Res. 6063, Calling for Public Hearing Design and ConstructionCITY OF KALISPELL MEMORANDUM To: Doug Russell — City Manager From: Keith Haskins, PE — City Engineer Re: Resolution of Intent and Call for Public Hearing for Amendments to the Kalispell Design and Construction Standards Meeting Date: April 4, 2022 BACKGROUND: The City periodically updates the Standards for Design and Construction (Standards) to ensure conformance with current requirements of State and Federal agencies, to adopt changes in various materials and methods used in construction, to aid in operation and maintenance of public infrastructure, and to ensure the standards reflect the best practices necessary to support a sustainable community. The Standards were last updated on January 21, 2020. Since that time, the City has adopted the Move 2040 — Kalispell Transportation Plan which included updates to road classifications, typical sections, and policy recommendations. Additionally, the Montana Contractors Association recently published the Seventh Edition of the Montana Public Works Standard Specifications which are used as a baseline for municipal construction specifications. Due to these significant updates along with other staff recommendations, edits, and corrections, an update to the Standards is now necessary. The following proposed significant amendments have been incorporated into a draft of the Standards: • Section 1.6.2 Record Files — this section was added to mitigate issues staff is having in getting record drawings. • Section 3.1.4 Review Fees — this section was modified to increase the review fee from $180 per review to a fee structure which will pay for the cost of staff time and Public Works costs for review software which will soon be incorporated into City review processes. • Section 3.1.5 Construction Drawings — this section was added to require full final sets of plans in PDF and DWG format to assist staff for work completed on new construction and also to help coordinate between developments and engineers in growth areas. • Chapter 7 — Pretreatment was removed from Sanitary Sewer and reestablished in its own chapter. These requirements are overseen by the Pretreatment Coordinator and were often overlooked by contractors. This change is intended to make the pretreatment requirements clearer. • Table 7 — Traffic Impact Study Categories and Requirements were added as recommended by the Transportation Plan. • Table 9 — Access Spacing Guidelines were added as recommended by the Transportation Plan. 201 1' Avenue E IPhone (406)758-7720 PO Box 1997 Public Works Department Fax (406)758-7831 Kalispell, MT 59903 1 www.kalispell.com RECOMMENDATION: Council should adopt Resolution 6063, a resolution of intent to amend the city of Kalispell's Standards for Design and Construction, calling for a public hearing and directing the City Clerk to provide notice therefore. WHEREAS, the City of Kalispell currently has written Standards for Design and Construction in place for the purpose of maintaining compliance with state and federal laws as well as to maintain best practices and consistency for public construction projects; and WHEREAS, the City of Kalispell Standards for Design and Construction must be amended from time to time to reflect changes in state law as well as to reflect changes in policy as directed by the Kalispell City Council. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF KALISPELL AS FOLLOWS: SECTION 1. A public hearing is hereby called and shall be held on Monday, May 2, 2022 at 7:00 p.m. in the council chambers at City Hall, 201 First Avenue East, on the proposed amendments to the City of Kalispell Standards for Design and Construction. SECTION 2. Notice of the public hearing shall be published in the Daily Inter Lake on April 10, 2022, April 17, 2022, and April 24, 2022. SECTION 3. The City Clerk shall immediately make the proposed standards available on the City's internet web site as well as keep a printed copy in the City Offices to be made available to the public for inspection and reproduction. The amendments are being presented to the Kalispell City Council for their consideration. The City Council, on April 4, 2022, passed a Resolution of Intention to Amend the City of Kalispell Standards for Design and Construction. Any person wishing to address the proposed ordinance may appear at this hearing and make oral statements or present their comments in writing. Written comments may also be submitted for Council consideration by delivering the comments to the City Clerk prior to the hearing, or email to publiccomment ckkalispell.com.
