provisions of this section shall be punished as provided in Section 1-9 of this Code. Kalispell, Montana City Code Chapter 24 STREETS AND SIDEWALKS Article 7 ENCROACHMENT CODE 24-61 Short Title. 24-62 Purpose. 24-63 Definitions. 24-64 Regulations Generally. 24-65 Projection and Clearance. 24-66 Enforcement of Article; Penalties. 24-61 Short Title. This article shall be known as the CITY OF KALISPELL UNIFORM RIGHT-OF-WAY ENCROACHMENT CODE. (Ord. 779 § 1) 24-62 Purpose. A. The purpose of this article is to provide standards for the regulation and control of encroachments and private use of public rights -of -way within the incorporated limits of this City. This article will ensure full compliance by this incorporated City with all applicable Federal, State and local laws, in the interest of public safety and the free and safe flow of traffic. B. It is also the purpose and intent of this article to provide minimum standards to safeguard life, health, property and public welfare by regulating and controlling the placement of all signs and sign structures within the incorporated limits so as to prevent the obstruction of view of any official traffic sign, signal or device. (Ord. 779 §§ 2, 6) 24-63 Definitions. For the purpose of this article, the following words and phrases shall have the meanings respectfully ascribed to them by this section: CURB LINE: The line at the face of the curb nearest to the street or roadway. In the absence of a curb, the curb shall be established by the City officials. ENCROACHMENTS: All private devices placed upon the public right-of-way, including devices which overhang or underlie the right-of-way. (Ord. 779, 3) 24-64 Regulations Generally. No private signs, eaves, marquees, transmission lines, within or without a conduit or pipe, or similar devices will be allowed to encroach on the public rights -of -way of this City within the incorporated limits, except as provided herein and then only by permit issued by the City of Kalispell Public Works Department. No gainful private or commercial use of the public right-of-way will be allowed except by permit issued by the City of Kalispell Public Works Department and as allowed by the Kalispell Municipal Code. (Ord. 779 § 4; amd. Ord. 1823, 3-4-2019) 24-65 Projection and Clearance. The outermost portion of an overhanging device should be at least two feet (2') behind the face of the curb, or where there is no curb, from the established curb line, and the lowest portion of an overhanging device should be at least seven and one-half feet (7 1/2') above the top of the curb, sidewalk or roadway shoulder elevator. (Ord. 779 § 5) 24-66 Enforcement of Article; Penalties. Authorized City and County officials are hereby directed to enforce all of the provisions of this article as provided herein and in accordance with the provisions of Montana Code Annotated Sections 7-14-2134 through 7-14-2138. Any person violating the provisions of this article shall be, in addition to the penalties provided by the aforementioned State law, punishable by a fine not to exceed three hundred dollars ($300.00). Kalispell, Montana City Code Chapter 19 OFFENSES; MISCELLANEOUS 19-19 Certain Acts of Panhandling Prohibited. A. Definitions: Panhandling. PANHANDLING, for the purpose of this section, is any solicitation made in person requesting an immediate donation of money or other thing of value. Purchase of an item for an amount far exceeding its value, under circumstances where a reasonable person would understand that the purchase is in substance a donation, is a donation for the purpose of this section. So long as the solicitor is not within twenty (20) feet of an intersection, panhandling does not include passively standing or sitting with a sign or other indication that one is seeking donations, without addressing any solicitation to any specific person other than in response to an inquiry by that person. B. Time of Panhandling: Any person who panhandles after sunset or before sunrise is guilty of a misdemeanor. C. Place of Panhandling: Any person who panhandles when the person solicited is in any of the following places is guilty of a misdemeanor: 1. Within twenty (20) feet of any bus stop; 2. In any public transportation vehicle; 3. Within twenty (20) feet of any street intersection or highway intersection; 4. On private property, unless the solicitor has, in his or her possession, permission from the owner or occupant. D. Manner of Panhandling: Any person who panhandles in any of the following manners is guilty of a misdemeanor: 1. By coming within three (3) feet of the person solicited, until that person has indicated that he or she does wish to make a donation; 2. By blocking the path of the person solicited along a sidewalk or street; 3. By following a person who walks away from the panhandler; 4. By using profane or abusive language, either during the solicitation or following a refusal; 5. By panhandling in a group of two (2) or more persons; or 6. By any statement, gesture, or other communication which a reasonable person in the situation of the person solicited would perceive to be a threat. E. Penalty: Any person convicted of the violation of any of the provisions of this section shall be punished as provided in Section of this Code. Sec. 82-1. - Dangerous use of public rights -of -way. (a) Definitions. The following words, terms and phrases, when used in this section, shall have the meanings ascribed to them in this subsection, except where the context clearly indicates a different meaning: (1) Designated roadways means the interstate system (including interstate entrance and exit ramps), and arterial and collector roadways or rights -of -way. For purposes of this definition, collector and arterial roadways or rights -of -way shall be those roadways classified as collector, arterial, or Interstate/Toll roadways on the Highway Vision Plan & Functional Classification Map, or classified as a collector, arterial, or Interstate/Toll roadway pursuant to the functional classification or reclassification procedures and criteria established pursuant to the Pasco County comprehensive plan. This definition also encompasses those portions of these designated roadways located within a municipality. It also encompasses the first 440 feet of local roadways intersecting with these designated roadways. The portions of these designated roadways subject to this section include the portions within the area open for vehicular traffic (including medians), plus four feet outside of the shoulders and/or curbs. (2) Legally parked means a vehicle that is standing, stopped, or parked in an area designated, or legally authorized, for parking. (3) The traveled portion of a designated roadway means any portion of a designated roadway (including travel lanes, turn lanes, and shoulders) that is normally used by moving motor vehicle traffic that is not a lawful parking area. (4) Median means any area separating traffic lanes on a roadway. A median includes, but is not limited to, any paved or unpaved, landscaped or nonlandscaped, portions of a roadway which exist between opposing lanes of traffic. For the purpose of this section, the phrase "public rights -of -way" shall be defined as set forth in F.S. (2021) § 334.03(21), and as may be amended. (b) Prohibitions. Except as provided herein, or as otherwise permitted by law, it is unlawful to make any use of the public rights -of -way in a manner that interferes with the safe and efficient movement of people and property from place to place on a public road or right-of-way. Such prohibited activity includes, but is not limited to: (1) Occupancy of median. It is unlawful for any person to stop, stand, or otherwise occupy or remain in a median on any designated roadway when that person is not in the process of lawfully crossing the road in accordance with applicable traffic and safety laws. a. Presumption. Stopping, standing, or otherwise occupying a median through two consecutive opportunities to cross in accordance with applicable traffic and safety laws is prima facie evidence of a violation of this subsection. (2) Physical interaction on roadway. It is unlawful for any person to engage in any physical interaction between a pedestrian and an occupant of a motor vehicle, including but not limited to the transfer of any product or material, while the motor vehicle is not legally parked and is located on the traveled portion of a designated roadway. (3) Commercial use of public rights -of -way. It is unlawful to use any public right-of-way for commercial activity. Commercial activity prohibited by this section includes, but is not limited to, vending or sale of goods, display or goods for sale, storage of goods for sale in connection with commercial activity, or repair or manufacturing of goods. Signage is not "commercial activity" regulated by this chapter. (c) Exemptions. Nothing in this section shall prohibit the following: (1) Law Enforcement, fire and rescue, or other government employees or contractors acting within the scope of their lawful authority; (2) A person conducting inspection, construction, maintenance, repair, survey, or other legally authorized services; (3) A person responding to lend aid during an emergency situation; (4) Entering or exiting a bus or other public transit system; (5) Use of public roads and rights -of -way that have been closed to vehicular traffic for a special event permitted by the appropriate governmental entity. (d) Penalties. Any person who is found to be in violation of any provision of this section shall immediately cease the activity in violation and may be issued a citation punishable by a fine not to exceed $500.00, as authorized under F.S. § 125.69(1) and Section 1-11 of this Code. Each action in violation of a provision of this chapter shall constitute a separate offense. Issuance of a citation does not preclude an action for injunction, issuance of a trespass warning where authorized, or any other legal remedy available to Pasco County. (Ord. The last time the planning fee schedule was updated was in 2015. The City tries to keep fees for their services in line with the market of what other municipalities are charging. In general, other comparable municipalities have raised their fees over the last few years. I have attached the fee schedule for the City of Kalispell as well as five other comparable municipalities for comparison. Given the amount of time that has passed since the last fee evaluation, staff feels it is the appropriate time to determine whether the fees should be raised to reflect the current market. We have not included a