AN CIDTAANCE AMENDING ORDINANCE NO. 629 OF THE CITY OF KALgPELL, BY
PROHIBITTNG THE DISTRIBUTION OLD HANDBILLS, CIRCULARS, AND ADVERTTSEMENT
LITERATURE WITHIN Tl1E CITY, ESTABLISHING A PENALTY THEREFORE, AND
PROVIDING AN EFFECTIVE DATE.
BE TT ORDATNED BY THE CITY COUNCIL OF THE CITY OF KALISPELL, MONTANA
AS FOLLOWS:
SECTION I. Ordinance No. 629 of the City of Kalispell
(Section 19-13 Kalispell City Code) is amended so that it
A reads as follows:
A) It shall be unlawful and punishable as provided
under this Ordinance for any person, firm, cDrpor--
ation, enrit.y or pai nership to deliver any
handbills, advertising matter, circulars or cards
to or upon any street, sa_dewalk, public- place,
public way or private premises in. the City excep,_
by being handed to the recipient, placed upon a
porch, stoop or entxance way of a building so as
to prevent any such articles from being blown about,
becoming scattered or in any way causing litter.
B) It shall be un.l.awful to distribute handbills,
advertising matter, circulars or cards by affixing
the same to vehicles parked within. the City.
C) It shall be unlawful to deliver any advertising
matter, circular, or handbill to any premises where
the owner or occupant has told the distributor or
person making deliveries that he does not desire
to receive such material.
D) If any handbill., advertising matter, circular
or card is found to be distributed in violation of
this Ordinance th.e person, firm, corporation, entity
or partnership whose name appears upon the advertise
meet as the sponsoring party shall be prima facie
responsible for such violation and subject to the
penal.t_y therefore.
E) Any person, firm, corporation, entity or partner-
ship found guilty of violating this Ordinance shall.
be fined a sum not to exceed $100.00.
SECTION II. This Ordinance shall become effective from and
after thirty (30) days of the passage by the City Council
and approval by the Mayor.
