A RESOLUTION ADOPTING AN AMENDMENT TO THE KALISPELL GROWTH
POLICY -- PLAN IT 2035 ON A 6.78 ACRE TRACT OF LAND MORE SPECIFICALLY
DESCRIBED AS PARCEL A OF COS 6557 AND TRACTS A AND B OF COS 17674 IN THE
WEST ONE-HALF OF SECTION 19, TOWNSHIP 29 NORTH, RANGE 21 WEST, P.M.M.,
FLATHEAD COUNTY, MONTANA FROM "SUBURBAN RESIDENTIAL" TO "URBAN
MIXED USE
WHEREAS, pursuant to MCA 76-1-601 the Kalispell Growth Policy — Plan It 2035 was adopted
by the Kalispell City Council on July 3, 2017; and
WHEREAS, Spartan Holdings, LLC is requesting a growth policy amendment on approximately
6.78 acres located generally along Highway 93 at 3201 Highway 93 North, south of
Ponderosa Residential Subdivision and further described as Parcel A of COS 6557
and Tracts A and B of COS 17674 in the West one-half of Section 19, Township 29
North, Range 21 West., P.M.M., Flathead County, Montana; and
WHEREAS, on May 10, 2022, the Kalispell City Planning Board held a duly noticed public
hearing on the request in which it received no public comment and reviewed
Kalispell Planning Department report #KGPA-22-01 that evaluated the proposal
based upon the goals and objectives of the Growth Policy and current circumstances
in the planning jurisdiction; and
WHEREAS, at the conclusion of the public hearing and after consideration of the proposed
amendment, the Kalispell City Planning Board adopted report #KGPA-22-01 as
findings of fact and recommended approval of the proposed Growth Policy
amendment; and
WHEREAS, on June 6, 2022 the Kalispell City Council responded to the Planning Board
recommendation by passing Resolution 6077, a Resolution of Intention to Adopt,
Revise or Reject a Proposed Amendment to the Kalispell Growth Policy — Plan It
2035 and called for a public hearing to be held on July 5, 2022; and
WHEREAS, on July 5, 2022 the Kalispell City Council, after due and proper notice, held a public
hearing on the Kalispell City Planning Department request and received no further
written or oral public comment regarding the application of the Kalispell Planning
Department report #KGPA-22-01; and
WHEREAS, upon consideration of the recommendation of the Kalispell Planning Board and all
other evidence in the public record, the Kalispell City Council finds that it is in the
best interest of the City to amend the Kalispell Growth Policy — Plan It 2035 by
adopting, as its findings, Kalispell Planning Department report #KGPA-22-01, and to
amend the designation of the property described as Parcel A of COS 6557 and Tracts
A and B of COS 17674 in the West one-half of Section 19, Township 29 North,
Range 21 West., P.M.M., Flathead County, Montana as requested in the Growth
Policy.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
KALISPELL, AS FOLLOWS:
SECTION 1. That pursuant to Section 76-1-604, MCA, the Kalispell City Council hereby
adopts as an amendment to the Kalispell Growth Policy — Plan It 2035, the
designation of the property described as Parcel A of COS 6557 and Tracts A
and B of COS 17674 in the West one-half of Section 19, Township 29 North,
Range 21 West., P.M.M., Flathead County, Montana in the Growth Policy
from "Suburban Residential" to "Urban Mixed Use" as fully described in
Kalispell Planning Department report 4KGPA-22-01 attached hereto and
incorporated fully herein by this reference.
SECTION 2. This Resolution shall become effective immediately upon its passage by the
City Council.
PASSED AND APPROVED BY THE CITY COUNCIL AND SIGNED BY THE MAYOR OF
THE CITY OF KALISPELL, THIS 5TH DAY OF JULY, 2022.
