ORDINANCE NO. 1157
AN ORDINANCE AUTHORIZING THE KALISPELL POLICE DEPARTMENT TO
REMOVE VEHICLES PARKED IN VIOLATION OF SECTION 17-90, KALISPELL
CITY CODE, ESTABLISHING A PENALTY FOR OVERTIME PARKING; REPEALING
SECTION 17-93 AND SECTION 17-95, AND DECLARING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY.COUNCIL OF THE CITY OF KALISPELL AS
FOLLOWS:
SECTION I. Aj Any motor vehicle parked or left in
violation of Section 17-90, Kalispell City Code, or in
violation of the posted duration of parking on the
public streets or avenues, or in metered or unmetered
lots leased or owned by the City, within the City of
Kalispell may be moved by or under the authority of any
police officer who shall certify the cost thereof to
the City Judge. Such cost shall be added to any fine
assessed for the violation involved; the owner or
operator of such vehicle shall pay all costs of the
moving and storage of said vehicle.
Bj Such motor vehicle may be moved to any parking
lot provided by the police or to any local garage for
outdoor storage.
SECTION II. If any motor vehicle is found to have been
stopped, standing or parking in violation of Section
17-90 or in violation of the posted duration of parking
on the streets or avenues or upon any metered or
unmetered lot leased or owned by the City within the
City of Kalispell, the registered owner thereof shall
be prima facie responsible for such violation and
subject to the penalty therefor; provided, however that
unless such registered owner shall be proven to have
personally, willfully committed such violation by
corroborating independent evidence, the penalty
therefore shall be limited to a fine of less than five
hundred dollars ($500.00) only.
SECTION III. That Section 17-93 and Section 17-95,
Kalispell City Code are hereby repealed. All other
portions of the Kalispell City Code not amended or
repealed hereby remain unchanged.
SECTION IV. This Ordinance shall take effect thirty
days from and after final passage by the City Council
and approval by the Mayor.
