SUBJECT: FY2023 Budget - Solid Waste Removal Assessment
MEETING DATE: August 15, 2022
BACKGROUND: The Solid Waste Removal Assessment resolution is adopted
annually to provide a levy to fund the costs of the removal of garbage or other offensive matter
from streets, alleys, or any premises. For fiscal year 2023, staff is recommending implementing
an 15% increase, approved by Resolution 6083 on July 18th, 2022.
RECOMMENDATION: It is recommended the City Council approve Resolution 6095, a
resolution to levy the cost of removal of garbage or other offensive matter from streets, alleys or
any other premises as a special tax against the property from which such matter was deposited,
and the disposition thereof.
FISCAL EFFECTS: Anticipated revenue to be generated by the assessment is
$1,270,000.

A RESOLUTION TO LEVY THE COST OF REMOVAL OF GARBAGE OR OTHER
OFFENSIVE MATTER FROM STREETS, ALLEYS OR ON ANY PREMISES AS A
SPECIAL TAX AGAINST PROPERTY FROM WHICH SUCH MATTER WAS
DEPOSITED, AND THE DISPOSITION THEREOF.
WHEREAS, Section 7-14-4105 MCA, gives a City Council power to provide for levying the cost
of removal of garbage or other offensive matter from streets, alleys, or any premises
as a special tax against that property from which the same was deposited, the City
Council deems such a method more equitable and just than paying for such removal
from the General Fund of the City; and
WHEREAS, at a public hearing held on the 5th day of July, 2022, the City Council did consider
all objections made to said estimate and to the basis of levy and assessment for
payment for said cost.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
KALISPELL, MONTANA:
SECTION 1. The assessments for removal of garbage or other offensive matter for the
fiscal year 2022-2023 are hereby estimated to be $1,270,000.00 and the City
Council finds that the cost of the removal of garbage and other offensive
matter from the various lots and parcels of land within the city and benefited
by such removal is the amount as shown by the records maintained in City
Hall.
SECTION 2. That the assessments charged are hereby established as follows:
(a) $128.00 per average single family residential dwelling unit on
one or more contiguous city lots per fiscal year;
(b) Non-residential (commercial) rates for 300 gallon and 400
gallon dumpsters will not include discounts for multiple times
per week collection. Pick-up rates for 300 and 400 gallon
dumpsters are $389.00 and $473.00 perpick-up, respectively.
(c) Charges for these, and all other garbage collection services
shall be in accordance with the schedule maintained in the
office of the Director of Public Works.

RESOLUTION NO.6083
A RESOLUTION TO ADOPT THE FEES, SCHEDULES, RATES, CHARGES AND
CLASSIFICATIONS IMPOSED ON THE CUSTOMERS OF THE CITY OF KALISPELL
SOLID WASTE UTILITY.
WHEREAS, it is necessary and prudent, pursuant to authority granted to municipalities operating
utility services by Section 69-7-101 et seq., MCA, for the City of Kalispell, from
time to time, to study and review the fees, schedules, rates, charges and
classifications it charges to its customers for solid waste utility services; and
WHEREAS, a study of the City of Kalispell Solid Waste Division has determined that the current
structure will not provide the finances to maintain the same level of service for the
upcoming fiscal years or support adding solid waste service accounts within the
City that are adjacent to the established routine service areas; and
WHEREAS, Public Works staff has determined that a short-term four-year step assessment
increase would support a continued level of service for current customers and
accounts for expenditure increases due to inflationary costs; add resources (1 FTE)
to provide service in new areas within city limits; maintain reserve levels that are
financially reasonable and responsible; and maintain equipment replacement
schedules for the short term would be appropriate; and
WHEREAS, on June 6, 2022 the City Council passed Resolution No. 6974 stating its intent to
adopt the recommendations of city staff and set a public hearing for July 5, 2022
on the proposed amendments to the fees, schedules, rates, charges, classifications
and regulations of the solid waste utility service of the City of Kalispell and gave
the necessary Notice thereof as required by Section 69-7-111, MCA; and
WHEREAS, the public hearing was duly held by the Kalispell City Council at a public meeting
thereof in the Kalispell City Hall beginning at 7:00 o'clock P.M. on July 5, 2022,
and all persons appearing at the hearing and expressing a desire to be heard were
heard, and all written comments thereon furnished to the City Clerk at the meeting
prior thereto were also given full consideration by the Council.
WHEREAS, the Kalispell City Council hereby finds the proposed amended fees, schedules,
rates, charges, classifications and regulations of the solid waste utility service to be
reasonable and just; and
WHEREAS, the Kalispell City Council therefore considers it proper and necessary at this time
to amend the fees, schedules, rates, charges, classifications and regulations imposed
for solid waste utility service to its inhabitants and other persons served by the City
of Kalispell Solid Waste Utility.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
KALISPELL:
SECTION 1. That the fees, schedules, rates, charges, classifications and regulations
applicable to the use of the City of Kalispell Solid Waste Utility and other
services performed by the utility as set forth in Exhibit "A", attached hereto
and by this reference made a part hereof, are found to be just and are hereby
established and adopted to be imposed for the solid waste utility service to
the inhabitants of the City of Kalispell as set forth in Exhibit "A".
SECTION 2. This decision is final ten (10) days after filing of this Resolution with the
City Clerk. The City Clerk shall file a copy hereof with the Public Service
Commission of Montana at that time.
