The applicant has applied to the City of Kalispell for a conditional use permit on behalf of the
Flathead Special Education Cooperative to locate the Cooperative in a portion of a building located
at 1110 2nd Street West for the purpose of providing special and related services to students between
the ages of three and fourteen years of age.
The Kalispell City Planning Board and Zoning Commission, after due and proper notice, on
July 14, 2009, held a public hearing on the application, took public comment and recommended that
the application be approved subject to certain conditions.
After reviewing the application, the record, the KPD report, and after duly considering the
matter, the City Council of the City of Kalispell, pursuant to the Kalispell Zoning Ordinance, hereby
adopts Kalispell Planning Department Conditional Use Report #KCU-09-9 as the Council's findings
of fact, and issues and grants to the above -described real property a conditional use permit to operate
a school in the P-1 zoning district subject to the following conditions:
Prior to the Flathead Special Education Cooperative occupying the building the following
conditions shall be met:
All required building and fire safety codes for the area serving the Flathead Special
Education Cooperative shall be completed.

2. Bushes shall be planted along the east side of the existing parking lot which have a
minimum mature height over 5 feet to screen the parking lot and cars from the
adjacent homes. Prior to installing the bushes the location, size and type of bush shall
be reviewed and approved by the Planning Department and Parks and Recreation
Department.
Note: The bushes shall be a minimum 5 gallon in size at the time of planting and
shall be kept in a healthy condition. Dead or dying bushes shall be replaced by the
property owner.
3. Exterior building lights shall be brought into compliance with the city's lighting
standards in the Kalispell Zoning Ordinance.
On -going condition:
4. That commencement of the approved activity must begin within 18 months from the
date of authorization or that a continuous good faith effort is made to bring the
project to completion.
