SUBJECT: Resolution 6115 - Stillwater Bend Phase 1 — Preliminary Plat extension
MEETING DATE: January 3, 2023
BACKGROUND: This is a request by Spartan Holdings to extend the preliminary plat for Stillwater
Bend Phase 1 for two years. The preliminary plat for Stillwater Bend Phase 1 was approved
February 3, 2020. Condition 14 of the preliminary plat states that "the preliminary plat shall be valid
for a period of three years from the date of approval," which is in accordance with 28.2.06(E)(7) of
the Kalispell Subdivision Regulations. Accordingly, the expiration date for the plat is February 3,
2023. The subdivision regulations provide for a two-year extension request and the applicant has
provided a letter requesting a plat extension.
The applicant has been under construction and is preparing for final plat for Phase 1 this spring.
Recent supply chain issues and winter weather have created the short delay in the completion date. If
the extension is not granted, the applicant will be required to go back through the Major Preliminary
Plat process prior to final plat approval.
RECOMMENDATION: It is recommended that the City Council approve Resolution 6115, a
resolution extending the Stillwater Bend Phase 1 preliminary plat for an additional two years.
FISCAL EFFECTS: Positive impacts if approved.
ALTERNATIVES: Deny the request.

A RESOLUTION APPROVING A TWO-YEAR EXTENSION TO THE PRELINHNARY
PLAT OF STILLWATER BEND PHASE 1 SUBDIVISION.
WHEREAS, the City Council of the City of Kalispell granted preliminary plat approval for
Stillwater Bend Phase 1 on February 3, 2020; and
WHEREAS, the developers, Spartan Holdings, LLC, have requested a two-year extension to the
preliminary plat of Stillwater Bend Phase 1 due to supply chain issues and winter
weather; and
WHEREAS, good cause exists for the request for extension by Spartan Holdings, LLC and it is in
the best interests of the city that the extension be given.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
KALISPELL, MONTANA AS FOLLOWS:
SECTION 1. That the application of Spartan Holdings, LLC, for a two-year extension of
the preliminary plat of Stillwater Bend Phase 1 Subdivision, Kalispell,
Flathead County, Montana is hereby approved.
