Award Bids for the Water and Sewer Main Replacement Project 2023 This item considers awarding various bids to Sandry Construction, LHC, Inc., and JR Civil, LLC for replacement of original 1920's era Water and Sewer Mains. Ordinance 1898 — Second Reading — Westside Neighborhood ParkinManagement Zone Amendment This ordinance considers a petition to expand the Westside Neighborhood Parking Management Zone to include 5ch Street West between 5`h Avenue West and 6th Avenue West. COMMITTEE REPORTS — City -County Board of Health: Health Officer Jen Rankosky City -County Board of Health Officer Jen Rankosky began her report related to the rates of reportable diseases decreasing considerably since a high in December. 07:03:56 PM (00:04:58) Councilor Hunter asked about the new COVID strain. 07:04:11 PM (00:05:13) Health Officer Rankosky answered Councilor Hunter's question. 07:04:37 PM 00:05:39 Councilor Daoud asked about RSV infection rates. Page 2 of 5 Kalispell City Council Minutes, January 17, 2023 Health Officer Rankosky answered Councilor Daoud's question. 07:06:20 PM (00:07:22) Councilor Hunter asked about mental health concerns and constraints. 07:06:45 PM (00:07:47) Health Officer Rankosky responded to questions. 07:10:49 PM (00:11:51) Health Officer Rankosky explained that the Health Department was recently reaccredited and are currently reviewing their processes. They just finished their community health assessment related to their goals and top priorities. G. PUBLIC COMMENT Mayor Johnson opened general public comment. Seeing none, he closed public comment. Resolution 6115 — C-Pace Program This resolution considers creation of a Commercial Property Assessed Capital Enhancement Act of Montana District within the City of Kalispell. City Manager Russell provided the staff report on this item asking that this item be postponed to the next available meeting so clarification can be sought regarding collection responsibilities. Appoint Municipal Judge and Administer Oath of Office The Selection Committee is recommending Alison Howard to be appointed Municipal Judge until the next general election in November 2023. Judge Alison Howard spoke to her appointment. Mayor Johnson thanked the Judge and all of the supporters who came to the meeting. I. CITY MANAGER COUNCIL AND MAYOR REPORTS No Action City Manager Doug Russell provided the following report: • State Legislative Matter: The City has concerns in opposition to Legislative House Bill 206 which would require 50% of the registered voters to turn out and vote in affirmative for a mill levy request and would cap the mill levy to five years. • In response to what we have been seeing as a day -time encampment in Depot Park we have been having discussions regarding what can be done related to passing ordinances. Mr. Russell spoke further on this matter and asked whether Council would be open to a discussion during the next work session on possible related ordinances. 07:29:31 PM 00:30:33 Mayor Johnson asked about related health issues. City Manager Russell asked whether Council would object to a temporary closure of the gazebo at Depot Park and the closure of any other structure or facility that would need closure in response to concerns therein. 00:32:37 Councilor Fisher asked how the closure would occur. 00:33:03 Councilor Carlson asked questions related to further issues. He thanked the Police for helping with trespassing issues at the Fairgrounds. 07:34:14 PM (00:35:16) Manager Russell said that the C-Pace Resolution will be added to the next regular agenda. 07:34:35 PM (00:35:3.7) Councilor Hunter spoke regarding Federal funds that may be available to review zoning. He then spoke regarding the tax on marijuana sales and requested a work session prior to the budget. 07:36:20 PM (00:37:2D City Manager Russell responded to Councilor Hunter's desire to look at zoning and asked for the Council to wait until the State Legislature is done with the session as the state is looking at a State Growth Policy Plan. 00:38:54 Mayor Johnson spoke regarding House Bill 206 and the negative consequences that would occur if it passed. He would encourage the public to email State Representative Courtney Sprunger in opposition of House Bill 206. J.
