BACKGROUND: The Solid Waste Fund supports services for the collection and transport of solid
waste to the landfill for residential and commercial customers within the City limits. As part of the
preliminary budget process, it was identified the Solid Waste Assessment Fund required a review for
potential assessment adjustments. The Fund's projected revenue using the current assessment criteria did
not provide the finances to maintain the same level of service for the upcoming fiscal years. Additionally,
the current finances do not support adding solid waste service accounts within the City that are adjacent to
the established routine service areas.
On May 16, 2022, staff presented, and City Council participated in work session discussions to review the
status of the Fund's services, service capabilities, equipment replacement schedules, and financials. A
copy of the presentation summary can be found on the City's website at Solid Waste I Kalispell, MT. As
a result of the work session meeting, Council directed staff to proceed with public outreach and setting a
public hearing date to receive comments on the proposed four-year step assessment increase that supports:
1. Continued level of service for current customers and account for expenditure increases due to
inflationary costs
2. Adding resources (1 FTE) to provide service in new areas within city limits
3. Maintaining reserve levels that are financially reasonable and responsible
4. Maintaining equipment replacement reschedules for the short term
5. Performing a comprehensive Business Plan Update in FY 23 to review solid waste service and
policies.
A public hearing was held at the July 5, 2022 Council Meeting, along with public outreach efforts to
educate the public on the proposed four-year step assessment increase. A legal notice of the proposed
solid waste assessment increase was sent to 5,915 customers, the City's website offered educational
information on the subject, and multiple news and social media venues advertised the proposed
amendments. A summary of the comments and City responses are provided as an attachment.
ACTION REQUESTED: Motion and vote to approve Resolution 6083, a resolution to amend
the solid waste assessment rate as provided in the attached resolution.
ALTERNATIVE: As suggested by City Council.

Public Outreach Effort
An extensive effort was undertaken to educate the public on the proposed four-year step
assessment increase. A legal notice of the proposed solid waste assessment increase was sent to
5,915 customers, the City's website offered educational information on the subject, and multiple
news and social media venues advertised the proposed amendments. At the July 5, 2022, Council
Meeting, a public hearing was held to listen to the public regarding Council's intent to act upon
the proposed solid waste assessment increase.
Comments were received via the public hearing, email, and phone correspondence. All of the
comments and responses were logged and are provided as an attachment in a table format.
Overall Comments Received
The City has received twenty (20) comments/inquires on the solid waste services and assessment
increase. Nineteen of the comments were from residential customers, and the remaining
comment was from an undefined customer class.
Comments Summary
The comments received were categorized as For, Against, or Neutral based on the content of the
comment. In general, For represented comments that were not against an assessment increase
(noting one For response does not support increase due to growth), and Against represented
comments that were outright against an increase. Neutral represented interactions regarding
questions on the assessment and how they as a customer would be affected, four residents signed
up for service after receiving the outreach information, etc., but gave no indication if they were
For or Against the proposed rate increase. The pie chart below summarized the responses
received into the three categories.

RESOLUTION NO.6083
A RESOLUTION TO ADOPT THE FEES, SCHEDULES, RATES, CHARGES AND
CLASSIFICATIONS IMPOSED ON THE CUSTOMERS OF THE CITY OF KALISPELL
SOLID WASTE UTILITY.
WHEREAS, it is necessary and prudent, pursuant to authority granted to municipalities operating
utility services by Section 69-7-101 et seq., MCA, for the City of Kalispell, from
time to time, to study and review the fees, schedules, rates, charges and
classifications it charges to its customers for solid waste utility services; and
WHEREAS, a study of the City of Kalispell Solid Waste Division has determined that the current
structure will not provide the finances to maintain the same level of service for the
upcoming fiscal years or support adding solid waste service accounts within the
City that are adjacent to the established routine service areas; and
WHEREAS, Public Works staff has determined that a short-term four-year step assessment
increase would support a continued level of service for current customers and
accounts for expenditure increases due to inflationary costs; add resources (1 FTE)
to provide service in new areas within city limits; maintain reserve levels that are
financially reasonable and responsible; and maintain equipment replacement
schedules for the short term would be appropriate; and
WHEREAS, on June 6, 2022 the City Council passed Resolution No. 6974 stating its intent to
adopt the recommendations of city staff and set a public hearing for July 5, 2022
on the proposed amendments to the fees, schedules, rates, charges, classifications
and regulations of the solid waste utility service of the City of Kalispell and gave
the necessary Notice thereof as required by Section 69-7-111, MCA; and
WHEREAS, the public hearing was duly held by the Kalispell City Council at a public meeting
thereof in the Kalispell City Hall beginning at 7:00 o'clock P.M. on July 5, 2022,
and all persons appearing at the hearing and expressing a desire to be heard were
heard, and all written comments thereon furnished to the City Clerk at the meeting
prior thereto were also given full consideration by the Council.
WHEREAS, the Kalispell City Council hereby finds the proposed amended fees, schedules,
rates, charges, classifications and regulations of the solid waste utility service to be
reasonable and just; and
WHEREAS, the Kalispell City Council therefore considers it proper and necessary at this time
to amend the fees, schedules, rates, charges, classifications and regulations imposed
for solid waste utility service to its inhabitants and other persons served by the City
of Kalispell Solid Waste Utility.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
KALISPELL:
SECTION 1. That the fees, schedules, rates, charges, classifications and regulations
applicable to the use of the City of Kalispell Solid Waste Utility and other
services performed by the utility as set forth in Exhibit "A", attached hereto
and by this reference made a part hereof, are found to be just and are hereby
established and adopted to be imposed for the solid waste utility service to
the inhabitants of the City of Kalispell as set forth in Exhibit "A".
SECTION 2. This decision is final ten (10) days after filing of this Resolution with the
City Clerk. The City Clerk shall file a copy hereof with the Public Service
Commission of Montana at that time.
PASSED AND APPROVED BY THE CITY COUNCIL AND SIGNED BY THE MAYOR OF
THE CITY OF KALISPELL, THIS 18TH DAY OF JULY, 2022.
