07-13-05City/County Joint Airport Affected Area Committee City of Kalispell - Flathead County Montana MINUTES Present: Fred Leistiko, Mgr. Planning Office None The July 13, 2005, meeting of the City/County AAA Committee was called to order at 1:15 P.M. in the Kalispell City Hall Conference Room by Chairman Fred Leistiko. The meeting was noticed on the Bulletin Board at City Hall. Mr. Leistiko welcomed the committee members and briefly outlined the minutes of the last meeting on June l & The minutes of the June I & meeting were approved. Hear from the Public: No comments. Tom Jentz moved and Tom Sands seconded the appointment of William C. (Bill) Paullin as the committee approved member -at -large. Chairman Leistiko opened the discussion on the recommended contents of the proposed Airport Affected Area Regulations. After a lengthy discussion on content, it was recommended by all members that we use the format set out in the example submitted to the Committee by Robert Peccia & Associates of Helena, Montana. The basic document and attached reference maps would be studied by the Committee members over the next few weeks and any recommendations brought back to the Committee at its next meeting in August. Chairman Leistiko reviewed how the sample document was developed and also stated that he had contacted Peccia & Associates two days ago to ascertain whether they had made any recommended changes to the document since the passage of SB 255. RPA stated that the document was based on SB 255 when it was written and that it is the document they are distributing to all their aviation clients to be used as a base document in the formulation of their new Airport Affected Area regulations. The document incorporates all the provisions of Federal Air Regulation 14 CFR Part 77 and the new MCA 67 - 1 thru 11. A discussion ensued regarding the necessary exhibits (maps) required with the new regulation. The necessary maps were selected from those presented that the committee believes represents the Zones needed to explain the airport area of influence. A discussion followed, regarding height restriction on Lone Pine Mountain since the terrain penetrates into the proposed area of influence. It was agreed that as long as the current zoning regulations regarding height restrictions are followed there will not be a problem. However, if an entity desires to construct a tower or any other structure that exceeds current zoning, the variance must come from the Board of Adjustment after referring the matter to the Airport Manager for compliance with the height above ground restriction in the Airport Affected Area regulations. A discussion followed, regarding the administrative approval of any variances. It was agreed that the variance would come from the Board of Adjustment having jurisdiction over the airport, which is the City of Kalispell. The committee will study the proposed regulation, the new State law, and the FAR's and come up with any recommendations at the next meeting scheduled for 1:00 P.M. on August 17"' at the same location. Any member who is not able to attend the 8/17 meeting will send their recommendations to the Chairman for discussion at that meeting. Future scheduling was discussed. After adoption of a recommended regulation, the committee will request a work session with the County Commissioners, and another with the Kalispell City Council. After presentations to both, the Committee will hold a public hearing to take public comment. Following public comment, final draft regulations will be given to the City and County for approvals.
