ORDTNANCE NO. 1112 M
AN ORDINANCE REGULATING THE DTSPLAY OF OUTDOOR ADVERTTSTNG AND ART
FORMS UPON CITY RTGHTS-OF-WAY AND UPON CITY OWNED PROPERTY, REPEALING
§19-23 KALISPELL CITY CODE AND DECLARTNG AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY Or KALTSPELL, MONTANA
AS FOLLOWS:
SECTION I. No person, firm, corporation, organi_zati.on or
partnership shall erect, cause to be. erected, or place,
paste, post or affix within the City right-of-way or upon
any City owned property, excluding offices or work space not
directly accessible- to the public., sculpture, design, art
form, placard, bill, notice, sign or billboard without com-
plying with terms of this Ordinance.
SECTION II. A) Every person, fir.n, corporation, oranization,
or partnership that desires to erect, cause to be erected,
place, post, paste or affix any picture, photograph, drawing,
sculpture, design, art form, placard, bill_, notice, sign or
billboard within City right-of-way or upon any City owned
property shall, prior to engaging in such activity, make an
application for an Outdoor Display Permit to the Director of
Parks & Recreation.
B) The application referred to above shall be in the -
form of a letter to the Director of Parks & Recreation and
contain:
1) Dame of person responsible
2) Address and telephone number
3) Type of display
4) Purpose of display
5) Place of display
b) Approximate size of display
7) Duration of display
8) If possible, a drawing or photograph of display
C) Upon the receipt of the application, the Director of
Parks & Recreation shall review the application and forward
the application, along with his recommendation to the Parks
Committee of the City Council who shall consider the application
at a Parks Committee meeting.
D) The Parks Committeein considering an application
which is more than 90 days in duration shall request and
receive comments on the application from the Hockaday Board
and the Architectural Review Committee of the Community
Development Department. If an application for a display is
less than 90 days, the Parks Committee shall have authority
to pass on the application without review.
E) Upon receiving the comments from the Hockaday Board
and the Architectural Review Committee the Parkas Committee
shall make a recommendation either to issue or deny the
permit to the City Council.
F) The City Council shall review the findings of the
Parks Committee and direct the Director of Parks & Recreation
to issue or deny the permit.
SECTION III. Every permittee granted a permit under the
Ur finance shall construct and maintain the.outdoor display
in a safe condition. If the Director of Parks & Recreation
determines that the outdoor display has become unsafe, he
shall have the authority to order its immediate removal.

SECTION TV. The provisions of the Ordinance are severable,
and if any part of this Ordinance should be found to be
invalid, such invalidity shall not affect the remaining
provisions:
SECTION V. Any person, firm, corporation, organization, or
partnership violating any provision of this Ordinance shall
be guilty of a misdemeanor and be fined not more than $500
and/or imprisoned for a term of 90 days and a separate
offense shall be deemed committed on each day during or in
which a violation occurs or continues.
SECTION VI. Section 19-23 Kalispell City Code is hereby
repealed.
SECTION VII. This Ordinance shall take effect 30 days after
its passage by the City Council and approval by the Mayor..
