Ordinance 1140 - Expand Downtown Redevelopment AreaORDINANCE NO. 1140 AN ORDINANCE AMENDING THE DOWNTOWN REDEVELOPMENT PLAN FOR THE CITY OF KALISPELL BY EXPANDING THE JURISDICTIONAL AREA OF THE URBAN RENEWAL PLAN AND MAKING CHANGES IN THE TEXT OF THE URBAN RENEWAL PLAN TO ADDRESS ADDITIONAL PROJECTS IN THE KALISPELL DOWNTOWN REDEVELOPMENT PLAN. WHEREAS, the City Council of the City of Kalispell on the 10th day of September, 1979, adopted Ordinance #933, entitled AN ORDINANCE APPROVING THE KALISPELL DOWNTOWN REDEVELOPMENT PLAN FOR THE CITY OF KALISPELL, MONTANA, AS AN URBAN RENEWAL PLAN AND THE FEASIBILITY OF — RELOCATION; AUTHORIZING THE MAYOR TO IMPLEMENT THE PLAN WITH POWERS CONTAINED IN THE URBAN RENEWAL LAW, and WHEREAS, the Urban Renewal Law, Title 7, Chapter 15, Part 48, Montana Code Annotated, allows revision of the Urban Renewal Plan by ordinance after City -County Planning Board review of the amendment, and WHEREAS, the Kalispell Development Corporation and the Tax Increment Committee have recommended that the boundary of the Downtown Redevelop- ment Plan be expanded to include certain property in the vicinity of Flathead High School, and WHEREAS, the Kalispell City Council passed on the 7th day of August, 1989, Resolution No. 3891, entitled A RESOLUTION OF INTENTION TO REVISE THE DOWNTOWN REDEVELOPMENT PLAN BY EXPANDING THE JURISDICTIONAL AREA OF THE URBAN RENEWAL PLAN FOR THE DOWNTOWN REDEVELOPMENT PROJECT, and WHEREAS, said Resolution was referred to the Kalispell City -County Planning Board for review in accordance with §7-15-4217, Montana Code Annotated, and WHEREAS, the Kalispell City -County Planning Board held a public hearing on Resolution #3891 on the 12th day of September, 1989, and WHEREAS, the Kalispell City -County Planning Board reviewed the proposed expansion to determine: 1) the effect, if any, of the proposed expansion on persons displaced by the expansion, 2) its conformity with the Kalispell City -County Master Plan, 3) whether the proposed expansion will afford a maximum opportunity, consistent with the needs of the community, as a whole, to rehabilitate and redevelop the urban renewal area by private enterprise, and 4) whether a sound and adequate financing program exists for the expansion; and WHEREAS, after consideration of the testimony at the public hearing and the staff report the Kalispell City -County Planning Board passed a motion: To recommend approval for the expansion of the Redevelopment District and the proposed plan amendments as set forth in the staff report, titled "Expansion of the Redevelopment Area and Implementing Projects", and WHEREAS, the City Council of the City of Kalispell held a public hearing on the proposal to expand the jurisdictional area of the urban renewal plan on the 16th day of October, 1989, and WHEREAS, 75% of the housing stock in the area -of the proposed expansion is in need. of minor to major rehabilitation, and x Y ,., A.v, 39 WHEREAS, Flathead High School as well as the residents in the surrounding area have expressed concerns over the nearly 400 vehicles per day parked on the City streets in the area by faculty, students and staff at Flathead High School, and WHEREAS, several intersections in the area of Flathead High School have the highest rate of accidents in the greater Kalispell study area, and WHEREAS, the Public Works Department has documented that water and sewer mains in the area of the proposed expansion are at least 50 years old, and WHEREAS, the Public Works Department has documented a need for storm drainage and street improvements in the area of the proposed expansion, and WHEREAS, the expansion of the jurisdictional area of the Downtown Redevelopment Plan will not result in the displacement of any persons, and WHEREAS, the City -County Master Plan identifies numerous goals the proposed expansion is consistent with: rehabilitate housing (Goal 4a); strengthen the economy (endorsement by the Kalispell Chamber, Goal 5d); improvement of off-street parking and pedestrian needs (Goal 5g) ; eliminate land -use conflicts (Goal 61) ; maintain the character of the single family neighborhood (Goal 6g); improve transportation through the use of identified collectors (Goal 7c); create off-street parking (Goal 7g); identify and preserve historic resources (Goals 9a & 9b), and WHEREAS, the Downtown Redevelopment Plan has been incorporated into the Master Plan and the expansion of the residential area of the Downtown Redevelopment Plan and implementing projects shall be consis- tent with achievement of Master Plan goals, and WHEREAS, the expansion of the Downtown Redevelopment District may lead to the elimination of parking and infrastructure problems which will give residents incentive to improve and rehabilitate houses, and WHEREAS, expanding the jurisdictional area of the Downtown Redevelopment Plan will result in the area being included in the tax increment district of the City of Kalispell and funds collected by the City under the tax increment law may be used for public works projects in the area, and WHEREAS, the expanding jurisdictional area of the Downtown Redevelopment Plan will not result in a change in the amount of taxes paid by any resident in the district. NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF KALISPELL AS FOLLOWS: SECTION I. That the text of the Kalispell Downtown Redevelop- ment Plan Ordinance #933, as amended is hereby amended as follows: A) Parking Facilities, p.5 shall be amended by adding thereto the following paragraph: "Off-street parking facilities will be needed in surrounding neighborhoods impacted by adjacent intense land uses. The area around Flathead High School should have additional off-street parking to relieve the pressure of over 400 student vehicles parking on the streets." B) Traffic, Transportation and Parking, p.7 shall be " Amended by adding thereto the following paragraph: "The neighborhood adjacent to Flathead High School experiences 40 the highest rate of traffic accidents at intersections in the Kalispell area. Location of additional off-street parking adjacent to the designated collector of 5th Ave. West will help alleviate the congestion and accidents in the residential area. A minimum of one city block should be considered to provide adequate off-street parking for the 400 plus student vehicles parking on the streets." C) Redevelopment Goals, --Parking, p.9 shall be amended to read as follows: "To provide a system of off-street parking facilities which recognizes the needs of the shopper, the businessman, the resident, the high school student, and the employee." D) Redevelopment Objective, p.9 shall be amended so that the tenth paragraph reads as follows: "To develop multi --level parking structures in the Core Area with surface lots on the fringes and the neighborhood sur- rounding Flathead High School to provide for both the shopper and short-term parker, and the long-term parker, employee, resident and student." SECTION II. All other parts and portions of the Kalispell Downtown Redevelopment Plan, Ordinance #933, as amended, not amended hereby remain the same. SECTION III. That the jurisdictional area of the Kalispell Downtown Redevelopment Plan is hereby expanded to include that area as described in Exhibit "A", attached hereto and for purposes of this Ordinance made a part hereof. SECTION IV. This Ordinance shall become effective thirty (30) days from and after its final passage by the Council and approval by the Mayor.