recommended fee schedule as we want to have the work session to discuss these activities within the Development Services Department prior to that step. RECOMMENDATION: It is recommended that the Council receive the report and direct the staff as needed. FISCAL EFFECTS: There are no anticipated fiscal impacts at this time. ALTERNATIVES: Deny the request. Prior to that, in 2018, we evaluated program costs and looked at ways to reduce direct costs and started marketing our department and programs through social media. We have recently reevaluated our program direct costs and performed a cost analysis of our fees/revenues while looking at the overall benefits to those we serve. Inflationary costs, since 2020, have impacted on our ability to provide programming at the same price point. A few highlights of consideration related to proposed fee adjustments include: • The after -school program is still essential to our community for working parents. This program provides a safe, fun, and educational opportunity to kids who may otherwise be unsupervised after school. However, wages and supplies have continued to increase. • Partner Programs (highlighted in orange on the fee schedule) fees are usually set in collaboration with other organizations and revenues generated are split between the parties. Partner Programs include reduced pricing to the community that we have negotiated and limits our related programing expenditures. • We plan to continue offering free community events (highlighted green on the fee schedule). We receive sponsorships to cover the direct costs of the event and often utilize volunteers, food donations, and paid sponsorships to keep the event free. We continue to work on developing these free community events. • We are not recommending an adjustment to pool entry fees as historically; Council has not wanted the entry fees adjusted. We reviewed what others charge for pool entry fees and found we are at the higher end for a municipal pool except for Splash Montana in Missoula. If we calculated what it would cost per participant to enter the pool as a break- even point, we would need to charge $17.73 per person. This price point would deter participation at the pool. We are, however, proposing increasing fees for swim lessons, swim classes and private party rentals. • Included in the proposed recreation fees, is implementing online registration. This will increase efficiencies within our recreation division and make registrations more convenient for the community. We continue to evaluate our programs and fee schedules making sure that we are offering quality and affordable programs that the community supports while reducing or holding our overall costs to a minimum. We work to broaden our programing opportunities to the community and have something for everyone to participate in at a reasonable cost. RECOMMENDATION: Consider the proposed increases to recreational program costs. Since that time, inflationary costs related to maintenance, fields, pavilions, restrooms, and greenspaces have increased substantially. There were approximately 350 documented facility reservations last year, oftentimes back-to-back with three or four user groups using a facility in one given day. Reservations vary from a private birthday or graduation to a special event such as the Great Bear Brewfest. To help offset these inflationary maintenance costs, we are proposing a 10% fee increase for reservations. Our fee structure was designed to work with an online reservation system, that no longer exists, and to provide more flexibility in accommodating additional reservations per day for our community to use these spaces or structures. This method varies greatly from other municipalities, so it is difficult to make a direct comparison to other nearby municipalities. RECOMMENDATION: Consider increasing the facility reservation costs to appropriately cover the increased maintenance costs and inflation. ATTACHMENTS: Existing and proposed reservation fees. Box 1997 Kalispell, Montana 59903-1997 (406) 758-7715 Fax (406) 758-7719 FROM: Chad Fincher, Director of Parks & Recreation SUBJECT: Proposed Vending Permit and Special Event Permit Fee Adjustments MEETING DATE: March 13, 2023 BACKGROUND: Since the inception of ordinance 1455 in 2003 establishing vending permits, annual permit vending fees have been $50 per year from the date of issuance. Ordinance 1741 passed in July 2014 separated and identified $10 special event vending permits. When comparing the city of Kalispell's vending permit costs to other cities and factoring in staff time to process, document, and follow-up on vending permits, it appears reasonable to consider increasing these fees. Another proposed change is to further define the special event category. Currently events could span multiple days/weeks/months and still fall into the $10 special event category as these events would be considered one event under the current ordinance. RECOMMENDATION: Consider increasing the annual vending permit cost to $100.00, increasing the Special Event permit cost to $25, and updating language to reference the special event fee only covers a three-day consecutive event. These changes would help to offset the staff time it takes to process, follow up with reminders and track both vending permits and events.
